PROJECT ORDINANCE
SEAGATE SEWER SYSTEM
BE IT ORDAINED, by the Board of District Commissioners of
New Hanover County Water & Sewer District:
WHEREAS:
1. New Hanover County Water & Sewer District (District) is
engaged in the development of the Seagate Sewer System, which
capital project involves the construction or acquisition of
capital assets.
2. District desires to authorize and budget for said
capital project in a project ordinance adopted pursuant to North
Carolina General Statute $159-13.2, such ordinance to authorize
all appropriations necessary for the completion of said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute $159-13.2.
2. The capital project undertaken pursuant to this ordi-
nance is the development of the Seagate Sewer System, which
project is herewith authorized.
3. The revenue that will finance said project is:

5. This ordinance supersedes the project ordinance for
Seagate Sewer System adopted November 7, 1983 by the Board of
Commissioners of New Hanover County.
6. This project ordinance shall be entered in the minutes
of the Board of District Commissioners. Within five days hereof,
copies of this ordinance shall be filed with the finance and
budget offices in New Hanover County, and with the Clerk to the
Board of District Commissioners.

Dear Property OWner:
Within the next two (2) to four (4) weeks New Hanover County
Water and Sewer District will be constructing a sewer
pipeline in the street right-of-way adjacent to your
property.
In order to allow construction to proceed in an orderly
manner the District Commissioners have approved the '
fOllowing Resolution:
NOW, THEREFORE
1. Prior to undertaking sewer line construction
activities within a street right-of-way, the District or its
agents or employees will make reasonable efforts to notify
all property owners adjacent to the street right-of-way that
construction will soon commence.
2. The notice will advise the property owner that the
owner will need to relocate all plants, trees, shrubbery,
fences and other items presently located within the street
right-of-way and not required by the North Carolina
Department of Transportation (NCDOT) to remain within the
street right-of-way.
3. If the property owner fails to remove said items,
District's contractor will remove the items and will not
replace or replant them.
4. The District's construction activities within
street right-of-way will include the regrading of drainage
areas and replacement of driveways and pavement to comply
with NCDOT requirements.
5. Upon completion of construction within a street
right-of-way, the District's contractor will reseed grass
only. The property owner will be responsible for the
replacement of grasses which require sprigging or plugging.

Commissioners of the County of New Hanover, sitting as the
governing board of said District, a body corporate and
politic, locat-ed in the State of North Carolina, was duly

having been given as required by North Carolina statutes,
and minutes of said meeting have been duly recorded in the
Minute Book kept by me in accordance with the law for the
purpose of recording the minutes of said Board.
2. I have compared the attached extract with said
minutes so recorded and said extract is a true copy of said
minutes and of the whole thereof insofar as said minutes
relate to matters referred to in said extract.
3. Said minutes correctly state the time when
said meeting was convened and the place where such meeting
was held and the members of said Board who attended said
meeting.

OF THE COUNTY OF NEW HANOVER,
SITTING AS THE GOVERNING BOARD OF THE
NEW HANOVER COUNTY WATER AND SEWER DISTRICT
The Board of Commissioners of New Hanover County, sitting as the
Board of District Commissioners of the New Hanover County Water
and Sewer District, met in regular session on the first floor of
the County Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, at 9:00 a.m. on Monday, June 17, 1985, with the
following memb~rs present:

moved that the
following resolution be adopted:
WHEREAS, the Local Government Commission of
North Carolina has informed the Board of Commissioners of
the County of New Hanover, sitting as the governing board of
the New Hanover County Water and Sewer District, that it has
sold in the manner prescribed by law the District's $17,000,000
Sanitary Sewer Bonds, Series 1985, dated June 1, 1985, and
that the contract of sale contemplates that the bonds shall
bear interest as hereinafter providedJ NOW, THEREFORE,
BE IT RESOLVED by the Board of Commissioners of
the County of New Hanover, sitting as the governing board of
lthe New Hanover County Water and Sewer District, as follows:

1 . The Bonds hereinbefore described shall bear
inte.res t as follows:
Bond s payable in each of the years 1986 to 1996,
inclusive, 7.90% per annum, and
Bond s payable in each of the years 1997 to 2005,
inclusive, 8.00% per annum.
2. This resolution shall become effective upon
its adoption.
