1985-06-17 W&S Exhibit -' ~ ; ~ PROJECT ORDINANCE SEAGATE SEWER SYSTEM BE IT ORDAINED, by the Board of District Commissioners of New Hanover County Water & Sewer District: WHEREAS: 1. New Hanover County Water & Sewer District (District) is engaged in the development of the Seagate Sewer System, which capital project involves the construction or acquisition of capital assets. 2. District desires to authorize and budget for said capital project in a project ordinance adopted pursuant to North Carolina General Statute $159-13.2, such ordinance to authorize all appropriations necessary for the completion of said project. NOW, THEREFORE, WITNESSETH THAT: 1. This project ordinance is adopted pursuant to North Carolina General Statute $159-13.2. 2. The capital project undertaken pursuant to this ordi- nance is the development of the Seagate Sewer System, which project is herewith authorized. 3. The revenue that will finance said project is: Bond Proceeds $ 635,960 725,800 71,688 183,512 Federal Grant Clean Water Bonds Transfer from New Hanover County TOTAL ~1=g1g=~g~ 4. Within five days hereof, copies of this ordinance shall be filed with the finance and budget offices in New Hanover County, and with the Clerk to the Board of District Commissioners. V' . !: l' Dear Property OWner: Within the next two (2) to four (4) weeks New Hanover County Water and Sewer District will be constructing a sewer pipeline in the street right-of-way adjacent to your property. In order to allow construction to proceed in an orderly manner the District Commissioners have approved the ' fOllowing Resolution: NOW, THEREFORE 1. Prior to undertaking sewer line construction activities within a street right-of-way, the District or its agents or employees will make reasonable efforts to notify all property owners adjacent to the street right-of-way that construction will soon commence. 2. The notice will advise the property owner that the owner will need to relocate all plants, trees, shrubbery, fences and other items presently located within the street right-of-way and not required by the North Carolina Department of Transportation (NCDOT) to remain within the street right-of-way. 3. If the property owner fails to remove said items, District's contractor will remove the items and will not replace or replant them. 4. The District's construction activities within street right-of-way will include the regrading of drainage areas and replacement of driveways and pavement to comply with NCDOT requirements. 5. Upon completion of construction within a street right-of-way, the District's contractor will reseed grass only.
