Resolution in support of a
60%/40% split of the Room Occupancy Tax Receipts
60% to the Beach Renourishment Fund and
40% to the Cape Fear Coast Convention & visitors Bureau
Whereas, tourism is the #1 industry in New Hanover County and
provides more year-round jobs for the county, more sales tax
collections, increased assessed valuations, capital investments and
higher ad valorem tax collections, and
Whereas, the tourism portion of the New Hanover County Room
Occupancy tax has produced a return on the local level that
surpasses other economic tools, and
Whereas, New Hanover County is ranked 9th in North Carolina for
travel expenditures and has been surpassed by counties with higher
tourism marketing budgets, and
Whereas, it is essential that continued growth in the room
occupancy tax be stimulated by additional funding to market the
whole New Hanover County travel experience more aggressively;
otherwise, we will not be able to compete effectively with other
areas bent on continuing to increase their share of the domestic
and international markets at our expense, and
Whereas, an increase in funding to tourism assures numerous non-
profit attractions such as Thalian Hall, Wilmington Railroad Museum
and st. John's Museum of Art, promotional programs, and
Whereas, in order to compete, the Cape Fear Coast Convention &
visitors Bureau needs to expand to promote and market the film
industry which has a great impact on our economy, and
Whereas, Room Occupancy tax receipts provide the funding for beach
renourishment, which is a vital need in New Hanover County and is
supported in full by the travel industry, and
Now, therefore, Be It Resolved that New Hanover County Board of Commission
,does hereby support disbursement of 60% of the room occupancy tax
to the Beach Renourishment Fund, and 40% to the Cape Fear Coast
Convention and visitors Bureau.

SALE OF SURPLUS PROPERTY
BY THE CITY OF WILMINGTON AND/OR NEW HANOVER COUNTY
By resolutions duly adopted by the City Council of the City of Wilmington
and the Board of Commissioners of New Hanover County, the City of Wilmington
and New Hanover County proposes to accept an offer to purchase a certain parcel
of real property located in New Hanover County owned by the City of Wilmington
and/or New Hanover County. The identification of the offer is as follows:

The offer to purchase is subject to the following terms and conditions:
"
(1) That the offers are unconditional and may not be revoked.
(2) That the City of Wilmington and/or New Hanover county shall retain as
liquidated damages any deposit posted if any offerer fails to pay the
balance due in cash and secure the deed within 10 days of notice by
certified mail or if returned undelivered within 10 days of the last
attempted delivery.
(3) That all sales are subject to final approval by the City Council of
the City of Wilmington and/or the Board of Commissioners of New

Hanover County.
(4) That the use of the property and construction of any structures
improvements, changes or additions shall at all times comply with all
applicable federal, state or local laws, rules and regulations.
The proposed sale of this property is being conducted pursuant to North
Carolina General Statute 160A-269 and is subject to upset bid. The public will
take notice that within ten days after publication~ of this advertisement, any
person may raise the bid by not less than 10% of the first $1,000 and 5% of the
remainder. Upset bids may be in writing and must be delivered to the City
Clerk, accompanied by a deposit of 5% of the total increased bid. The deposit
must be by cash, cashier's check, certified check or bid bond. Upon receipt of
an upset bid, the City Clerk shall readvertise the offer at the increased bid
and otherwise ,follow the statutory procedures until no further qualifying upset
bids are received. When no further qualifying bids are received, the City
Council and/or Board of Commissioners may accept the offer and sell the
property to the highest bidder for cash.
The City Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover County reserve the right to reject any and all
offers at any time. The proposed sale is made subject to the above conditions
together with all outstanding taxes, liens or other encumbrances, if any; title
shall be conveyed by bargain and sale deed without warranty; and the property
will be sold in its present condition "as is" without any improvements by the
City.

The City Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover county intend to decide whether it will accept or
reject the highest offer within a reasonable time not to exceed thirty days
from the date of the published advertisement. Any and all deposits shall be
forfeited if a bid is accepted by the City and then withdrawn by the bidder.

