A resolution is submitted that is calling on the county and its municipal partners to require face coverings inside public facilities when social distancing is not practicable. Board of Commissioners - August 24, 2020 ITEM: 2 NEW HANOVER COUNTY BOARD OF COMMISSIONERS FACE COVERINGS RESOLUTION WHEREAS, the World Health Organization declared COVID -19, the disease caused by a novel strain of the coronavirus, a pandemic on March 11, 2020; and WHEREAS, the global COVID-19 pandemic has infected more than 21 million people worldwide, more than five million Americans, more than 145,000 people in North Carolina, and nearly 3,000 New Hanover County residents; and WHEREAS, COVID -19 has claimed the lives of more than 170,000 people in the United States and 21 people in New Hanover County; and WHEREAS, COVID -19 is spread through the airborne transmission of infectious droplets from individuals sneezing, speaking, and coughing; and WHEREAS, the Centers for Disease Control (CDC) has determined that proper social distancing and the use of face coverings slows the spread of the virus; and WHEREAS, New Hanover County has been engaged in an aggressive campaign to educate the public following guidance from Public Health and the CDC on the use of face coverings, frequently washing hands, and sanitizing surfaces; and WHEREAS, on June 24, 2020, Governor Roy Cooper issued Executive Order 147 requiring the use of face coverings in public settings; and WHEREAS, the CDC recommends simple face cloth coverings for the general public that can be made from household items for a relatively low cost; and WHEREAS, to reduce the spread of the virus, the CDC recommends the use of cloth face masks in public settings where other social distancing measures are difficult to maintain, including office buildings. NOW, THEREFORE BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby requires the use of face coverings in all county and municipal buildings, subject to consent by municipal governments, by employees and the visiting public based on the guidance issued under Executive Order 147. Crowell, Clerk to the Board Board of Commissioners - August 24, 2020 ITEM: 2 - 1 - 1 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: 8/24/2020 Consent DEPARTMENT: IT PRESENTER(S): Leslie Chaney, Chief Information Officer CONTACT(S): Jan Kennedy, Clerk of Superior Court SUBJECT: Adoption of a Resolution to Award a Contract to JurisLink as a Sole Source Vendor for the Purchase of the JurisLink System BRIEF SUMMARY: For a number of years, New Hanover County has utilized video technology to facilitate video -based first appearance proceedings, eliminating the need to transport inmates between the detention center and the courthouse. This has long been viewed as a more efficient and secure process for these proceedings. The solution that has been used in New Hanover County is strictly for the video portion of the process with no additional tools for scheduling, so this activity remains a very time- consuming manual process for both the detention center and court staff. With the advent of the COVI D -19 pandemic, there has been a heightened interest in expanding the number and types of court proceedings that might be handled via video, eliminating the need for an in- person appearance. Clerk of Court Jan Kennedy and her staff have brought forth a solution that will allow for the expansion of remote court appearances while automating most of the scheduling functions making for a more efficient process for not only the clerk's staff and the detention center staff, but for the public who use the court system as well. The proposed system would replace the video appearance systems currently in use in three courtrooms and the special proceedings room and expand the capabilities into a fourth courtroom. This is a turn -key system that includes all of the components necessary for video appearances from the detention center to all of the courtrooms and also allows for appearances from other remote locations. The IT team has researched this solution and finds that it meets the expectations of the staff with the clerk's office and others in the judicial system and recommends the purchase of this system. It does not overlap with other systems that are provided by the State Administrative Office of the Courts. Procurement: The New Hanover Clerk of Court wishes to purchase the JurisLink System as a sole source procurement. NCGS 143 - 129(e)(6) exempts purchases of apparatus, supplies, materials, or equipment for competitive bidding requirements when: (i) performance or price competition for a product are not available; (ii) a needed product is available from only one source of supply; or (iii) standardization or compatibility is the overriding consideration. JurisLink is the sole owner and manufacturer of the system; therefore, there is no available price competition. Compatibility and standardization is necessary and supported by the following: • The critical need for the system to interface with state's official court calendar system • JurisLink's ability to interface the video appearance equipment with the calendaring components of the system The total cost of the integrated system is $302,700 and a budget amendment has been prepared for Board approval. New Hanover County utilizes video technology to facilitate video -based first appearance proceedings and would like to implement a solution to expand remote court appearances and automate scheduling functions. The proposed system would replace the video appearance system currently in use in three courtrooms and the special proceedings room. This system would also allow for expansion into a fourth courtroom, which is needed for social distancing in response to the pandemic. Equipment for this new courtroom would be purchased using $63,750 in available CARES Act funds (Coronavirus Relief Fund) that were previously budgeted. The total cost of this system is $302,700, with a recurring annual maintenance cost of $30,000. Section 3: Documentation of Adoption This ordinance shall be effective upon its adoption. