NORTH CAROLINA
BUY AND SELL AGREEMENT
NEW HANOVER COUNTY
This contract, made and entered into this 30th day of
October, 1984, by and between the NEW HANOVER COUNTY WATER AND
SEWER DISTRICT, a body politic and corporate of the State of
North Carolina, hereinafter referred to as "Buyer," and DANIEL
HARVIN and wife, RU'l'H HARVIN, of New Hanover County, North
Carolina, hereinafter referred to as "Sellers";

Subject to the terms and conditions h~reinafter set
forth, Sellers have contracted to sell to Buyer and Buyer has
contracted to purchase from Sellers that certain tract or parcel
of land located near the City of Wilmington, in Harnett Township,

New Hanover C01-lnty, North Carolina, and more particularly
described as follows:
Being all of Lot No. 156, Hillsdale Section 3, per plat
of the same recorded in Nap Book 5, Page 14, New
Hanover County Registry, and being the same property
conveyed to Sellers by deed dated October 18, 1949,
recorded in Book 486, Page 433, aforesaid Registry.
The terms and conditions of this sale and purchase are
as follows:
1. The agreed purchase price for said premises is
Eighteen Hundred and No/lOOths Dollars ($1,800.00), to be paid as
follows:
a. One Hundred and No/lOOths Dollars ($100.00)
upon the execution of this contract, the receipt of which is
hereby acknowledged by the Sellers;
b. Seventeen Hundred and No/lOOths Dollars
($1,700.00), the balance of the purchase price, upon the
delivery, to Buyer, of a warranty deed for said property.
2. Sellers agree and bind themselves, their heirs and
assigns, upon receipt of the payment of the purchase price for
said land, as hereinbefore provided, to execute and deliver to
the Buyer a good and sufficient deed, in fee simple, .conveying
said land and premises to, the Buyer, with general warranty and
free from all encumbrances except utility easements of record.
3. It is understood and agreed that said warranty
deed is to be executed and delivered on or before the 9th day of
November, 1984, and possession of said property is to be given
upon delivery of said deed.

4. It is further understood and agreed that, if the
within offer has not been accepted and the within contract
executed within ten (10) days from the date hereof, the offer on
the part of the Buyer is withdrawn.
5. Taxes for the real property shall be prorated to
the date of final settlement.
6. It is further understood and agreed that, in
consideration of the benefi ts inur ing to the parties hereto, the
terms and condi tions of this contract shall be binding upon the
parties hereto, their heirs, successors and assigns.
