1993-07-06 RM Exhibits INTRODUCED BY: Allen O'Neal, County Manager DATE: July 6, 1993 RESOLUTION AUTHORIZING THE SALE OF REAL PROPERTY LOCATED AT 1314 ORANGE STREET LEGISLATIVE INTENT/PURPOSE: This resolution relates to the sale of surplus property jointly owned by the City of Wilmington and New Hanover County, more particularly identified as follows: Parcel No. 054-06-013-015.000 Address 1314 Orange Street Amount of Offer $1,350.00 Tax Value $2,092.00 Offeror: James and Berneice Williamson 1401 Orange Street, Wilmington, N. C. 28401 The offer(s) has been advertised for upset bid in accordance with N.C.G.S. 160A-269 and there have been no qualifying upset bids for the identified parcel(s). The parcel(s) have been declared surplus by the County Commission and not needed for public purposes. RESOLVED: 1. That pursuant to N.C.G.S. 160A-269, the County Commission does hereby accept the offer(s) to purchase identified herein from the offeror(s) as indicated. 2. That New Hanover County reserves the right to reject any and all offers. 3. That New Hanover County will retain any deposit posted by the offeror(s) when: a. The offer is withdrawn after posting the deposit. b. The offeror(s) fail to pay the balance of an approved offer, due in cash, within ten (10) days of receipt of a notice by certified mail of availability of the deed of conveyance. 4. That any amount shown due on any attached list for liens be waived in total. 5. That the Chairman of the County Commission be and is hereby authorized to execute a deed without warranties to the offeror(s) as designated herein. Adopted at a ~;ular meet ing on -u=t" ~ of Chairman RESOLUTION OF HANOVER COUNTY OF COMMISSIONERS NEW BOARD WHEREAS, G.S. reappraisal of all real January 1, 1975 and every shall be advanced; and 105-286 (a) (1)' provides for the property in New Hanover County as of eighth year thereafter, unless the date WHEREAS, G.S. 105-286(a)(2) provides that any county desiring to conduct a reappraisal of real property earlier than required by this subsection (a) may do so upon adoption by the Board of County Commissioners of a resolution so providing; and WHEREAS, the Board of County Commissioners are of the opinion that an earlier reappraisal than the reappraisal scheduled for 1999 will be more equitable as such a reappraisal will more nearly equalize values of all real property owners in New Hanover County, NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners does hereby advance its scheduled octennial reappraisal of all real property in New Hanover County as of January 1, 1997, and directs the Clerk to promptly forward a copy of this Resolution to the Department of Revenue. Robe ~an Board of County Commissioners ATTEST: c;Jit )(;,/ ~Pl C k - ~w :J{anover County r:Board of Commissioners 1\?so[ution WHEREAS, New Hanover County and the City of Wilmington ha~e entered into a joint interlocal agreement to develop a Management and Planning System (MAPS) to automate our land records system in accordance with N.C.G.S. 102-15-17 and; WHEREAS, MAPS is being jointly financed with New Hanover County being responsible for the maintenance and update of the land records component of our geographic information system and; WHEREAS, New Hanover County has the necessary funds in its 1993-94 budget to match the grant amount awarded; NOW, THEREFORE, BE IT RESOLVED, that the Board of County Co~~issioners hereby gives its unanimous approval of New Hanover County's 1993-1994 Land Records Management Grant Application for matching funds to assist in the automation and updating of our land records system. " , .", t.- >: / RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, after due advertisement, bids were received and publicly opened by the Environmental Management Department at 11:00 a.m. on the 6th day of July, 1993, at the conference room at the New Hanover County Waste-To-Energy Administration Building, 3002 Highway 421 North, Wilmington, North Carolina, and the following bids were received for Preparation of Landfill Cell #4A and Closure of Cell #3A for the Environmental Management Department, Bid # 93-0363: Cell #4A Cell #3A Total Geo-Con, Inc. $617,689.00 ES & J Enterprises, Inc. $726,117.00 $846,325.00 $942,895.00 $228,636.00 $216,778.00 AND WHEREAS, according to G.S. 143-132, if fewer than three bids are received after the first advertisement for a formal construction bid, a second advertisement of the proposal should be made and after this second advertisement, the award may be made even if only one bid has been received; AND WHEREAS, after the first advertisement, only two bids were received and the project was advertised as required by General Statutes a second time after which only two bids were received; AND WHEREAS, the Environmental Management Director, the Finance Director and the County Manager recommend that the contract be awarded to Geo-Con, Inc. of Monroeville , Pennsylvania, the lowest responsible bidder, in the amount of Eight Hundred Forty-six Thousand Three Hundred Twenty-five Dollars ($846,325.00); AND WHEREAS, funds have been previously appropriated and are now in or will be in subsequent years budget Account No. 700-480-4191-5940 to cover this contract; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the contract for Preparation of Landfill Cell No. 4A and Closure of Cell 3A for the Environmental Management Department, be awarded to Geo-Con, Inc. in the amount of Eight Hundred Forty-six Thousand Three Hundred ... " Twenty-five Dollars ($846,325.00); and that the County is hereby authorized and directed to execute contract # 93-0363, contract form to be approved by the County Attorney. BE IT FURTHER RESOLVED that the Purchasing Agent is hereby authorized to return the bid deposit to the unsuccessful bidder. This 6th day of July, 1993. (SEAL) ~J:J/:j~ Chairman, Board of County Commissioners RESOLUTION OF INTENT TO CLOSE A PUBLIC ROAD EASTWIND SUBDIVISION Unnamed Road WHEREAS, a petition has been filed pursuant to N.C.G.S. 153A-241, requesting the Board of Commissioners of New Hanover County to close the following described portion of a publi9 road; Beginning at a point in the southwestern right-of-way of the unnamed road which is the northwestern corner of lot 86, Section 3 of Eastwind Subdivision recorded in Map Book 19, Page 73 of the New Hanover County Registry, commencing from said point 190.46 feet east to the southeast corner of said right-of-way which is the northeast corner of lot 86, Section 3 Eastwind Subdivision extending from said point 60 feet north to the northeastern right-of-way of the unnamed road which is the southeastern corner of lot 85, Ea.t"ind Subdivision extending from said point 190.46 feet west to the northwestern right-of-way line of said unnamed road which is the southwestern corner of lot 85, Eastwind Subdivision, extending 60 feet south to the point of beginning. NOW, THEREFORE, BE IT RESOLVED, that this Board is considering closing said road to public use, and that a public hearing on this question will be held on the 2nd day of August, 1993, at 7:30 p.m. in the Assembly Room o.f the Old County Courthouse, 24 North Third Street, Wilmington, N.C. at which time the Board will hear all interested citizens and make a final determination as to whether the unopened road shall be closed. The foregoing resolution was adopted by the New Hanover County Board of Commissioners on the 6th day of July, 1993.