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County, North Carolina, that the Ordinance for Budget Amendment(s) 21 -006 amending the annual budget ordinance for the fiscal year ending June 30, 2021, is adopted. Trabucco, CEO and Attorney at Law New Hanover County JurisLink Proposal 6/2/20 7/27/20 1 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 1 About JurisLink: JurisLink was founded in 2010 by a practicing criminal defense attorney. JurisLink is the result of spending countless hours on the road or waiting for a client at the facility, or even waiting for a visitation room to open up. Prior to the launch of JurisLink there was no way for an attorney to have a secure meeting with his /her client other than meeting in person. JurisLink has consulted Attorneys (private and public defenders) Jail staff, U.S. Marshals, Agents, as well as both Federal and State Law Enforcement Agencies in order to deliver a simple yet secure video - conferencing solution. JurisLink provides the equipment as well as the software solution necessary to make video - conferencing painless for the users. Too often, solutions are not utilized after they are purchased. JurisLink utilizes CafeX's WebRTC solution. WebRTC software is built around web standards and uses SSL and sRTP for signaling and media flows. It has end -to -end encryption and is one of the most secure methods of web communication today. CafeX is an industry leader in Google's WebRTC platform. JurisLink launched its CafeX solution in 2009. CafeX is on the cutting edge of WebRTC technology and has recently benefited from a $20 Million capital infusion from Intel. CafeX's vision, paired with Intel's backing, has ensured that WebRTC will continue to expand and alleviate the need for costly endpoints while alleviating the typical fear of video - conferencing due to a number of downloads and plugins that most users typically do not understand. With our CafeX/WebRTC solution our meeting space opens like a webpage. • The Federal Public Defender for the Eastern District of North Carolina (EDNC) uses JurisLink and has saved countless driving hours and increased office efficiency. Although Federal inmates may be housed hours apart, they can see multiple inmates in minutes versus hours. The Chief District Court Judge in the Eastern District approved JurisLink as a reimbursable expense as it has shown to save upwards of $1500 per meeting for CJA Panel Attorneys. JurisLink has saved the federal government hundreds of thousands of dollars in travel time and mileage reimbursement. The Eastern District of North Carolina Federal courts, Onslow (4 Courtrooms), Duplin (2 Courtrooms) Carteret and Craven (2 Courtrooms), Cleveland, and Bertie, Lincoln, Counties have implemented the JurisLink Video Arraignment Solution to realize cost savings and address security concerns. We are in the process of finalizing contracts with Sampson and Franklin Counties 2 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 2 JURIS�INK ENABLING JUDICIAL EFFICIENCY Statement of Work for JurisLink Attorney /Client Visitation System and Video First Appearance System /JurisLink Purpose: The purpose of this proposal is to provide the USPO County with: 1) A video -first appearance system that allows video -first appearances. The Judge /Clerk will initiate the session and there will be cameras for the Judge, Prosecution, Defense, and Defendant. All cameras including the kiosk will auto - initiate. A courtroom microphone system will be installed so that the defendant can hear everyone in the courtroom and that everyone can hear the defendant clearly. The Clerk will have a monitor and a microphone and there will be a large screen LCD monitor for public viewing. The Clerk will have the ability to present the first- appearance forms to the defendant for viewing and e- signature. Once signed the completed document will be emailed to the clerk's computer and will be available for printing. 