1993-05-17 RM Exhibits 5 (11) NORTH CAROLINA STATE DEPARTMENT OF TRANSPORTATION REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM North Carolina County of New Hanover Road(s) Description: PROSPECT A VENUE WHEREAS, the attached petition has been filed with the Board of county Commissioners of the county of New Hanover requesting that the above described road(s), the location of which has been indicated in red on the attached map, be added to the Secondary Road System; and WHEREAS, the Board of County Commissioners is of the opinion that the above described road(s) should be added to the Secondary Road System, if the road(s) meets minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System. NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New Hanover that the Division of Highways is hereby requested to review the above described road(s), and to take over the road(s) for maintenance if they meet established standards and criteria. MAR 81 s{;;) STATE OF NORTH CAROLINA BEFORE THE BOARD OF COUNTY COMMISSIONERS COUNTY OF NEW HANOVER In the Matter of Closing A Portion of OLD AVENUE in Hermitage Estates (Castle Hayne) ORDER It appearing to the Board of County Commissioners of New Hanover County that a Resolution of Intent to close a portion of OLD AVENUE was adopted by the County Commissioners on the 5th day of April, 1993, and it further appearing that said resolution called for a hearing to be held on the 3rd day of May, 1993, at which time the County Commissioners would hear complaints and comments of interested persons, and it further appearing that notice of said hearing was published in the Wilmington Star News Newspaper in accordance with the Road Closing Ordinance of New Hanover County, and after conducting such hearing the County Commissioners are of the opinion that a portion of OLD AVENUE in the County of New Hanover should be closed and are satisfied that the closing of same is not contrary to the public interest, and that no individual owning property in the vicinity of the roads will be deprived of reasonable means of ingress and egress to his property by such closing, the legal description of said road being as follows: Beginning at a point in the northwestern right-of-way line of OLD AVENUE (40 foot right-of-way) said point being approximately 1,300 feet south of the Parmele Road (SR 1335) - Old Avenue intersection; commencing from the northwestern right-of-way of Old Avenue 1,450 feet south along the western right-of-way of Old Avenue; thence 40 feet east of the southern terminus of Old Avenue; thence 1,450 feet north along the eastern right-of-way of Old Avenue; thence 40 feet west to the point of beginning as shown on the plat of Hermitage Estates for H. Bluethenthal (Redivision), recorded in Map Book 4, Page 22 of the New Hanover County Registry. Greer, Chairman Attest: S(J) WHEREAS, the New Hanover County Board of Commissioners is commi tted to promoting viable communi ties "by providing decent housing and a suitable living environment and expanding economic opportunities, principally for persons of low and moderate income" and; WHEREAS, approximately ten (10) percent of the County's existing housing stock is substandard and; WHEREAS, approximately twenty-five (25) households have been identified in the Kirkland Community which are in need of housing rehabilitation assistance and sewer improvements and; WHEREAS, the County is committed to provide local funds when necessary and will continue to apply for Community Development Block Grant funds to help meet the needs of low and moderate income persons; NOW THEREFORE BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby authorizes the submission to the North Carolina Department of Commerce, Division of Community Assistance, a Community Revitalization Grant for the purpose of housing rehabilitation in an amount not to exceed $600,000. New Hanover County (County) engaged the 1S 1n construction of the Animal Control Shelter, which capital project involves the construction and/or acquisition of capital assets. 2. County desires to authorize and budget for said capital project is a project ordinance adopted pursuant to North Carolina General Statute $159-13.2, such ordinance to authorize all appropriations necessary for the completion of said project. NOW, THEREFORE, WITNESSETH THAT: 1. This project ordinance adopted pursuant to North 1S Carolina General Statute $159-13.2. 2. The capital project undertaken pursuant to this ordinance is the construction of the Animal Control Shelter which project is herewith authorized. 3.
