RESOLUTION
OF THE
BOARD OF DISTRICT COMMISSIONERS
OF THE
NEW HANOVER COUNTY
WATER AND SEWER DISTRICT
WHEREAS G.S. Chapter 153A, Article 15 authorizes counties
to establish water and sewer systems, and G.S. Chapter 162A,
Article 6 authorizes counties to establish water and sewer
districts; and
WHEREAS New Hanover County has established the New Hano-
ver County Water and Sewer District, which District has arranged
for construction of a sewer system in the unincorporated County;
and
WHEREAS the District desires to locate portions of the
sewer system within the rights-of-way of certain streets in New
Hanover County; and
WHERE~S various streets in New Hanover County have been
dedicated to the public use by the recordation of a subdivision
plat or other map; and
WHEREAS G.S. 153A-158 authorizes counties to acquire a
fee or lesser interest in real property by gift, grant or other
lawful method; and
WHEREAS New Hanover County desires to accept the offer of
dedication of certain streets for the pupposes of providing
sewer and water services to County residents by and through the
New Hanover County Water and Sewer District;
NOW, THEREFORE, BE IT RESOLVED as follows:
That New Hanover County Water and Sewer District hereby
accepts the offers of dedication of the portions of the streets
delineated in Exhibit 1, which is attached hereto and incorpor-
ated herein by reference, for the purposes of providing water

KNOW ALL MEN BY THESE PRESENTS, that New Hanover County Water and
Sewer District, a body politic hereinafter call "Grantor", in
consideration of the sum of $1.00, in hand paid by CAROLINA POWER &
LIGIIT COMPANY, the receipt whereof is hereby grants unto said CAROLINA
POWER & LIGHT COMPANY, hereinafter called. "Company", its successors
and assigns, the right, privilege and easement to go in and upon that
certain tract of lot of land situated. in Harnett Township in said
County and State, containing 9 lots, being the land described in deeds
recorded. in book 1317 page 294, book 1317 page 281, book 1341 page 459,
book 1350 page 689, book 1341 page 461, book 1349 page 397, book 1331
page 890, book 1326 page 539, book 1318 page 259, and book 1317 page
288, New Hanover County Registry, and to construct, maintain and
operate in, upon, and through said premises in a matter suitable to it,
with poles, wires, cables, underground conduits, and other necessary
apparatus and appliances, a line, or lines for the purposes of
transmitting power by electricity, together with the right at all times
to enter upon said pre~ises for the purpose of inspecting said lines
and making necessary repairs and alterations thereon; and the right to
per~it the attachment of and/carry in conduit wires and cables of any
other company or person; together with the right at all times to cut
a~~y and keep clear of said lines all trees and other obstructions that
may, in any way, endanger the proper maintenance and operation of the
same.
It is understood and agreed. that the right of way herein granted
is for a system of electric lines to provide service to the sewer lift
station on the land described above.
TO HAVE AND TO HOLD the aforesaid right, privilege and. easement
unto CAROLINA POWER & LIGHT COMPANY, its successors and assigns,
forever.

Dear Mr. Taft:
I hereby certify that the governing body of the New
Hanover County Water and Sewer District has analyzed the local
share of the costs of the proposed wastewater treatment
facilities, including the financial impact on this community and
the residents of the service.
As a result of the analyses, I have determined that the
District has the legal, institutional, managerial, and financial
capability to ensure adequate construction, operation and
maintenance, and replacement of the wastewater treatment works.