2) New Hanover County will also have access to our remote court calendaring system that allows any or all participants to attend court remotely. Project Duration: The term of the agreement is for sixty (60) months. The term begins on the day of the first successful video . Project Scope: JurisLink, Inc. will provide the following services: Project Management: • Communicate expectations of JurisLink, Inc. and New Hanover County and assist and /or make changes necessary to obtain AOC approval on the JurisLink system. • JurisLink will provide a their own internet circuit (Spectrum) and cover all associated costs. • JurisLink will meet with the New Hanover County Judges, and New Hanover County Clerk's Office, New Hanover County IT, to customize the user interface, courtroom setup, and to customize the JurisLink e- signature documents interface. • Provide technical support and training for all New Hanover County staff and attorneys. • Provide maintenance and equipment to keep the kiosk in operational order. • JurisLink will assist New Hanover County to submit the video - conferencing plan to the North Carolina Administrative Office of the Courts for approval. • JurisLink will encourage all court staff to contact them with questions, problems, or suggestions to improve the efficiency and effectiveness of the JurisLink system in New Hanover County. Equipment List: JurisLink, Inc will provide the following equipment in each Courtroom: • Judge: PC, Monitor, Microphone and Camera 3 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 3 • Clerk: PC, Monitor, Microphone and Black /white printer • Defense: Microphone, Camera, and Hotphone to connect with inmate for secure attorney /client communications. • Prosecution: Microphone Defense camera covers • Courtroom: One or two 65 inch wall mounted LCD television and speakers with wireless connect capabilities. Can be supplemented for mobile carts. Amplifier, Mixer, complete courtroom sound system and wireless presentation system and jury microphone system • Jail: PC, Secure Kiosk with Microphone, Handset, camera and private communication method • Other Courtroom: e- signature and document review at defense tables for each courtroom. Customized for NCH specifications. • Other Courthouse: 3 Public viewing monitors with integration into AOC calendaring system. 12 Public access kiosks for affidavit of indigency forms. Cost: The initial installation, equipment, and JurisLink Software licensing fees per courtroom are $63,750.00. (4 courtrooms= $255,000) Kiosks at jail are also included and will be installed as space and privacy allows within the current jail environment. The above fees include a video station at the Behavioral health unit. 3 Televisions with Mini -PC's programmed for scrolling courtroom calendars with daily updates from AOC installed by JurisLink $3900 each 3 Total ($11,700) 12 Kiosks for e- documents outside courtroom for affidavit of indigency to be filled out by defendants outside of courtroom and auto print to each clerk station. 12 total @ $3000 each installed by JurisLink. (Total $36,000) All Internet connectivity is managed on a networks provided and paid for by JurisLink. Costs is included. Annual Maintenance and Software fees are included in the initial cost per Courtroom and for all other equipment. During Years 2 -5, the annual JurisLink Software Licensing Fees and Annual Maintenance Fees for each courtroom is $7500. (Annually 4 Courtrooms $30,000) (Licensing and maintenance includes access to JurisLink courtroom calendaring system and e- documents outside of court etc.) It also includes all replacement costs of all equipment with the exception of theft or willful destruction. The second year begins on the earliest of the anniversary of the first video - arraignment or July 1st of the following year. This is due upon receipt. JurisLink will submit an invoice to New Hanover County annually for License and Maintenance Fees One half (50 %) of the initial contract amount is due within 30 days of the signing of this agreement. Twenty -five percent (25 %) is due upon the completion of the installation of all equipment listed in the "proposal". The Final payment of twenty -five percent (25 %) is due within 30 days of the FIRST successful video -first appearance. The contractual costs are outlined in the graph marked as Exhibit "A" and are incorporated herein by reference as if fully restated. 4 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 4 Warranty: JurisLink warrants the courtroom and Jail equipment for 1 year and shall provide for timely replacement of any equipment failure thru the JurisLink HotSwap Program. (Theft or destruction of equipment is excluded from coverage). Licensing & The annual licensing and maintenance fee covers all software upgrades, Maintenance support, training and equipment replacement costs. (Excluding theft or destruction). Technical Support: For video -first appearances JurisLink technical support is available Monday - Friday 8:00 am- 6:00 pm. JurisLink will utilize logmein.com for remote support. Equipment Support: JurisLink will send a technician as needed, on location, within a 4 -5 hour response time. Timing: JurisLink anticipates that the system will be installed and implemented within 90 days of the date of the signing of this agreement assuming that adequate power wiring and Internet is installed in a timely manner. The installation time- line is also subject to AOC approval and both parties agree that the timing of such approval is out the control of JurisLink and New Hanover County. Project Assumptions: • New Hanover County will provide adequate power in order for JurisLink, Inc. to install and operate the equipment in the courtrooms and for the kiosk inside the jail. • JurisLink will not share or disseminate any inmate information to any third parties unless required by law. • JurisLink will provide all specific data, audio and video wiring for each Courtroom and Jail. Terms and Conditions. • New Hanover County will provide access and permissions to the appropriate resources in a timely manner. • New Hanover County will not provide JurisLink's operational procedures to any third parties to the extent permitted by law. Video Arraignment