MINUTES OF SPECIAL MEETING, OCTOBER 17, 1985 - PENDING LITIGATION
EPA/FLEMINGTON LAWSUIT
ASSEMBLY
The New Hanover County Board of Commissioners met in Special
Session on Thursday, October 17, 1985, at 9:00 o'clock A.M. in
the Assembly Room of the County Administration Building, 320
Chestnut Street, Wilmington, North Carolina.

Members present were: Commissioners Jonathan Barfield, Sr.:
John M. Dolan: Claud O'Shields, Jr.: Fred Retchin: Chairman Nolan
O'Neal: County Manager, G. Felix Cooper: County Attorney, Robert
W. Pope: and Clerk to the Board, Lucie F. Harrell.
Chairman O'Neal called the meeting to order stating the
purpose of the Special Meeting was to discuss pending litigation
of the EPA/Flemington Lawsuit.
County Attorney Pope introduced Attorney Jack Gardner amd
Attorney Mark Kurdys, members of the Law Firm of Hedrick, Eatman,
Gardner and Kincheloe stating they were representing the County
in the EPA/Flemington law suit.
EXECUTIVE SESSION
Commissioner Retchin MOVED, SECONDED by Vice-Chairman
Barfield to convene from Special Session to Executive Session for
discussion of pending litigation. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Chairman O'Neal convened the meeting to Executive Session at
9:11 o'clock A.M.

County Manager Cooper recommended the Executive Session to
be recorded. After discussion, it was the consensus of the Board
not to record the session.
Commissioner Retchin MOVED, SECONDED by Commissioner Dolan
to reconvene the meeting to Special Session. Upon vote, the
MOTION CARRIED UNANIMOUSLY.
Chairman O'Neal reconvened the meeting from Executive
Session to Special Session at 10:29 o'clock A.M.
ADJOURNMENT
Commissioner Dolan MOVED, SECONDED by Commissioner Retchin
to adjourn the Special Meeting. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Chairman O'Neal adjourned the meeting at 10:44 o'clock A.M.
