This 22nd day of August, 1994. /?~ Chairman, Board of County Commissioners ATTEST: ~ ~\;/ Cl rk to the Board Revised Ordinan~e l'1 D A RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, swimming at certain times in specific waterways and in portions of the ocean constitutes a public safety hazard; and WHEREAS, certain portions of unincorporated New Hanover County beyond the Town limits of Wrightsville Beach pose special logistical considerations in providing enforcement of water safety ordinances; and WHEREAS, New Hanover County has adopted, by resolution, the Town of wrightsville Beach swimming ordinances, rules, and regulations to be effective for the designated areas of unincorporated New Hanover County north of the Town limits; and WHEREAS, the Town of Wrightsville Beach is agreeable to enforcing its swimming ordinances, rules, and regulations on behalf of New Hanover County pursuant to interlocal agreement. NOW, THEREFORE, the Board of Commissioners of New Hanover County hereby resolves as follows: 1. New Hanover County hereby adopts, for that portion of unincorporated New Hanover County situated to the north of the Town limits, those Town of Wrightsville Beach ordinances, rules, and regulations pertaining to swimming, as may be amended from time to time by the Board of Alderman and approved by the Board of County Commissioners. 2. New Hanover County shall authorize the Town of wrightsville Beach to enforce said swimming regulations pursuant to local agreement giving the Town all necessary jurisdiction for such purpose. 3. Caster ABSENT: William Sisson * * * * * * CbmmissionerGreer presented the following resolution and moved that it be adopted: WHEREAS, the bond order hereinafter described has taken effect and the Board of Commissioners of the County of New Hanover (the "Issuer") desires to borrow money for the purpose for which bonds are authorized to be issued by said bond order in anticipation of the receipt of the proceeds of the sale of said bonds as hereinafter provided; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Issuer, as follows: (1) The sum of $5,000,000 will be borrowed by the Issuer in anticipation of the receipt of the proceeds of the sale of bonds authorized to be issued by the school bond order, ado~ted by the Board of Commissioners of the Issuer on January 3, 1994, for the purpose fo+ which said bonds are authorized to be issued. Negotiable notes, each designated "School Bond Anticipation Note," shall be issued for said sum so borrowed. (2) Said notes shall be dated September 27, 1994, shall be payable June 21, 1995 and shall bear interest from their date at a rate which shall not exceed twelve per centum (12%) per annum. Such interest shall be payable at the maturity of the said notes. Each of said notes shall be signed by the Chairman and the Clerk of the Board of Commissioners of the Issuer and the seal of the Issuer shall be affixed to each of said notes. (3) The power to fix the rate of interest to be borne by said notes and to determine the denomination or denominations of the notes and the place of payment of the notes is hereby delegated to the Chairman and Clerk of the Board of Commissioners of the Issuer who are hereby authorized and directed to cause said notes to be prepared and to execute said notes when they shall have been sold by the Local Government Commission of North Carolina. (4) The Chairman and the Clerk of the Board of commissioners of the Issuer are hereby authorized to make application to the Local Government Commission of North Carolina for its approval of said notes in the manner prescribed by The .Local Government Finance Act. Said Local Government Commission is hereby requested to sell the notes in the manner prescribedpy said Act. Said notes, when they shall have been sold by said commission in the manner provided by law and when they shall have be~n executed in the'manne~ prescribed by this resolution, shall -2- ~ ! be turned over to the state Treasurer of the state of North Carolina for delivery to the purchasers to whom they may be sold by said commission. (6) The power to make any election on behalf of the Issuer with respect to the arbitrage rebate provisions of the Code applicable to the notes is hereby delegated to the Chairman of the Board of Commissioners and the Finance Officer of the Issuer. Grease removal. (a) Grease and oil traps or other interceptors shall be provided at the user's expense, when such user operates an establishment preparing, processing or serving food and/or food products. Grease interceptors may also be required in other industrial or commercial establishments when they are necessary for the proper handling of liquid wastes containing oil and/or grease in amounts of excess of seventy-five (75) mg/l, or for any flammable wastes. All such traps, tanks, chambers or other interceptors shall be of a type and capacity approved by the County Engineer and shall be readily and easily accessible for cleaning and inspection. All such interceptors shall be serviced and emptied 'of the waste content as required, as frequently as thirty (30) days or as long as ninety (90) days, at the discretion of the County Engineer or his designee, in order to maintain their minimum design capability to intercept oils and greases from the waste water discharged to the public sanitary sewer. (b) Waste removed from grease interceptors shall not be discharged into the public sanitary sewer. The owner shall be responsible for the sanitary disposal of such wastes. (Ord. of 6-4-84, Art. V, Section 17-5.6) (c) The user shall maintain written records of trap maintenance for two (2) years. The user shall send a copy of the invoice for trap cleaning or similar "suitable record each time the trap is cleaned, to the County Engineer or his designee.
