RESOLUTION AUTHORIZING THE COUNTY COMMISSION TO EXECUTE A
QUIT CLAIM DEED CONVEYING ITS INTEREST IN LOTS TO THE CITY OF WILMINGTON
LEGISLATIVE INTENT/PURPOSE:
By resolution adopted April 19, 1994, the Wilmington City Council
authorized the conveyance of the indicated lots to Wilmington AME Zion
Housing Development Corporation (WHDC).
It is the City's desire that the County Commission authorize
coqveyance of its interest in and to this property to the City, in order
that these lots can then be conveyed to the WHDC.
These lots will be utilized for the construction of owner-occupied
single-family residences.
The WHDC is a Community Housing Development organization and has
funding up to $112,500 for the purpose of construction or moving existing
acceptable dwellings onto the properties.
NOW, THEREFORE, BE IT RESOLVED:
That the County Commission authorizes the Chairman of the New Hanover
Board of Commissioners to execute a quit claim deed conveying its interest
in and to the below indicated parcels unto the City of Wilmington.

RESOLUTION REQUESTING THE COUNTY COMMISSION TO AUTHORIZE
CONVEYANCE OF ITS INTEREST IN JOINTLY-OWNED LOTS TO THE CITY OF WILMINGTON
LEGISLATIVE INTENT/PURPOSE:
In accordance with the jointly-owned real property policy adopted by
City Council and the County commission, the following jointly-owned lots
have been identified by wilmington Housing Finance and Development, Inc.
(WHFD), as suitable for construction of owner-occupied, single-family
residences.
It is the City's desire that the County Commission authorize
conveyance of its interest in and to this property to the City, in order
that these lots can be conveyed to WHFD.
In accordance with the policy, WHFD must construct or move existing
owner-occupied single family residences onto the lots within 18 months.
NOW, THEREFORE, BE IT RESOLVED:

WHEREAS G S 18B-904(f) authorizes a governing body to designate an official, by name or by
position, to make recommendations concerning the suitability of persons or locations for ABC
permits and
WHEREAS the County of New Hanover, wishes to notify the NC ABC Commission of its
designation as required by G S 18B904(f),

AMENDING THE ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6,1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1 That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969,
as amended be and the same is hereby further amended as follows:
Amend Section 51.5-2, 8. to read:
8. When a development proposal is submitted under this section, it shall be
processed as a major subdivision (more than five lots), under the provisions
of the New Hanover County Subdivision Regulations as amended. (4/6/94)

Section 2 Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of
such conflict is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general
welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full
force and effect from and after its adoption.

consideration has been given to the renaming of a private road to FOX HUNT LANE located in
Pembroke Jones Park at Landfall and recorded as part of Map Book 31, Page 326 of the New
Hanover County Registry; and it further appearing that a public hearing was held on Monday,
October 3, 1994, at which time all persons were heard on the question of whether or not the renaming
would be in the public interest, and it further appearing that notice of said hearing was transmitted
to all resident owners and prominently posted in at least two (2) locations along said road, and
published in the Star News local newspaper; and the Board of County Commissioners is of the
opinion that said road in New Hanover County should be renamed and the renaming of same is in the
public interest, the description of which is displayed on the attached exhibit '

ORDINANCE
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road
is hereby named FOX HUNT LANE.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office of the
Register of Deeds of New Hanover County, North Carolina, and that notice of the action taken by
the Board of County Commissioners be transmitted to the postmaster having jurisdiction over the
road, the North Carolina Board of Transportation and to any city within five (5) miles of said road
in accordance with N.C. General Statutes 153A-240.

OF COMMISSIONERS
WHEREAS, New Hanover County desires to transfer its Home
Health Program to the New Hanover Regional Medical Center, along
with such personal property as records, computers, office
equipment, and licensing utilized in providing such services; and,
WHEREAS, the Medical Center will provide the Home Health
services in the manner set forth in General Statute Section 131E-8,
with the care available to the public on a non-discriminatory
basis; and,
WHEREAS, any personal property conveyed herein shall be used
for public purposes, and shall revert to New Hanover County should
such property cease to be so utilized.
WHEREAS, each employee transferred from New Hanover County
shall receive equal or better benefits at the New Hanover Regional
Medical Center as they had while employed with New Hanover County.
NOW, THEREFORE, THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS
does hereby resolve that the New Hanover County Home Health
program, together with staff, office equipment, computers, and
records is hereby transferred to the New Hanover County Regional
Medical Center effective January I, 1995.

