LEGISLATIVE INTENT/PURPOSE:
This resolution relates to the sale of surplus property jointly owned by the
City of wilmington and New Hanover County, more particularly identified as
follows:

160A-269 and there have been no qualifying upset bids for the identified
parcel(s).
The parcel(s) has been declared surplus by the County Commissioners and not
needed for public purposes.
RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners does hereby accept
the offer(s) to purchase identified herein from the offerer(s) as indicated.
2. That New Hanover County reserves the right to reject any and all offers.
3. That New Hanover County will retain any deposit posted by the offerer(s)
when:
a. The offer is withdrawn after posting the deposit.
b. The offerer(s) fail to pay the balance of an approved offer, due in
cash, within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
4. That any amount shown due on any attached list for liens be waived in total.
5. That the Chairman of the County Commissioners be and is hereby authorized to
execute a deed without warranties to the offerer(s) as designated herein.

Road(s) Description:
DORSETT PLACE (PHASE I)
WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above described
road(s), the location of which has been indicated in red on the attached map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described road(s), and to take over the road(s) for maintenance if they
meet established standards and criteria.
CERTIFICATE
The foregoing resolution was duly adopted by the Board of
Commissioners of the County of New Hanover at a meeting on the

WHEREAS, the U.S. Corps of Engineers has been requested to cut $2.0 billion out
of its annual public works budget of $3.5 billion over the next five years;
WHEREAS, the reduction in public works will eliminate numerous channel and inlet
maintenance projects crucial to the Nation's waterways transportation system;
WHEREAS, these cuts in New Hanover County would eliminate Corps maintenance
of Masonboro and Carolina Beach Inlets and possibly negatively impact beach nourishment
projects;
WHEREAS, these New Hanover County projects are vital to the County's economy
and to the maintenance of the waterways;
WHEREAS, public works projects of the Corps provide greater economic benefits
than costs;
/ WHEREAS, many of the public works projects have national significance;
WHEREAS, it would be grossly inefficient for local, state or other parties to assume
these public works projects; and
WHEREAS, abandonment of these projects by the Corps and subsequent
diminishment of Corps expertise, experience, and resources would significantly reduce
national readiness to respond to disaster or war;
NOW, THEREFORE BE IT RESOLVED, that the New Hanover County Board of
Commissioners states that it is imperative that the Corps of Engineers should continue its
economically valuable and nationally critical missions in public works projects, particularly
navigation maintenance and beach nourishment.

Resolution of Intent
To Close a Public Road
Nassau Road
Sedgefield Subdivision
WHEREAS, a petition has been filed pursuant to N.C G.S. 153A-241, requesting the
Board of Commissioners of New Hanover County to close the following described portion ofa
public road;
Being all of the northern right-of-way (60 feet) of Nassau Road beginning in the south-
west corner of lot 41 and part of the Sedgefield Subdivision, duly recorded in Map
Book 7, Page 31 of the New Hanover County Registry, commencing from said point 200
feet northeast to the northwest corner of lot 41, thence from said point 60 feet northwest
to the northeast corner oflot 31 and part of Sedgefield Subdivision recorded in Map
Book 7, page 31; thence 200 feet southwest to the southeast corner oflot 31, thence 60
feet southeast to the point of beginning.
NOW THEREFORE, BE IT RESOLVED, that this Board is considering closing said road
to public use and that a public hearing on this question will be held on the 5th of September, 1995
at 7:30 p.m. in the General Assembly Room of the County Courthouse, 24 North Third Street,
Wilmington, N.C. at which time the Board will hear all interested citizens and make a final
determination as to whether the road shall be closed

NEW HANOVER, NORTH CAROLINA,
AMENDING THE FLOOD PLAIN MANAGEMENT REGULATIONS OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN.
Section 1. That the Flood Plain Management Regulations of the County ofN ew Hanover adopted
April 3, 1978 as amended be and the same is hereby further amended as follows:
Amend Article IV Provisions for Flood Plain Management, Section 2 Specific Conditions,
d.(I) Manufactured Homes
(1) Manufactured Homes - All manufactured homes, except for those in an existing
manufactured home park as defined in this Ordinance. to be placed or substantially
improved in Zones Al-A30, AH and AO shall be elevated on a permanent foundation such
that the lowest floor of the manufactured home is at least two feet above the base flood
elevation and be securely anchored to an adequately anchored foundation system in
accordance with the provisions of subsection (2) below. Manufactured homes to be vlaced
or substantially improved in an existing manufactured home park as defined bv this
Ordinance must be placed on a permanent foundation such that the lowest floor is equal with
or ;ust above the 100 vear flood line. Such structures shall also complv with the anchoring
standard", set forth in subsection (2) below. ....
Section 2 Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of
such conflict is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general
welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force
and effect from and after its adoption.

A PRIVATE ROAD TO MAZUR DRIVE
ORDINANCE
It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the naming of a private road to Mazur Drive located in Cape Fear
Township, Castle Hayne community commencing approximately 1,650 feet west from the Castle
Hayne Road/Sondey Road intersection, extending 1,330 feet south from the south side of Sondey
Road and recorded as part of Map Book 1500, Page 931 of the New Hanover County Registry and
it further appearing that a public hearing was held on Monday, August 7, 1995, at which time all
persons were heard on the question of whether or not the naming would be in the public interest; and
it further appearing that notice of said hearing was transmitted to all resident owners and prominently
posted in at least two (2) locations along said road, and published in the Star News local newspaper,
and the Board of County Commissioners is of the opinion that said road in New Hanover County
should be named and the naming of same is in the public interest, the description of which is
delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road
is hereby named MAZUR DRIVE.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office of the
Register of Deeds of New Hanover County, North Carolina, and that notice of the action taken by
the Board of County Commissioners be transmitted to the postmaster having jurisdiction over the
road, the North Carolina Board of Transportation and to any city within five (5) miles of said road
in accordance with N.C. General Statutes 153A-240.

delivery of general County services, for the operation of commercial enterprises, for the response of
emergency and public safety vehicles, and for the convenience of the general public, and
WHEREAS, a comprehensive and systematic property numbering system is an efficient means
of identifying property within the County; and
WHEREAS, such a system will promote the health, safety, and welfare of the citizens of New
Hanover County.
THEREFORE, it further appearing that a public hearing was held on the 7th day of August,
1995, at which time all persons were heard on the question of whether or not assigning house
numbers would be in the public interest, and it further appearing that notice of said hearing was
prominently posted in at least two (2) locations along said street, that notice of the time, place and
subject matter of the hearing was prominently posted at the County Courthouse and published in a
newspaper of general circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above house number assignments
be made.
It is further ordered that a copy of this ordinance be transmitted to the Postmaster having
jurisdiction over the road, to the Board of Transportation, Sheriffs 911 Dispatcher and to any city
