2020 at 2:00 p.m. at 230 Government Center Drive, Suite 110, to discuss the below items.

2:00 p.m. Item 1: The Oaks at Murray Farms – Preliminary Plan
Request by Paramounte Engineering, Inc. for The Oaks at Murray Farms, a
performance residential development, consisting of 62 single-family lots, 34
duplexes, and 204 apartment units for a total of 300 units. The subject property is
located near the 8300 block of “Old” Market Street and the 8300 block of Shiraz
Way, consists of 52.39 acres, and is zoned (CZD) RMF-L.
2:15 p.m. Item 2: 3008 North Kerr Avenue Flex Space – Commercial Site Plan
Request by Port City Consulting Engineers, PLLC for a commercial site plan for a 4-
unit office/warehouse building (7,081 sf) within the North Kerr Industrial Park. The
subject property is located at 3008 North Kerr Avenue, consists of 1.24 acres, and
is zoned I-2.

The following comments have been received for the October 7, 2020 TRC meeting.
Please note: following the TRC meeting, a revised site plan addressing each of the below items must be
resubmitted prior to receiving approval.

1. In addition to these written comments, please see the attached staff markups.
2. Please update the plan with the following general corrections:
a. Please update the existing/proposed zoning on the site data table.
b. Please add the max height of the townhomes and single-family homes to the site data
table.
c. Please add the number of bedrooms per unit per building type, and square footage of the
clubhouse, to the parking calculations.
d. Open space for RMF districts is now required to be 20% of the gross area of the project.
Please update the site data table.
e. Please update wetland notes to indicate no impacts are proposed.
3. Please indicate the exact location of where street right-of-ways will be dedicated, and where access
easements will be provided.
4. Will the sidewalks along the townhomes be included in an access easement if no right-of-way is
proposed?
5. Please extend the sidewalk to connect to the existing sidewalk on Rosemary Lane, and extend the
sidewalks along the other road connections to the property line.
6. Please add a sidewalk along the road accessing townhomes #1-6.
7. Tree Removal:
a. Specimen Trees (Live Oaks 36” and over) cannot be removed unless a variance is obtained
from the Board of Adjustment. The plan shows two specimen trees are to be removed.
Can you highlight those trees on the plan? In addition, the plan shows a 48” Oak being
removed south of building seven. This tree is not included on the tree removal table.

b. Please note, that any lot that is less than one acre and shown on an approved preliminary
plan is exempt from the tree retention standards.
c. Please extend tree protection fencing along the protected trees in the bufferyard
southeast of building 3.
d. A mitigation plan is required prior to final plat approval.
8. Landscape Plan:
a. Please provide a landscape plan showing compliance with the bufferyard, parking lot,
screening, and foundation planting regulations.
9. All exterior lighting in the multi-family portion of the project shall be designed to not exceed 0.5
foot candles when measured at the property line. Please provide documentation to confirm
compliance with this regulation.
10. Please provide the most recent Jurdistictional Determinations from the USACE.
11. Any concerns with the required bufferyard along the townhomes and possible backyard
improvements? No improvements (ex. Patios) would be permitted in the bufferyard.
Fire Services, David Stone, 910-798-7458
1. Fire apparatus access roads shall not exceed a 10 percent grade.
2. All new buildings will shall comply with Section 510 of the NC Fire Code, Emergency Responder
Radio Coverage Survey shall be conducted. It is recommended that a pre-construction survey be
completed (Pre-construction surveys are not mandatory). This does not apply to the single family
and duplex section of this development.
3. All new buildings shall comply with Appendix J of the NC Fire Code, Building Information Signs.
(This does not apply to the single family and duplex portion of this development.
4. If a building is required to be sprinklered, Fire Department Connection (FDC) location must be
approved by the Fire Marshal's Office.
5. Sprinklered buildings must have a fire hydrant within 100 feet of the FDC.
6. All sprinklered buildings must have a Knox Box installed.
7. All access gates must be designed according to the NHC Fire Services gate requirements and
submitted through COAST to the NHC Fire Marshals off for plan review.
NHC Engineering, Phil Bevilacqua, 910-798-7072
1. A New Hanover County Stormwater Authorization-to-Construct is required. Stormwater control
measures are required to maintain the pre-development runoff rate for the 2-, 10- and 25-yr
storms. Analysis for the 100-yr storm is required to verify that no buildings are flooded.
2. On-site collection systems are required to be designed for the 25-yr storm and analyzed for the
100-yr storm.
3. Off-site drainage is required to be delineated and conveyed through the site in accordance with
NHC standards (25-yr design & 100-yr analysis).
4. A drainage easement is required for off-site drainage conveyances and is to be sized according
to NHC standards.

5. The large channel through the site has steep, eroding banks. It will need to be in stable
condition for the county to accept it for maintenance. There may be potential to create flood
plain to stabilize it and reduce discharge from the site.

