MINUTES OF NEW HANOVER COUNTY WATER AND SEWER DISTRICT
MEETING, OCTOBER 20, 1986
ASSEMBLY
The New Hanover County Water and Sewer District met i
Regular Session on Monday, October 20, 1986, at 11:4
o'clock A.M. in the Assembly Room of the New Hanover Count
Administration Building, 320 Chestnut Street, Wilmington
North Carolina.

Dolan; Nolan O'Neal; Fred Retchin; Vice-Chairman Jonatha
Barfield, Sr.; County Manager, G. Felix Cooper; Count
Attorney, Robert W. Pope; and Clerk to the District, Luci
F. Harrell.
VICE-CHAIRMAN JONATHAN BARFIELD, SR. TO SERVE AS CHAIRMAN 0

As a resul t of the recent vacancy crea ted b
resignation of Commissioner Claud O'Shields, Jr., effectiv
October 6, 1986, Commissioner Retchin MOVED, SECONDED by
Commissioner Dolan to authorize Vice-Chairman Barfield t
serve as Chairman of the Water and Sewer District unti
convening of a new board on December 1, 1986. Upon vote
the MOTION CARRIED UNANIMOUSLY.

September 22, 1986, as presented.

Chairman Barfield asked if anyone from the genera
public wished to comment on an item not listed on th
Regular Agenda or any item listed on the Consent Agenda
The following person commented:
Mr. William Funderburg asked for clarification 0
Section 17.42 of the Water and Sewer District Ordinance
requiring written approval from the New Hanover Count
Heal th Department to the developer or owner befor
commencement of construction of a private wastewate
disposal system. He asked if NorthChase had applied to th
Health Department stating the only permit that had bee
issued by the Health Department was a temporary septic tan
permit.
County Attorney Pope stated the State issued the onl
permit required.

regulations, it was the consensus of the District Boar t
request the County Attorney to research the sectio
referenced by Mr. Funderburg and report back to the Distric
at a later date.
After further discussion, it was the consensus of t
District Board to request the County Manager to contact B
Jamison with the North Carolina Department of Natur
Resources and Community Development to appear at the ne
meeting to discuss and explain State permits and monitori
of wastewater discharge.

APPROVAL OF LETTER TO DESIGNATED RESIDENTS FOR
CONNECTIONS TO SEAGATE SEWER SYSTEM
After discussion of a grant enabling eligib
residents of the Seagate Community to connect to the syst
at no charge, Commissioner Retchin MOVED, SECONDED
Commissioner O'Neal to approve the draft letter presented
the Engineering Staff to be forwarded to designat
residents of this area. Upon vote, the MOTION CARRI
UNANIMOUSLY.

ADOPTION OF RESOLUTION FOR ACCEPTANCE OF CERTAIN STRE
RIGHTS-OF-WAY IN PHASE I, AREA II TO ALLOW CONSTRUCTION
MAINTENANCE OF SEWER SYSTEM
Commissioner Retchin MOVED, SECONDED by Commission
Dolan to adopt a resolution for acceptance of certain stre
rights-of-way in Phase I, Area II to allow construction a
maintenance of the Sewer System. Upon vote, the MOTI
CARRIED UNANIMOUSLY.
ADOPTION OF RESOLUTION FOR SEWER SYSTEM CONVEYANCE
ACCEPTANCE - LANDFALL PHASE I
Commissioner Retchin MOVED, SECONDED by Commission
O'Neal to adopt the resolution authorizing the Chairman
execute documents to convey the equipment and easement
the District for Landfall Phase I as presented.
Upon request, Chairman Barfield opened the floor f r

ADOPTION OF RESOLUTION ACCEPTING CONVEYANCE OF EQUIPMENT F
PUMP STATION AND FORCE MAIN - ROGER K. WOLFF
Commissioner Retchin MOVED, SECONDED by Commission
O'Neal to adopt a resolution accepting conveyance
equipment for pump station and force main by Roger K. wol
according to the contract between KLR Development and t
Water and Sewer District authorizing the Chairman to execu
the document. Upon vote, the MOTION CARRIED UNANIMOUSLY.

ADOPTION OF RESOLUTIONS FOR CONDEMNATION, IF NECESSARY, F
WATER AND SEWER EASEMENTS
Commissioner Retchin MOVED, SECONDED by Commission
O'Neal to adopt resolutions authorizing condemnation,
necessary, for water and sewer easements across parcels he
