PROVAL OF REQUEST BY CAPE FEAR UTILITIES FOR A VARIANCE OF SEW QUIREMENT IN ROGERS SUBDIVISION (SECOND PROPOSAL) County Engineer, Wyatt Blanchard, presented backgroun formation on the sewer variance requirement for placement of bile home under the water tank located on Lots 39 and 40 i gers Subdivision. He stated the term, temporary, has bee fined as the continued use and operation of the sewer lin til whichever event occurs first: (1) the water system is sol any party; or ( 2) the mobile home is removed after bein aced upon the property and occupied by the watchman and hi mily or by December 1, 1992. County Engineer Blanchard recommended granting the sewe riance to Cape Fear Utilities if the mobile home is removed 0 e gravity sewer is extended by December 1, 1992; and if other land owner wants to extend the gravity sewer during th ove period of time, Cape Fear Utilities must participate in th st and connect the mobile home or remove it from the premises. 305 306 MINUTES OF REGULAR MEETING, JANUARY 7, 1991 (CONTINUED) Mr. Kenneth Shanklin, the attorney representing Cape Fear Utilities, stated since refiling the petition for the sewer variance on December 7, 1990, the RUIJeL:S [dlll.Lly drill Ca.pe Fear ,1, Utilities have agreed to construct an 8'"='"lncn sewer line fY<l5m Rogers Road northwardly to Westbrook, eastwardly to the watl r tank with two manholes on site. At this point, the mobile ho e can be installed on-site in order to house the watchman who will protect the water tank. Also, a water line will be installed f r the Rogers family running west from the water tank. After discussion of the proposed agreement presented Attorney Shanklin being satisfactory to all parties involved, action was required. EXECUTION OF DOT ENCROACHMENT AGREEMENTS County Engineer, Wyatt Blanchard, stated as new subdivisio are constructed, the developers are required to install se systems which must be transferred along with easements to District. The N. C. Department of Transportation now requir. execution of encroachment agreements between the District and T prior to the acceptance of streets for maintenance and ownershil. In the past, these agreements were not always necessary; howev DOT has informed the District that subdivision streets will be accepted without executed agreements. Motion: District Commissioner Retchin MOVED, SECONDED Vice-Chairman Greer to require execution of encroachm agreements as requested by the N. C. Department Transportation.
