FEBRUARY 6. 1989 SEMBLY The Board of District Commissioners of the New unty Water and Sewer District held a Special Meeting on Monday, bruary 6, 1989, at 10:39 o'clock P.M. in the General Assembl om of the New Hanover County Courthouse, 24 North Third Street, 'lmington, North Carolina. Members present were: District Commissioners E. L. Mathews, .f Nolan O'Neal; Fred Retchin; Vice-Chairman, W. Alber rbett, Jr.; Chairman, Jonathan Barfield, Sr.; County Manager, Felix Cooper; County Attorney, Robert W. Pope; and Clerk t e Board, Lucie F. Harrell. Chairman Barfield called the meeting to order. PROVAL OF MINUTES District Commissioner Retchin requested rewording of th oposed option concerning construction in a minor subdivisio en dividing one lot from a tract of land, and requested th ragraph to be reworded as follows: Allow only one lot to be separated from a tract of land subject to the approval of the New Hanover County Board of Commissioners. In the event a new request was made to divide either the new tract or the remainder of the original tract, then the District would require the dry sewer to be constructed. District Commissioner Retchin MOVED, SECONDED by Distric mmissioner 0' Neal to approve the minutes as presented with rrection to the option as stated above. Upon vote, the MOTIO RRIED UNANIMOUSLY. N-AGENDA ITEMS Chairman Barfield asked if anyone from the general publi uld like to speak on a item not listed on the Regular Agenda one commented. CEPTANCE OF THE 201 FACILITIES PLAN UPDATE AS APPROVED BY C. DIVISION OF ENVIRONMENTAL MANAGEMENT District Commissioner Retchin MOVED, SECONDED by Distric mmissioner O'Neal to accept and approve the 201 Facilities PIa date as approved by the N. C. Division of Environmenta nagement. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the plan is on file in the Engineering Department 2 0 2 MINUTES OF SPECIAL MEETING, FEBRUARY 6, 1989 (CONTINUED) APPROVAL OF CONTRACT BETWEEN THE NEW HANOVER COUNTY WATER AND SEWER DISTRICT AND TALBERT COX & ASSOCIATES FOR CONSTRUCTION OF '1_ PHASR T T OF TAR SF.WF.R TN'1'F.RrRPTOR SVSTP-M (A ("ObTTINUED ITEM FROM r ARY 17, 1989) r Assistant Finance Director, Alan Mozingo, stated afte dscussion with Talbert, Cox & Associates, Inc. and the Stat D partment of Human Resources, the overhead rate of 156.66 s bmi tted by TCA is wi thin an acceptable range. However, the p of it percentage or fixed fee is high and after negotiations th Talbert, Cox & Associates, Inc. they have agreed to reduce t is figure from 21% to 15% for a total savings of $23,725. After further discussion, District Commissioner Retchi M VED, SECONDED by District Commissioner Mathews to approve the r vised contract and authorize the Chairman to execute the d cument subject to approval by EPA and the County Attorney. PTION OF RESOLUTION TO SEEK PROPOSALS FOR CONSTRUCTION 0 P SE II SEWER INTERCEPTOR SYSTEM District Commissioner Retchin MOVED, SECONDED by District C mmissioner O'Neal to adopt a resolution to seek proposals for c nstruction of the Phase II Sewer Interceptor System. Upon v te, the MOTION CARRIED UNANIMOUSLY. A copy of the resolution is contained in Exhibit Book I, P ge 46. l DSCUSSION OF TIME INVOLVED WITH INSTALLATION OF SEWER LINE I L NG LEAF ACRES AND WINDEMERE SUBDIVISIONS Chairman Barfield stated several individuals from Long Leaf A res and Windemere have questioned the presence of sewer c ntractors in this area since July 1988. County Engineer, Wyatt Blanchard, stated the contractor has b en in this area for a lengthy period of time due to soils e countered and poor management techniques by supervisors of the p oject. He stated the contractor is absorbing the costs i volved and should be out of the area shortly. JOURNMENT District Commissioner Retchin MOVED, SECONDED by District C mmissioner O'Neal to adjourn.
