A RESOLUTION
OF THE
NEW HANOVER COUNTY WATER AND SEWER DISTRICT
WHEREAS, it is necessary for construction of sewer utilities to acquire permanent
and temporary sewer utility easements, on the property of James Ray Thompson, Deed
Book 1408, Page 118, New Hanover County Registry, more specifically described as a
fifteen foot (15') wide permanent easement adjoining and abutting the eastern property
line, together with a five foot (5') wide temporary construction easement, having a duration
of three hundred sixty-five (365) days from the date of acquisition, adjoining and abutting
the western line of the referenc~4:/ifteen foot (15') wide permanent easement, and a
seventy foot by one hundred foot (~ x 100') temporary bore easement, having a duration
of three hundred sixty-five days from the date of acquisition, as more fully shown on Exhibit
"A"; and
WHEREAS, it is necessary to utilize the District's power of eminent domain to
acquire the above-referenced easements in that negotiations to acquire said easements
have been unsuccessful in obtaining the property owner's consent.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the
New Hanover County Water and Sewer District hereby resolves that the necessary
easements on, over, and across the James Ray Thompson property, Tax Parcel No.
R04408-002-003-000, Deed Book 1408, Page 118, New Hanover County Registry be
acquired by condemnation. County staff is hereby authorized to take any and all actions,
including suit, necessary to obtain said real property interest.
