A RESOLUTION OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
OPPOSING FORCED ANNEXATION
WHEREAS, the New Hanover county Board of Commissioners opposes
the forced annexation by cities of County citizens residing in the
unincorporated areas of a county; and
WHEREAS, the Board of Commissioners supported House Bill 96B
introduced in the 1993 Session of the General Assembly titled "An
Act To Restrict Forced Annexation"; and
WHEREAS, House Bill 96B would have required that prior to the
annexation of a proposed area that an election be held in which a
majority of the votes cast from the area to be annexed be for
annexation; and
WHEREAS, House Bill 96B did not come out of the Judiciary II
Committee and therefore is presently not a viable bill.
NOW, THEREFORE, BE IT RESOLVED THAT THE NEW HANOVER COUNTY
BOARD OF COMMISSIONERS encourages the North Carolina Association of
County Commissioners to support the introduction of a bill
identical to House Bill 968 to prevent forced annexation of County
citizens.

Commissioners of the County of New Hanover requesting that the above described

WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of

RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, the New Hanover County Board of Commissioners
owns a parcel of land in the Castle Hayne area which is to be
developed as a public recreation facility; and
WHEREAS, it is the intent of the New Hanover County
Board of Commissioners to develop Castle Hayne Park in accordance
with the Master Plan for the park; and
WHEREAS, the development of this park necessitates the
removal of pine and hardwood trees;
NOW, THEREFORE, BE IT RESOLVED by the New Hanover
County Board of Commissioners that the Director of the New
Hanover County Parks Department be authorized to proceed with the
sale and removal of said trees, in accordance with North Carolina
General Statute 160A-267.

A RESOLUTION
OF THE BOARD OF COMMISSIONERS
OF NEW HANOVER COUNTY
WHEREAS, swimming at certain times in specific
waterways and in portions of the ocean constitutes a public
safety hazard; and
WHEREAS, certain portions of unincorporated New Hanover
County beyond the Town limits of Wrightsville Beach pose special
logistical considerations in providing enforcement of water
safety ordinances; and
WHEREAS, New Hanover County has adopted, by resolution,
the Town of Wrightsville Beach swimming ordinances, rules, and
regulations to be effective for the designated areas of
unincorporated New Hanover County north of the Town limits; and
WHEREAS, the Town of Wrightsville Beach is agreeable to
enforcing its swimming ordinances, rules, and regulations on
behalf of New Hanover County pursuant to interlocal agreement.
NOW, THEREFORE, the Board of Commissioners of New
Hanover County hereby resolves as follows:
1. New Hanover County hereby adopts, for that portion
of unincorporated New Hanover County situated to the north of the
Town limits, those Town of Wrightsville Beach ordinances, rules,
and regulations pertaining to swimming, as may be amended from
time to time by the Board of Alderman.
2. New Hanover County shall authorize the Town of
Wrightsville Beach to enforce said swimming regulations pursuant
to local agreement giving the Town all necessary jurisdiction for
such purpose.
3. This Resolution shall continue until and through
September 1, 1996.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA,
AMENDING THE ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969,
as amended be and the same is hereby further amended as follows:
Amend Section 45-2 to read:
A non-conforming use may be changed to another non-conforming use only in
accordance with approval issued by the Board of Adjustment. The Board shall issue
such approval if it finds that the proposed use will be more compatible with the
surrounding neighborhood than the use in operation at the time the approval is applied
for; provided, however, the Board shall not approve a residential use of higher density
than that otherwise allowed in the zoning district. If a non-conforming use is changed to
any use other than a conforming use without obtaining approval pursuant to this
paragraph, that change shall constitute a discontinuance of the non-conforming use, and
the property involved may thereafter be used only for conforming purposes.

Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of
such conflict is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general
welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force
and effect from and after its adoption.

ORDER
It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the assignment of house numbers on GLAZIER ROAD located in
Cape Fear Township, numerical range 5000-5199.
WHEREAS, ready and accurate identification of developed property is important for the
delivery of general County services, for the operation of commercial enterprises, for the response
of emergency and public safety vehicles, and for the convenience of the general public; and
WHEREAS, a comprehensive and systematic property numbering system is an efficient
means of identifying property within the County; and
WHEREAS, such a system will promote the health, safety, and welfare of the citizens of New
Hanover County.
THEREFORE, it further appearing that a public hearing was held on the 8th day of August,
1994, at which time all persons were heard on the question of whether or not assigning house
numbers would be in the public interest, and it further appearing that notice of said hearing was
prominently posted in at least two (2) locations along said street, that notice of the time, place and
subject matter of the hearing was prominently posted at the County Courthouse and published in a
newspaper of general circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above house number assignments
be made.
It is further ordered that a copy of this ordinance be transmitted to the Postmaster having
jurisdiction over the road, to the Board of Transportation, Sheriffs 911 Dispatcher and to any city
within five miles of said road in accordance with N.C. General Statute 153A-240.

ORDINANCE
It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the renaming of Shannon Drive located in the Community
of Castle Hayne, Cape Fear Township, commencing approximately 450 feet north of the
Blue ClaylWoodhaven Drive intersection, extending west approximately 1,520 :!: feet to its
termination and recorded as part of Deed Book 1121, Page 1073 of the New Hanover
County Registry; and it further appearing that a public hearing was held on Monday,
August 8, 1994, at which time all persons were heard on the question of whether or not the
renaming would be in the public interest; and it further appearing that notice of said
hearing was transmitted to all resident owners and prominently posted in at least two (2)
locations along said road, and published in the Star News local newspaper; and the Board
of County Commissioners is of the opinion that said road in New Hanover County should
be renamed and the renaming of same is in the public interest, the description of which is
delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described
road is hereby renamed GLAZIER ROAD.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office
of the Register of Deeds of New Hanover County, North Carolina, and that notice of the
action taken by the Board of County Commissioners be transmitted to the postmaster
having jurisdiction over the road, the North Carolina Board of Transportation and to any
city within five (5) miles of said road in accordance with N. C. General Statutes 153A-240.

citizens of New Hanover County, and
WHEREAS, the Board of commissioners desires to ensure that the
yearly allocations to non-County agencies are spent for the purpose
for which they are allocated.
NOW, THEREFORE, BE IT RESOLVED BY THE NEW HANOVER COUNTY BOARD
OF COMMISSIONERS THAT:
The Board of County Commissioners reserves the right to make
on site visits, request information, and performance aUdits/reviews

Department of Public Instruction have identified many capital needs in the New Hanover
County Schools; and
WHEREAS, the one hundred counties of North Carolina appear to be in need of
additional revenue sources for capital needs of education and other pressing financial needs;
and
WHEREAS; an additio.rzallocal option-sales tax would help to provide funding for
necessary capital needs ofeduca(ion in New Hanover County and throughout the State of