System "Courtroom experience ": The video - arraignment system will allow for video -first appearances. Court sessions will be opened by the Judge /Clerk and all of the monitors /cameras /microphones will auto initiate. The Judge and Clerk's monitors will show the Defendant. The flat panel monitors in the courtroom will show the Defendant for viewing by the Prosecution, Defense, and general public. The defendant will see and hear all parties during the session and JurisLink will ensure that all statutory and AOC requirements are met. The JurisLink system is a web -based system utilizing WebRtc. All video and audio feeds are high definition, encrypted, and cannot be monitored or recorded. Current support voice codecs are G.711, 5 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 5 G.722, iLBC, iSAC, and VP8 is the supported video codec. The list of supported video codecs may change in the future. The JurisLink System operates on separate PC's to ensure that the video and audio feeds are comparable to what is experienced on a commercial television without any noticeable delays. The JurisLInk System complies with all North Carolina General Statutes related to video court sessions. The jail is equipped with a customized and fully automated kiosk. The Defendant will have a handset with a microphone and speaker. When the Judge opens Court, the kiosk automatically activates and shows all parties. Once the court session is over, the kiosk automatically turns off. The JurisLink System can support up to 5 people in a conference. An interpreter or a witness may appear from a remote location by simply logging in from their PC without having to attend court. They would be seen and heard at all times by all parties. eDocuments & eSianature Caoabili The JurisLink Software solution has the capability to allow Defendants to either; (A) fill out and sign the Affidavit of Indigency and /or (B) fill out and sign the Waiver of Counsel forms. This process takes place without the Defendant having to appear in person and the documents do not have to be transported to their respective courtrooms. The Clerk will have the capability to print the signed documents prior to and during that days Court. (There is no price change if this option is utilized). The JurisLink eDocument & eSignature solutions are a standard feature found in JurisLink's Software and we encourage utilization of this solution. DATA RETENTION AND SERVER INFORMATION There will be no data stored on any PC, Kiosk or at the server. TERMINATION FOR CAUSE New Hanover County shall have the right to terminate this Agreement if (a) service provider breaches any of its duties or obligations and has not cured such breach within thirty (30) days after receipt of written notice from the New Hanover County. JurisLink, Inc. shall have the right to terminate this agreement if New Hanover County breaches any of its duties or obligations and has not cured such breach within thirty (30) days after receipt of written notice from JurisLink, Inc. 6 Board of Commissioners - August 24, 2020 ITEM: 3 - 3 - 6 RETENTION OF EQUIPMENT In the event of termination or expiration of this agreement JurisLink retains ownership of the kiosk within the jail. Any data lines will remain in place. New Hanover County will retain any and all equipment located in the courtrooms. Further, all understandings contained herein are contingent upon the timely passage of appropriate funding resolutions by the parties' respective governing bonds. RECITALS WHEREAS, the United States Department of Justice has announced the availability of certain Edward Byrne Memorial Assistance Grant Funds through its Office of Justice Programs, Bureau of Justice Assistance; and WHEREAS, pursuant to federal law The Attorney General of the United States and The United States Department of Justice, Bureau of Justice Statistics, has determined and certified that the county bears more than fifty percent of the prosecution or incarceration costs arising from Part 1 violent crimes; and WHEREAS, the County and the City recognize that it would be in mutual best interest of all parties, as well as, the furtherance of the public interest and advancement of public safety, to cooperate one with the other in the Edward Byrne Memorial Justice Assistance Grant Process, and further, to enter into an agreement to equitably share said grant funds. Based on the individual funding needs as determined by the parties and subject to the approval of each parties' governing board, each parry may contribute a proportional share of any matching funds if deemed appropriate. 4. Board of Commissioners - August 24, 2020 ITEM: 9 NEW HANOVER COUNTY AIRPORT AUTHORITY Number of members: 7 appointed by Board of County Commissioners Terms of Office: 4 years - appointees may not serve more than two consecutive terms and cannot be reappointed until at least two years have expired since the end of their last term. Compensation: None; however, the chairman is allowed a maximum of $350 per month, other members $300 per month, for automobile /travel expenses. Meetings: Meetings are held on the first Wednesday of every month at 5:00 p.m. in the Airport Terminal Conference Room. Statute or cause creating Authority: General Statutes Chapter 404, Senate Bill 410; NHC Board of Commissioners approved expansion from 5 to 7 members on September 15, 2014. Purpose: The Airport Authority constitutes a corporate