RESOLUTION OF THE
BOARD OF COUNTY COMMISSIONERS
OF NEW HANOVER COUNTY
WHEREAS, Article 6, Chapter 162A of the North Carolina
General Statutes, as amended, provides that the board of commis-
sioners of any county may create a county water and sewer
district; and
WHEREAS, the New Hanover County Board of Commissioners
adopted a resolution on the 18th day of April, 1983, expressing
its intention to utilize said county water and sewer district
concept and Py notice called for a public hearing to consider
this matter at its regular meeting'on the 16th day of May, 1983,
at 9:00 a.m., in the County Commissioners' Assembly Room, 320
Chestnut Street, Wilmington, North Carolina, said notice having
been published once a week for three weeks in the Wilmington
Morning Star and posted in at least three public places in the
district described in said notice; and
WHEREAS, the public hearing to: consider the formation
of said county water and sewer district was held on Monday, May
16, 1983, at a regular meeting of the New Hanover County Board of
Commissioners and the Board of Commissioners having heard from
all interested persons, including the general public and staff
members, and after discussion, the Board of Commissioners finds
as a fact that there is a demonstrable need for providing sewer
services in the district hereinafter described,
that the
residents of such territory will benefit from the district's
creation, and that it is economically feasible to provide sewer

services in said district without unreasonable or burdensome
annual tax levies; and
WHEREAS, there are no cities or towns or incorporated
municipalities in whole or in part within the district which is
hereinafter described; and
WHEREAS, the territory to be embraced by and be within
the New Hanover County Water and Sewer District is as follows:
All of the unincorporated area of New Hanover County
lying and being North of Snow's Cut and Carolina Beach
Inlet and bounded as follows:
On the North by Pender County, on the South by Snow's
Cut and Carolina Beach Inlet, on the East by the
Atlantic Ocean and the Town of Wrightsville Beach, and
on the West by the Cape Fear River and the City of
Wilmington.
NOW, THEREFORE, BE IT RESOLVED by the New Hanover
County Board of Commissioners that a county water. and sewer
district be and the same is hereby created, to be known as the
New Hanover County Water and Sewer District and, BE IT FURTHER
RESOLVED that this resolution be published once in each of two
successive weeks in the Wilmington Morning Star; and
BE I'l' FURTHER RESOLVED that the terr i tory to be
included and embraced wi thin the New Hanover County Water and
Sewer District is as follows:

NOTICE OF INTENTION TO APPLY TO THE
LOCAL GOVERNMENT COMMISSION FOR APPROVAL OF BONDS
- - - - - - - - - - - - - - - - - -
NOTICE is hereby g1ven of intention of the undersigned
to file application with the Local Government Commission,
Raleigh, North Carolina, for its approval of the issuance of
bonds of the New Hanover County Water and Sewer District, which
bonds shall be subject to approval of the voters of said District
at an election and shall be for the following purpose and in the
following maximum amount:
$40,000,000 of bonds to pay capital costs of providing
sanitary sewer collection facilities, including the
acquisit10n and construct1on of lines, force mains and
interceptors and including the acquis1tion and instal-
lat10n of equipment and machinery required therefor and
the acquisition of land or rights-in-land required
therefor.
Any citizen or taxpayer of the New Hanover County Water
and Sewer District objecting to the issuance of any or all of
said bonds may, within seven days after the date of publication
of this notice, file with the Local Government Commission and
with the undersigned a written statement setting forth his
objections.
The statement shall set forth each objection to the
proposed bond issue and shall contain the name and address of the
person filing it.