RESOLUTION OF SUPPORT OF
CANDIDACY OF BETTY LOU WARD
FOR NACo THIRD VICE PRESIDENT
WHEREAS, North Carolina has a uniquely strong leadership role in the National Association of
Counties and traditionally comprises the largest contingent at any NACo conference, from 10 to
12 percent of the total attendance, and is one of a few states with 100 percent membership in
NACo; and
WHEREAS, many of our county officials volunteer their time and hard work to serve, and often
lead, important NACo committees and task forces; and
WHEREAS, our Association President Betty Lou Ward is a long-time member and current vice-
chair of NACo's Health Steering Committee, and also has served on four other NACo task forces
on such issues as ethics, volunteerism, science and technology, and crime legislation; and
WHEREAS, she has demonstrated strong leadership skills as our State Association President,
including presiding over the 1995 Legislative Goals Conference, appointing an Annexation
Study Committee, and representing the Association on several important State Committees, such
as the Public School Forum, the Human Services Automation Policy and Planning Council, and
the State-Local Partnership Council; and
WHEREAS, Betty Lou Ward was urged to seek the office of NACo Third Vice President
by state association presidents across the nation, and she has expressed a strong desire and
enthusiasm for seeking the office and has developed a platform based on issues of concern to our
county officials, and is prepared for a hard-working campaign; and
WHEREAS, the Board of Directors of the North Carolina Association of county commissioners
enthusiastically supports the candidaGY of Betty Lou Ward for NACo Third Vice President, and
pledges its energy and support in the campaign.

PROCLAMATION
Whereas, New Hanover County has been fortunate to have a citizen who so unself,
ishly has given of his time to help boys and girls in our community; and
Whereas, this outstanding citizen, Mr. Earl Jackson, has been employed by the
Community Boys and Girls Club for the past forty, four years and has been an integral
part of the lives of countless inner, city youths; and
Whereas, he has served as a role model and leader throughout the community with
a special way of caring for his fellowman;
Now, Therefore, Be it Resolved,
by the New Hanover County Board of Commissioners to proclaim March 24, 1995 as
"Earl Jackson Day"
in New Hanover County to recognize and honor this exemplary citizen
for the years of service given to the youth of our community.

ENDORSEMENT OF THE
LOWER CAPE FEAR WATER AND SEWER AUTHORITY
THE COUNTY OF NEW HANOVER fully endorses the request of the
Lower Cape Fear Water and Sewer Authority for the sponsor of a bill
through the General Assembly in the amount of two hundred thousand
($200,000.00) dollars for a special appropriation to fund the Cape
Fear River Program.
WHEREAS, current proposed standards affecting point source
dischargers, primarily large manufacturing facilities, are based on
previous data which is inconclusive and not complete; and
WHEREAS, the project description allows for the placement of
fifteen (15) sampling stations throughout the Lower Cape ~ear River
for uniform collection of data; and
WHEREAS, more realistic and logical future effluent
limi tations for users of the River can best be determined and
imposed from uniform, accurate data; and
WHEREAS, limitations and constraints will have a widespread
economic impact throughout the region; and
WHEREAS, the study will be conducted under the guidance of the
Center for Marine Science Research at the University of North
Carolina at Wilmington overseen by an advisory board representing
industry, environmentalists, academia, civic organizations, local,
state and federal agencies; and
WHEREAS, project data will be used to form the first
comprehensive model for basin-wide management to protect a vital
natural resource.
BE IT THEREFORE RESOLVED, that the County of New Hanover
respectfully requests the support of our legislators in the region
to cooperatively sponsor a bill at the request of the Lower Cape
Fear Wate~ and Sewer Authority for the funding of the Cape Fear
River Program.

RESOLUTION OPPOSING THE ADOPTION OF
PROPOSED STATE LEGISLATION REGARDING PUBLIC TRUST WATERS
WHEREAS, municipalities and communities in Coastal North
Carolina are subjected to stringent rules and regulations as a
result of their proximity to public trust waters; and
WHEREAS, these municipalities and communities play major roles
in supporting tourism, the State's number two industry; and
WHEREAS, the general public relies heavily on private
enterprise to provide means of boating access to the public trust
waters of our State; and
WHEREAS, proposed legislation coming before the 1995 General
Assembly poses additional burdens on commercial and private marina
and dock facilities with the implementation of easement fees for
existing and future marinas, docks, piers and other structures
located over public trust waters; and
WHEREAS, some proposals for legislation suggest that the
easement fees should additionally be placed on private docks, such
as a pier constructed at a private waterfront residence; and
WHEREAS, the passage of such legislation creating such new
fees could cause existing marinas to close, create substantial
increases in marina charges for services which will be passed on to
the general public, and prohibit the construction of new facilities
necessary to accommodate the growing needs of our State's tourism
industry and the general public, all of which would have a
detrimental effect on the tourism industry, general public, and the
strength, stability and growth of our local economy;
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County
Board of Commissioners does hereby oppose the adoption of such
State legislation and requests that the General Assembly carefully
consider the consequences and negative impacts such legislation
would have on both the public and private sectors of Coastal North
Carolina communities and the State's tourism industry.
