LEASE OF BID DEPOSIT FOR STATE UTILITIES CONTRACTORS, INC.
County Engineer, Wyatt Blanchard, commented on a lett
eceived from State utility Contractors on August 17, 1990, whi
informed the District that a clerical error of $212,000 was ma e
y omission of one item when preparing the bid documen
therefore, they would like to withdraw the bid and request t e
District to release the security bid deposit. According to t e
General Statutes, the contractor may withdraw the bid fr m
consideration after the bid opening without forfeiture of his b d
security deposit if the bid price was based upon a mistake whi h
constituted a substantial error, provided that the bid w s
submitted in good faith, and that the bidder submits credib e
evidence that the mistake was clerical in nature as opposed to a
judgement error and was due to an unintentional omission of a
quantity of work. The necessary documents have been submitted 0
the District's Consulting Engineer, Espey, Huston & Associate,
Inc., and it has been determined that the error was total y
unintentional.

County Engineer, Wyatt Blanchard, stated on August 15, 1990,

County Engineer Blanchard stated in order to allow the

q antities and should provide a lower overall cost for the
p oject.
