NEW HANOVER COUNTY BOARD OF COMMISSIONERS
FACE COVERINGS RESOLUTION
WHEREAS, the World Health Organization declared COVID -19, the disease caused by a novel strain of the
coronavirus, a pandemic on March 11, 2020; and
WHEREAS, the global COVID -19 pandemic has infected more than 21 million people worldwide, more
than five million Americans, more than 145,000 people in North Carolina, and nearly 3,000 New Hanover
County residents; and
WHEREAS, COVID -19 has claimed the lives of more than 170,000 people in the United States and 21
people in New Hanover County; and
WHEREAS, COVID-19 is spread through the airborne transmission of infectious droplets from individuals
sneezing, speaking, and coughing; and
WHEREAS, the Centers for Disease Control (CDC) has determined that proper social distancing and the
use of face coverings slows the spread of the virus; and
WHEREAS, New Hanover County has been engaged in an aggressive campaign to educate the public
following guidance from Public Health and the CDC on the use of face coverings, frequently washing
hands, and sanitizing surfaces; and
WHEREAS, on June 24, 2020, Governor Roy Cooper issued Executive Order 147 requiring the use of face
coverings in public settings; and
WHEREAS, the CDC recommends simple face cloth coverings for the general public that can be made from
household items for a relatively low cost; and
WHEREAS, to reduce the spread of the virus, the CDC recommends the use of cloth face masks in public
settings where other social distancing measures are difficult to maintain, including office buildings.
NOW, THEREFORE BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby
requires the use of face coverings in all county and municipal buildings, subject to consent by municipal
governments, by employees and the visiting public based on the guidance issued under Executive Order
147.

RESOLUTION
AWARD OF CONTRACT TO JURISLINK AS A SOLE SOURCE VENDOR
FOR THE PURCHASE OF A VIDEO -FIRST APPEARANCE SYSTEM
WHEREAS, Clerk of Court Jan Kennedy and her staff have brought forth a solution that will allow for the
expansion of remote court appearances while automating most of the scheduling functions making for a
more efficient process for the clerk's staff and the detention center staff, and
WHEREAS, the proposed system would replace the video appearance systems currently in use in three
courtrooms and the special proceedings room and expand the capabilities into a fourth courtroom. This
is a turn -key system that includes all of the components necessary for video appearances from the
detention center to all of the courtrooms and also allows for appearances from other remote locations;
and
WHEREAS, the IT team has researched this solution and finds that it meets the expectations of the staff
with the clerk's office and others in the judicial system and recommends the purchase of this system. It
does not overlap with other systems that are provided by the State Administrative Office of the Courts;
and
WHEREAS, NCGS 143- 129(e)(6) exempts purchases of apparatus, supplies, materials, or equipment from
competitive bidding requirements when:
(i) performance or price competition for a product are not available;
(ii) a needed product is available from only one source of supply; or
(iii) standardization or compatibility is the overriding consideration; and
WHEREAS, JurisLink is the sole owner and manufacturer of the system; therefore, there is no available
price competition. Compatibility and standardization is necessary and supported by the following:
• The critical need for the system to interface with state's official court calendar system, and
• JurisLink's ability to interface the video appearance equipment with the calendaring
components of the system.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners approves the
award of contract to JurisLink as a sole source vendor for the purchase of a Video -First Appearance System
in the amount of $302,700.

Section 2: Explanation
BA 21 -006 appropriates $238,950 in fund balance from the General Fund for new equipment needed by the Clerk of
Superior Court for remote appearances. New Hanover County utilizes video technology to facilitate video -based first
appearance proceedings and would like to implement a solution to expand remote court appearances and automate
scheduling functions. The proposed system would replace the video appearance system currently in use in three
courtrooms and the special proceedings room. This system would also allow for expansion into a fourth courtroom,
which is needed for social distancing in response to the pandemic. Equipment for this new courtroom would be
purchased using $63,750 in available CARES Act funds (Coronavirus Relief Fund) that were previously budgeted.
The total cost of this system is $302,700, with a recurring annual maintenance cost of $30,000.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County, North
Carolina, that the Ordinance for Budget Amendment(s) 21 -006 amending the annual budget ordinance for the fiscal
year ending June 30, 2021, is adopted.

WHEREAS, the New Hanover County Sheriff's Office desires to purchase two (2) bomb suits from
K4ed-Eng,LLC;and
WHEREAS, Med-Eng, LLC has been the sole provider of bomb suits to the Sheriff's Office for the
past twenty-three (23) years; and
WHEREAS, N[G5 143-I29(e)/6\ exempts purchases of apparatus, supplies, materials, or
equipment from competitive bidding requirements when:
(i) performance or price competition for a product are not available;
(ii)a needed product is available from only one source ofsupply; or
(iii) standardization or compatibility is the overriding consideration; and
WHEREAS, standardization is the overriding consideration for purchasing the bomb suits from

WHEREAS, each bomb suit cost $36,816 for atota| cost of $73,632 for both. One of the bomb

RESOLUTION
AWARD OF CONTRACT TO AGILENT TECHNOLOGIES AS A SOLE SOURCE VENDOR FOR THE
PURCHASE OF A GAS CHROMATOGRAPH /MASS SPECTROMETER (GC /MS)
WHEREAS, the Sheriff's Office is facing a need to replace its existing equipment used in seized
drug analysis due to the fact that the equipment will reach its end of guaranteed support as of
January 1, 2021; and
WHEREAS, the New Hanover County Sheriff's Office Forensic Laboratory wishes to purchase a
GC /MS from Agilent Technologies, Inc., as a sole source provider. NCGS 143- 129(e)(6) exempts
purchases of apparatus, supplies, materials, or equipment for competitive bidding requirements
when:
(i) performance or price competition for a product are not available;
(ii) a needed product is available from only one source of supply; or
(iii) standardization or compatibility is the overriding consideration.
WHEREAS, the Sheriff's Office has identified standardization or compatibility as the overriding
consideration due to:
• North Carolina State Crime Laboratory validation of the equipment.
• Agilent's ability to provide collaboration with other forensic labs.
• Many shareable controlled substance libraries are built on Agilent's platform.
• Expanding or changing personnel would be simplified because many qualified drug
chemists in governmental labs are familiar with or have been trained on an Agilent
GC /MS.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
approves the award of contract to Agilent Technologies as a sole source vendor for the purchase
of a gas chromatograph /mass spectrometer in the amount of $125,685.
