Vice-Chairman Barfield stressed the importance of informing
. the public with supporting facts and figures on cost
effectiveness of a consolidated government.
Chairman Gottovi, on behalf of the Consolidation Study
Commission, recommended the establishment of a Charter
Commission. She stressed the importance of legal expertise in the
staffing of the Charter Commission with assistance of a financial
expert and other outside agencies.
After a lengthy discussion of a consolidated government and
its costs effectiveness, Chairman O'Neal, on behalf of the Board,
expressed appreciation to the members of the Consolidation Study
Commission for an excellent job in preparing the report and the
many hours given of their time.
Chairman O'Neal announced a Public Hearing had been
scheduled for September 30, 1985, at 7:00 o'clock P.M. in the
Assembly Room of the County Administration Building to give the
public an opportunity to express their views and opinions.
ADJOURNMENT
Commissioner O'Shields MOVED, 'SECONDED by Commissioner
Retchin to adjourn the meeting. Upon vote, the MOTION CARRIED
UNANIMOUSLY.

ASSEMBLY
The New Hanover County Board of Commissioners met in
Special Session on Friday, September 13, 1985, at 9:30 o'clock
A.M. in Room 50l of the County Administration Building, 320
Chestnut Street, Wilmington, North Carolina.
Members present were: Commissi~ners Claud O'Shields, Jr..;
Fred Retchin; Chairman Nolan O'Neal; County Manager, G. Felix
Cooper; and County Attorney, Robert W. Pope.
Members absent were: Vice-Chairman Jonathan Barfield, Sr.;
and Commissioner John Dolan.
County Attorney Pope was the Acting Clerk.

Chairman O'Neal called the meeting to order stating the
purpose of the meeting was to discuss pending litigation of the
EPA/Flemington Lawsuit. : I

DISCUSSION OF PENDING LITIGATION - EPA/FLEMINGTON LAWSUIT
County Attorney Pope informed the Board of a pending trial
set for October 28, 1985, in Eastern District Federal Court in
Wilmington. He introduced Attorney Jack Gardner, Attorney Scott
Hedrick and Attorney Mark Kurdys, members of the'Law Firm of
Hedrick, Eatman, Gardner and Kincheloe with offices in Charlotte
and Wilmington.
Attorney Gardner explained that he and the other attorneys
present were representing New Hanover County in this suit brought
by the United States/EPA stating that. discussion was needed on
serious and sensitive developments with reference to the lawsuit
recommending an executive session.
EXECUTIVE SESSION
Commissioner O'Shields MOVED, SECONDED by Commissioner
Retchin to convene from Regular Session to Executive Session for
discussing pending litigation. Upon vote, the MOTION CARRIED AS
FOLLOWS:

Commissioner O'Shields
Chairman O'Neal
Absent: Commissioner Dolan
Vice-Chairman Barfield

Chairman O'Nea'l convened the meeting to' Executive Session at
9:43 o'clock A.M.
Commissioner O'Shields MOVED, SECONDED by Commissioner
Retchin to reconvene to Regular Session. Upon vote, the MOTION
CARRIED AS FOLLOWS:
Voting Aye: Commissioner O'Shields
Commissioner Retchin
Chairman O'Neal
Absent: Commissioner Dolan
Vice-Chairman Barfield
Chairman O'Neal reconvened the meeting to Regular Session at
10:44 o'clock A.M.
ADJOURNMENT
Commissioner Retchin MOVED, SECONDED by Commissioner
O'Shields to adjourn the Special Meeting. Upon vote, the MOTION
CARRIED AS FOLLOWS:
