Hanover County that :
RESOLUTION DECLARING THE RESULT OF THE SPECIAL
REFERENDUM HELD IN THE COUNTY OF NEW HANOVER ON
OCTOBER 10, 1995 UPON THE QUESTION OF APPROVING
THE CONSOLIDATION OF THE CITY OF WILMINGTON AND
THE COUNTY OF NEW HANOVER

Section 1, The New Hanover County Board of Commissioners of New Hanover County,
having received from the New Hanover County Board of Elections a certification evidencing said
Board's determination of the result ofthe canvass of the returns ofthe special referendum held in
the County of New Hanover on October 10, 1995 upon the question of approving the
consolidation ofthe City of Wilmington and the County of New Hanover, and does hereby
declare and certify the result of said referendum to be the result which is set forth in the
following, statement of the result of said referendum:

was submitted to the qualified voters of said County the following question:
Shall the City of Wilmington and the County of New Hanover be
consolidated and the consolidated unit assume the debt of each
secured by a pledge of faith and credit, the right to issue authorized
but unissued debt to be secured by a pledge of faith and credit
(including such debt as may be authorized for said City or County
on the date of this referendum) and any of said authorized but
unissued debt as may be hereafter issued, and be authorized to levy
taxes in an amount sufficient to pay the principal of and the interest
on said debt secured by a pledge of faith and credit?
At said referendum 86.447 voters were registered and qualified to vote, and,
11.390 votes were cast in favor of said question and 15.935 votes were cast against
said question. A majority of the qualified voters of said County who voted

Section 2. The Clerk to the New Hanover County Board of Commissioners of New
Hanover County shall file a copy of the foregoing statement of the results of said referendum in

statement once in The Wilmington Star-News. A statement in substantially the foregoing form
shall be published with the following statement:
Any action or proceeding challenging the regularity or validity of this referendum must
be begun within 30 days after the date of publication of this statement of result.

THE NEW HANOVER COUNTY BOARD OF ELECTIONS
FOR THE SPECIAL REFERENDUM
ON THE CONSOLIDATION OF THE
CITY OF WILMINGTON
WITH THE
COUNTY OF NEW HANOVER
ON THE 10TH DAY OF OCTOBER. 1995
WE, the undersigned Chairman and Members of the New Hanover County Board of
Elections, DO HEREBY CERTIFY that we met on October 12, 1995 at the hour of 11 :00
o'clock A.M., in the office of the Board of Elections in Wilmington, North Carolina, to canvass
the returns of the special referendum held in the City of Wilmington and the County of New
Hanover on October 10, 1995, and that the result of such canvass is as follows:
1. The total number of voters who voted "YES" in answer to the question, "SHALL the
City of Wilmington and the County of New Hanover be consolidated and the consolidated unit
assume the: debt of each secured by a pledge of faith and credit, the right to issue authorized but

. The total number of voters who voted "NO" in answer to such question was

3 Only the persons who had been duly registered were permitted to vote at said
referendum. The total number of voters who were registered and qualified to vote at said
referendum was

4. The polls for said referendum were opened at the polling places in the City and the
County on October 10, 1995, at the hour of 6:30 o'clock A.M., and were closed at the hour of
7:30 o'clock P.M., on that day.

result of the special referendum held for the City of Wilmington and the County of New Hanover

Road(s) Description:
BRANDY COURT (OFF WILLIAM LOUIS DRIVE)
Commissioners of the County of New Hanover requesting that the above
described road(s), the location of which has been indicated in red on the
attached map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described road(s), and to take over the road(s) for maintenance if they
meet established standards and criteria.

BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, on October 4, 1993, the Commissioners approved a contract with Correction
Enterprises, an agency of the State of North Carolina, to use inmate labor to perform a number of
jobs at W ASTEC and the Landfill;

AND WHEREAS, after review of the past year's operation under the current contract,
staff is requesting the renewal of the agreement for another year, year! y cost not to exceed
Sixty Thousand Dollars ($60,000);
AND WHEREAS, the Environmental Management Director, and the County Manager
recommend that the contract be renewed for an additional year;
AND WHEREAS, funds have been previously appropriated and are now in or will be in
subsequerh year's budget in Account No. 700-485- 4193-3700 to cover this contract;

NOW, THEREFORE, BE IT RESOL VED by the Board of County Commissioners

of New Hanover County that the contract for the use of inmate labor at W ASTEC and the Landfill
in the D~partment of Environmental Management, be renewed for and additional year with

Resolution Establishing Policy
for Optional Relocation Assistance
WHEREAS, New Hanover County, N C. has been allocatedfunds under Title 1 of the
Housing and Community Development Act of 1974, and
,
I
: WHEREAS, it is the objective, .spirit and intent qfthe Community Development Block
Grant! to achieve the revitalization of neighborhoods through improvements of housing
conditIons for low and moderate mcome citizens; and
WHEREAS, the rehabilitation of some dwelling units is so extensive that the work
cannot be accomplished without temporarily dislocating the residentsfrom their propaties;
and
WHEREA5: it is (?ften undesirable to permanently dislocated some residents from their
properties, change their status from homeowners to tenants~ or increase their financial burden
jor ~ousing costs; and
, WHEREAS, Section 570.496(a) qf the Community Development Block Grant
Reg/ilations permits a CDBG grantee to design and administer an "Optional Coverage"
relocation program which can provide benefits to owner occupants qf dilapidated units which
are. sU~Ject to removal through local code er!forcement activities (l1Jithout real property
acquisitIOn) or provide assistance to residents that are temporarily dlslucatedfrom their
properties; and
WHEREAS, such relocation-benefits must be utilized by the qual(fied reCIpient to'
acquire a standard dwelling umt or cover moving and related costs for those individuals
displaced by Block Grant acflvities (demolitIOn); and
WHEREA5', an Optional Coverage RelocatIOn Policy Plan has been prepared by the
Pl;ogram Administrator and has heen reviewed by the New Hanover County Board of
Commissioners, and
WHEREAS, it is the deSIre of New Hanover County to foster such worthy o~jectTves
l1dth the Community Development Block Grant Program.
'FHEREFORE, BE ITRESOLVED, that New Hanover County, NC does hereby adopt

a policy f?f "optional coverage relocation hene.fits" as setforth in Section 570.496(a) qfthe
Block G~ant Regulationsfor the Small Cities Block Grant Programs. Such policy is to cover
anyandlall financial obligatIOns incurred durmg any nece.s:s'Gry relocation qf affected citizens.

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION
FOR APPROVAL OF A FINANCING AGREEMENT AUTHORIZED BY
NORTH CAROLINA STATUTE 160A-20
I
WHEREAS, the County of New Hanover, North Carolina desires to acquire by installment
financing I an expansion of the current Social Services Building, with a construction price of
$890,000 :00 (the "Project") to better serve the citizens of New Hanover County; and
WHEREAS, New Hanover County desires to finance the Project by the use of an installment
contract authorized under North Carolina General Statue 160A, Article 3, Section 20; and
WHEREAS, findings offact by this governing body must be presented to enable the North
Carolina Local Government Commission to make its findings of fact set forth in North Carolina
General S~atute 159, Article 8, Section 151 prior to approval of the proposed contract;
NPW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of New Hanover
county, ~orth Carolina, meeting in regular session on the 16th day of October, 1995, make the
following!finds of fact.
1. The proposed contract is necessary or expedient because the installment financing will
make possible the construction by County of an expansion to the current Social
Services Building.
2 The proposed contract is preferable to a bond issue for the same purpose because, (i)
the installment financing will make expeditious acquisition of the needed expansion
possible; (ii) given the amount being financed, the transactional cost of the installment
financing method is the most economical
3. . The sums to fall due under the contract are adequate and not excessive for the
proposed purposed because the construction costs are the results of competitive bids
pursuant to state law and the interest rate is based on current market conditions.
4.. The County of New Hanover debt management procedures and policies are good
because the debt management policies of New Hanover County have been carried out
in strict compliance with governing law

5.j The annual debt service required for this proposed contract is currently budgeted,
I therefore no impact. However, if this had been a new budgetary item the impact
would be one third of a cent per $100 valuation.

6.[ The County of New Hanover is not in default in any of its debt service obligations.

7. The attorney for the County of New Hanover has rendered an opinion that the
proposed Project is authorized by law and is a purpose for which public funds may be
expended pursuant to the Constitution and laws of North Carolina.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Manager or Finance Officer
is hereby authorized to act on behalf of the County of New Hanover in filing an application with the
North Carolina Local Government Commission for approval of the Project and the proposed
financing contract and other actions not inconsistent with this resolution.
This resolution is effective upon its adoption this 16th day of October, 1995.