WHEREAS, after due advertisement, the following responsive bid
was received and publicly opened by the Engineering Department at
2 P.M. on the 13th day of Sept., 1994 at the County Administration
Annex, 414 Chestnut Street, Wilmington, North Carolina, for the
"HVAC CONTRACT, MULTI-PURPOSE BUILDING",

Pro-Maintenance

AND WHEREAS, according to G.S. 143-132, if fewer than three
bids are received after the first advertisement for a formal
construction bid, a second advertisement of the proposal should be
made and after this second advertisement, the award may be made if
only one bid has been received;
AND WHEREAS, after the first and second advertisements,
insufficient bids were received, and the project was advertised a
third time and two bids were received and only one of these was
responsive;
AND WHEREAS, the Chief Project Engineer, the Director of
Environmental Management and the County Manager recommend that a
contract be awarded to Pro-Maintenance, in the amount of twenty two
thousand, three hundred and eight dollars
($22,308) ,
AND WHEREAS, funds have been previously appropriated and are
now in Account No. 720-480-8000-6000 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the HVAC CONTRACT, MULTI-
PURPOSE BUILDING, Bid # 95-0080 be awarded to Pro-Maintenance in
the amount of $22,308 ; and that the County is hereby authorized
and directed to execute the contract, contract form to be approved
by the County Attorney.

project budget,
AND WHEREAS, according to North Carolina General Statutes, if
bids exceed funds available ,the governing board may" enter into
negotiations with the lowest responsible bidder.. .",
AND WHEREAS, following design modifications, a revised
contract price has been negotiated with Harris Electric Company of
Wilmington, Inc.,
AND WHEREAS, the Chief proj ect Engineer, the Director of
Environmental Management and the County Manager recommend that a
contract be awarded to Harris Electric Company of Wilmington, Inc.,
for an amount not to exceed twenty two thousand, eight hundred and
seventy five dollars ($22,875),
AND WHEREAS, funds have been previously appropriated and are
now in Account No. 720-480-8000-6000 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for
ELECTRICAL CONSTRUCTION be awarded to Harris Electric Company of
Wilmington, Inc. for an amount not to exceed $22,875; and that the
County is hereby authorized and directed to execute the contract,

W1IEREAS, New Hanover County is home to many talented artists, musicians and
performers and a has a citizenry of diverse interest in supporting the arts; and
WIIEREAS, the Cape Fear area is a thriving center for the arts and seeks to provide
cultural activity for visitors and all New Hanover County residents; and
WIIEREAS, the community at large is greatly enriched by the educational benefit, as well
as the inspirational and esthetic influence of the arts for the children, youth, families and all
'who choose to live here; and
WHl!.llEAS, a group of art enthusiasts has brought together many of the groups that stage
events toformulate a promotion of events known as "Celebrate Wilmington"; and
WIJEREAS, the purpose o.f"Celebrate Wilmington" is to highlight the range and quality
of events; and
WIIEREAS, this joint effort will benefit everyone;

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
SUPPORI1NG FLOW CONTROL AS A
MUNICIPAL SOLID WASTE MANAGEMENT TOOL
WHEREAS, New Hanover County has invested significant resources in developing an
integrated solid waste management system to protect the environment and the public health, and
WHEREAS, the control of solid waste flow allows state and local governments to ensure that
solid waste is disposed in an environmentally sound manner that reduces future liability, and
WHEREAS, the State of North Carolina encourages "Counties and municipalities... to operate
their solid waste management systems through the use of an enterprise fund (NCGS i30A-
08(b))", and
WHEREAS, the Control of solid waste flow establishes a stable revenue base necessary to pay
the debt service on capital-intensive solid waste management facilities, and
WHEREAS, the control of solid waste flow enables local governments to achieve State-
mandated waste reduction goals,
NOW, THEREFORE, BE iT RESOLVED BY THE NEW HANOVER COUNTY BOARD OF
COMMISSIONERS THAT:
New JIanover County strongly urges the Senate to support Senator Frank Lautenburg (D-NJ)
and his bill ~~2227, which authorizes local governments to control the flow of solid waste and,
be it
FURTHER RESOLVED, that New Hanover County strongly urges the Senate to attach S.2227
to the interstate waste bill in order to bring it to action on the Senate floor and, be it
FURTHER RESOLVED, that New Hanover County strongly urges Senators George Mitchell
(D-ME) and Robert Dole (R-KS) to set aside time on the Senate floor calendar for action on this
bill