1. This project has not been submitted for a land disturbing permit at this time.
Cape Fear Public Utility Authority, Bernice Johnson, 910-332-6620
1. Utility Plan Review required by CFPUA
2. CFPUA water and sewer available (sewer may require mainline extension).
3. At this time capacity is available.
4. DWQ permit application will require a Planning FTSE; as we are working towards incremental
capacity upgrades at the downstream pump stations.
5. Capacity is also dependent on the analysis of the pipe collection system (gravity and force mains).
6. A capacity determination can be provided upon submittal of the NC DWQ FTA/FTSE Application
Form and a Preliminary Plan, this determination does not guarantee capacity.
7. Capacity is issued to projects on a first come, first serve basis, when capacity is available, the plans
meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by the Authority.

These preliminary comments and are based on the plans as submitted for the proposed site and are
subject to further review upon receipt of any additional information. Subsequently, additional comments

1. A NCDOT Driveway Permit is required. Submit a plan in accordance with pages 14 and 15 of the
Policy on Street and Driveway Access to North Carolina Highways to include access locations
within 500’ of the proposed access on both sides of the State road. Submit to the local NCDOT
District Engineer’s Office.

a. Please include the overall square footage for the building and individual units in the Site
Data Table.
b. Please revise the dumpster enclosure detail on Sheet C-7.1 to reflect 8 feet in height per
Section 5.4.5.B of the UDO.
c. Please show/verify that the parking spaces adjacent to Kitty Hawk Road are blocked or
curbed to prevent vehicles either from overhanging planting islands or landscaped yards
by an average of more than one foot per Section 5.4.6.D of the UDO.
d. Are there anticipated tenants for this proposal? If so, will there be managerial positions
associated with each business? Will company vehicles remain on-site after business hours
or? Both of these would need factored into the minimum parking standard per the
warehouse parking standard.
2. Please note that the parking lot interior landscaping is 8% of the total area used for parking,
loading, driveways, internal drive aisles, and other vehicular use areas.
a. If the area behind the building is being used for storage, please label it accordingly. This
area would not be included in the interior landscaping calculation because it would not
be used for vehicular use.
i. Vegetation may be planted around the perimeter of the rear and sides of the
property to achieve the 8% landscaping.
b. Please include the dimensions of the landscape islands.

4. It appears that the existing trees shown on Sheet C-2 meet Section 5.3.4.C of the UDO that
requires a minimum of 15 trees with at least a 2-inch caliper be retained or planted on the site for
each acre disturbed by the proposed development.
5. According to Sheet C-2, a 14” Laurel Oak will be removed in order to construct the driveway.
a. A tree removal permit will be issued with the approval of this commercial site plan.
However, this is not a significant tree so mitigation is not required.
6. Is there any intention of installing signage? If so, please note any proposed sign is subject to
Section 5.6 of the UDO.
7. It appears that a portion of the driveway, parking area, and landscape islands encroach into
drainage easements.
a. Please note that the drainage easement still has to be accessible and the county is not
responsible if it is damaged during maintenance activities.
8. Please provide all NCDOT approvals upon receipt.

1. I conducted a site visit on September 11, 2020. County Fire Services approves with the following
conditions:
a. No storage over 12-foot-high, unless High Piled/Rack Storage permits received from this

Department connection.

2. Please note that the parking lot interior landscaping is 8% of the total area used for parking,
loading, driveways, internal drive aisles, and other vehicular use areas.
a. Please include the dimensions of each landscape island to ensure the 8% landscaping is
satisfied.
b. Additional area may need added to the ends of the parking aisle to meet this requirement.
3. Section 5.3.4.C of the UDO that requires a minimum of 15 trees with at least a 2-inch caliper must
be retained or planted on the site for each acre disturbed by the proposed development.
a. Please confirm that there is existing vegetation along the perimeter of the property that
aids in meeting this requirement.
b. Additional vegetation is encouraged around the stormwater pond if existing vegetation is
not sufficient.
4. Please include a transitional buffer along the western property boundary adjacent to the
residential property. In addition, all vegetation must be outside of the existing drainage easement
and meet the opacity requirements using one of the options listed below (Section 5.4.4.D):
a. a planted buffer strip (minimum of 6’ in height + 100% opacity),
b. a combination of plantings and fencing (fencing 6-10’ in height; if solid fence, two rows of
plantings at 3’ in height + 50% opacity; if permeable fence, two rows of plantings + 100%
opacity within one year of planting), or

c. a combination of a berm and plantings (combined height of berm and plantings at a
minimum of 6’ in height and 100% opacity within one year of planting).
i. Is the existing fence at least 6’ in height? Will any slats, panels, or privacy screens
be installed in the chain linked fence along this property line?
ii. If so, this fence may be incorporated into the transitional buffer if slats, panels,
or privacy screens are installed.
5. Once a field survey is completed, please show the necessary vegetation that will be used to
supplement the existing vegetation along the northern property line.
6. Please note that the Board of Commissioners amended the Exterior Lighting standards in the UDO
(Section 5.5) on September 8, 2020. Please see the below figures from Section 5.5.4 of the UDO
and confirm the site will meet these provisions.
a. Please note the illuminations are measured at ground level at the lot line in foot candles.
b. Please note that these standards would not apply to security lighting controlled and
activated by motion sensors for a duration of 15 minutes or less.
7. Is there any intention of installing new signage? If so, please note any proposed sign is subject to
Section 5.6 of the UDO.