and politic body that has the power and authority to: (1) purchase, acquire, establish, construct, own, control, lease, equip, improve, maintain, operate, and regulate the Airport for the use of airplanes, and other aircraft, and all facilities incidental to the operation of the Airport; (2) to purchase, acquire, own, hold, lease and /or operate real or personal property; (3) to acquire by purchase, lease, or otherwise and to hold lands for the purpose of constructing, maintaining or operating the Airport and to make contracts and lease agreements, to charge and collect fees, royalties, rents; (4) to make rules and regulations as necessary for the proper maintenance, use, operation and control of the airport or airport facilities owned, leased, or controlled by the Authority; (5) to provide penalties for violation of such rules and regulations; (6) to sell, lease, or dispose of any property, real or personal, belonging to the Airport Authority with sale of real property requiring approval of the County Commissioners; (7) to purchase insurance; (8) to deposit or invest and reinvest funds; and (9) to operate, own, lease, control, regulate, or grant to others the right to operate a business on the Airport premises, and to issue revenue bonds. The Airport Authority shall make an annual report to the Board of Commissioners setting forth in detail the operations and transactions conducted by it. Following Hurricane Florence, individuals who used mobility devices could NOT only find an affordable place to live, but one that was accessible as well. As our population increases and more people choose to age in place the concept of visitability should also be embraced. At disAbility Resource Center, not only do we provide services to people with disabilities but over 51% of our staff are individuals with disabilities. We understand the importance of affordability, accessibility and equal access, especially for individuals whose only income is SSI. It would be a great honor to share the experiences, observations and data to support the need to address the population whose income is $1000.00 or less per month and how it all intersects with so many other areas in our local economy 911, Emergency Room visits, higher re- admission rates at the hospital, individual safety risks, and even loss of human life). Qualifications for serving I have 10+years of experience helping people with disabilities try to find housing on an extremely low fixed - income, with no or poor credit. I often refer to this population as the "hidden homeless." These are individuals who due to their disability can't go into a shelter for a myriad of reasons. They often resort to staying with strangers and mere acquaintances. Often these situations put them at further risk for their personal safety and health as well. Someone who is on disability and receives CAP -DA services will lose those services within 30 days after they become homeless. I understand how the referral processes works at all levels including emergency sheltering, low income tax credit properties, targeted housing program, Section 8, public housing, transitional housing, supportive housing and permanent housing. Additionally, cIRC applied jointly with the Wilmington Housing Authority in September 2019 for a grant that provided 28 non - elderly, disabled, section 8 vouchers. As exciting and beneficial as that is, we quickly discovered that even with the additional vouchers, we need more landlords to accept the voucher so individuals can secure a place to live. As a member of the National Council for Independent Living's housing subcommittee I have gained valuable experience learning from others housing disability advocates from across the United States who are also addressing the affordable housing crisis. It was our dream to retire in Wilmington. Serving on the NHC Library Advisory Board would provide me with the opportunity to share my knowledge and skills with fellow Board members. Were I to be appointed to serve on the Board, learning firsthand the challenges facing NHC Libraries, particularly at this difficult time due to COVID -19, would be educational, demanding and fulfilling. What areas of concern would you like to see addressed by this committee? For more than thirty years, I have witnessed firsthand the transformation of libraries from print to digital collections. This transformation has never been more essential to the continuing value of our New Hanover County Libraries than since COVID- 19 struck. Members of the public can easily access the North Carolina Digital Library collections through Libby. But do they? These are difficult times for everyone but also provide new opportunities for education and life long leaming available through our NHC Libraries. There are three areas of concern: 1) ensuring that when NHC schools reopen, with continued online classes for many or most students, there are sufficient strategies in place for NHC Libraries to partner with local teachers to ensure student use of the digital collections; the degree to which the Libraries are able to reach out to and provide services for the vision impaired; growth of the digital collections, possibly by becoming an online only Federal Depository Library to provide access to self - selected digital information from all branches of the Federal Government, as well as e- books, via the Government Publishing Office's online catalog.
