WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above described
road(s), the location of which has been indicated in red on the attached map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described road(s), and to take over the road(s) for maintenance if they
meet established standards and criteria.

AN ORDINANCE OF THE
BOARD OF COMMISSIONERS

NEW HANOVER COUNTY
The Board of Commissioners of New Hanover County, North
Carolina does hereby ordain and enact the following to be codified
int he New Hanover County Code, Chapter 15, Water Supply System,
Article II, Section 15-95 obtaining building perrni t prior to
certification:
Repeal existing Section 15-95 and, substitute the following
therefore:
Section 15-95 Obtaining building permit prior to certification
In the event a developer/builder desires to obtain a building
permit prior to certification of the sewer system by the engineer,
he must furnish a one thousand dollar ($1,000.00) surety bond, case
deposit or letter of credit for each unit. Upon furnishing bond',
application for sewer service may be obtained not more than one
hundred twenty (120) days prior to certification of sewer system.
If multiple units are being constructed, however, the total
bond may be reduced by either of the following means:
(a) If a developer/builder wishes to obtain building permits
for more than five (5) units prior to certification of the sewer,
the deve loper /bui lder need submit no more than a $ 5, 000 surety
bond, cash deposit, or letter of credit.
(b) If the developer has already posted a bond for
construction of the sewer system with a new subdivision, and if
that bond also includes language satisfactory to the County to
cover the sewer certification bonding requirement for all builders

seeking building permits within that subdivision as allowed by this
section, then separate sewer certification bonds shall not be
required by the County for that subdivision.
EXCEPT as hereinabove amended, all provisions of Chapter 15

The Board of Commissioners of New Hanover County, does hereby
ordain and enact the following amendments to the New Hanover County
Code, Chapter 15, Water Supply System, Article II, Waste Water
Collection and Treatment, Division 9, Fee Schedule:
Add a subsection (c) to Section 15-121(a)(2):
(c) The parcel owner must pay the tap fee within six (6)
months notice of installation.
Amend existing Section 15-124 (a)(l) Specific Fees, as
follows:
Section 15-124(a) Specific Fees
(a) Sewer Service Connection Fees (Tap Fees):
(1) Structures not classified as new development shall pay
the tap fees below if the tap fee is paid within six months of
availability of the sewer system. If the tap fee is paid after six
months of availability of the sewer system, then the amount of the
tap fee must meet the schedule of tap fees for new development in
Sec. 15 -12 4 (a) (2).
Residential:
4" - $200.00
Optional - $250.00 with $25.00 at time of application
and $5.00 per month for 45 months.
Nonresidential:
4" - $200.00
6" - $500.00
8" and larger - Installation cost shall be estimated by the
district and paid at time of application. Taps for 8" and
larger only include the actual connection to the collection
system.
EXCEPT as hereinabove amended, all provisions of Chapter 15
shall remain in full force and effect.

NEW HANOVER COUNTY
The Board of Commissioners of New Hanover County does hereby
ordain that Division 9 Fee Schedule, Section 15-121(b) Treatment
Plant Capacity Fee (Impact Fee) is hereby amended by the addition
of a new subsection thereto:
Add Section 15-121(b)(3):
( 3) Non-residential unit (industrial wastewater). Industries
that generate industrial wastewater, have a National Pollutant
Discharge Elimination System (NPDES) permit, maintain a wastewater
treatment facility with capacity sufficient to cover the average
daily wastewater flow may be exempted from the Treatment Plant
Capacity Fee by the Board of County Commissioners based on these
and other criteria. This section does not exempt any non-process
domestic wastewater. When the District's wastewater system becomes
available to a non-residential unit having industrial wastewater,
the Treatment Plant capacity fee shall be paid prior to connection.
(Amendment retroactive to June 1, 1993)
EXCEPT as hereinabove amended, all provisions of Chapter 15
shall remain in full force and effect.

COMMUNICATIONS TOWER
BE IT ORDAINED, by the Board of Commissioners of New Hanover
County:
1.
New Hanover County (County) is
engaged in the
construction of the Communications Tower, which capital project
involves the construction and/or acquisition of capital assets.
2. County desires to authorize and budget for said capital
project is a project ordinance adopted pursuant to North Carolina
General Statute $159-13.2, such ordinance to authorize all
appropriations necessary for the completion of said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute $159-13.2.
2 .
The capital
project undertaken pursuant to this
ordinance is the construction of the Communications Tower which
project is herewith authorized.
3. The revenue that will finance said project is:

RESOLUTION OF
BOARD OF COUNTY COMMISSIONERS
WHEREAS, EPA has designated New Hanover County as a
Principle Responsible Party concerning the New Hanover County
Burn Pit Site;
WHEREAS, EPA has formally notified the County of the
opportunity for the County to implement the remedial design and
action required by EPA to clean up the Burn Pit site to an
acceptable level;
WHEREAS, the County has the financial resources and the
technical capabilities to help conduct and finance the required
remedial design and action;
WHEREAS, the County is willing to reimburse EPA for its
actual costs incurred in the oversight of the remedial design and
action;
WHEREAS, the County is committed in general to protection of
its environmental resources; and
WHEREAS, the County has already participated in financing
and conducting the removal of contaminated soils at the Burn Pit;
NOW THEREFORE BE IT RESOLVED, by the New Hanover County
Board of Commissioners to make a good faith offer to EPA to help
conduct and finance the required remedial design and action for
the clean-up of the Burn Pit.
