New Hanover County’s Technical Review Committee (TRC) will meet Wednesday, July 21, 2021
at 2:00 p.m. at 230 Government Center Drive, Suite 110, to discuss the below items.

2:00 p.m. Item 2: Tesla Park Clubhouse and Pool – Major Site Plan
Request by Justin Bishop, Malpass Engineering and Surveying P.C. for a 5,400 square foot
recreation area facility. The subject property is located at 4504 and 4510 Tesla Park Drive. It
consists of 0.63 acres and is zoned R-15.
2:20 p.m. Item 3: NHC Landfill Leachate Treatment Plant (Membrane Bioreactor) – Major Site Plan
Request by William Mason, CDM Smith for a 0.85 acre expansion. The subject property is
located at 5210 US HWY 421 North. It consists of 701.54 acres and is zoned I-2.
2:40 p.m. Item 1: GoDog Pet Hospitality Services – Major Site Plan
Request by John Tunstall, Norris & Tunstall Consulting Engineers P.C. for a 14,000 square foot
dog daycare with kennels facility. The subject property is located at 8130 Market Street. It
consists of 3.23 acres and is zoned B-2.

Civil Plan:
1. Provide fence detail to clarify material and height. I note a reference to fence details on the
civil plan but do not see reference on the suggested landscape plan.
2. Provide parking details to support the clubhouse.
3. Consider adding bicycle parking. Not required.
Landscape Plan:
4. Provide the details of the existing bufferyard to ensure code compliance.
Tree Removal Plan:
5. Please clarify if there is any tree removal proposed. If so, a tree removal permit and
mitigation plan may be required.
Lighting Plan:
6. Clarify if any additional lighting is proposed.

I conducted a site visit this am along with a plan review. Comments include:
1. Install all applicable NFPA 704 signage for pool chemical rooms.
2. 2. A Section 510 study is required for Emergency responder Radio Coverage.
3. Please follow the guidelines as set forth in the 2018 NC Fire Code Appendix J for Building
Information Signage.

1. Although the project appears to disturb less than one acre, the proposed site is within an
existing grading permit and will therefore be required to obtain an erosion control permit.

2. The impervious summary table and demo/site plans indicates the removal of only 14,000
sf of impervious. The net increase in impervious area will need to meet the requirements
for pre and post development flowrate requirements for the 2, 10, and 25 year storm
event. A Stormwater System Authorization to Construct (ATC) will be required for this
project. Please submit for an ATC as the design is completed.

Future amenities, which could consist of public swimming pool/spas/pods, will be required to submit
detailed plans, applications and equipment specification sheets for plan review and approval
before construction. Approval of the pool will be necessary before approval of all related
structures, which may include buildings housing bathrooms, pool equipment room, pool chemical
storage, pool decking and enclosure (fence/gates).
Please plan accordingly when submitting for permits in order to reduce delays due to non-submittals
for the pool.

The following comments have been received for the July 21st, 2021 TRC meeting.
Please note: following the TRC meeting, a revised site plan addressing each of the below items must be

1. Please update the plan with the following general corrections:
a. Please label what datum the elevations are tied to. Elevations must be tied to North
American Vertical Datum of 1988 (NAVD 88) and horizontal coordinates must be tied to
the North Carolina Grid System.
b. Please specify the disturbed area.
2. Parking:
a. Please show a designated parking space for the proposed expansion.
b. Please be sure to verify parking dimensions per Section 5.1.4.B.
3. Tree Retention:
a. Are any trees being removed, please be aware that there are tree retention requirements
with the UDO that have updated the classifications of regulated trees. Please see Section
5.3.4 for more specifics. In addition, trees preserved on the site may be credited toward
mitigation.
b. Section 5.3.4.C of the UDO requires a minimum of 15 trees at least 2” DBH must be
retained or planted on the parcel where development occurs for each acre or
proportionate area disturbed.
i. Please note that required landscaping for the project can be credited to meet this
requirement.
c. If applicable, please be aware that a Tree Removal Permit is required prior to any land
disturbance activities. Please provide the specific species (Loblolly Pine, Long Leaf Pine,
etc.) of the trees to be removed or retained to determine required mitigation.

1. Please provide swale calculations in accordance with NHC Stormwater Design Manual, Section
60.1.1. It appears there is inadequate swale depth west of the existing control building.
2. The use of 2:1 side slopes are permitted when the slopes are armoring, see section 60.1.2 of the
design manual. It is recommended 3:1 slopes be used for the swale and a swale section detail be
added to the plans.
3. What are the elevations of the gravel yard and concrete slab?

The following comments have been received for the July 21st, 2021 TRC meeting.
Please note: following the TRC meeting, a revised site plan addressing each of the below items must be
resubmitted prior to receiving approval.

1. Please update the plan with the following general corrections:
a. Please show and label the sight triangles on the landscape and site plan.
b. Please label what datum the elevations are tied to. Elevations must be tied to North American
Vertical Datum of 1988 (NAVD 88) and horizontal coordinates must be tied to the North
Carolina Grid System.
c. Please correct the site data table to reflect the Kennel’s required setbacks.
d. Please label the specific types of all easements.
2. Please be aware that kennels have additional standards UDO Section 4.3.4.B.3:
a. All structures shall have side and rear setbacks of 50 feet.
b. No outside sign more than 2.25 square feet in area shall be permitted.
c. Will the kennel portion of the facility be enclosed? Please be aware that minimum lot size shall
comply with Table UDO Section 4.3.4.B.3.a. The minimum lot size requirements may be waived
if the shelter is constructed to entirely enclose all facilities to adequately protect all animals
from weather extremes and to protect adjacent residences from noise, odors, and other
objectionable characteristics, provided all building setback requirements are met.
3. Parking:
a. Please be aware that the drive isles are larger than the UDO requires. To save on impervious,
you may consider reducing the drive isle widths, but this is not a requirement.
b. Please add a parking/drive aisle cross section to the site plan.

4. Tree Retention:
a. Section 5.3.4.C of the UDO requires a minimum of 15 trees at least 2” DBH must be retained or
planted on the parcel where development occurs for each acre or proportionate area
disturbed.
i. Please note that required landscaping for the project can be credited to meet this
requirement.
b. Please be aware that there are new tree retention requirements with the UDO that have
updated the classifications of regulated trees. Please see Section 5.3.4 for more specifics. In
addition, trees preserved on the site may be credited toward mitigation.
c. Please be aware that a Tree Removal Permit is required prior to any land disturbance activities.
Please provide the specific species (Loblolly Pine, Long Leaf Pine, etc.) of the trees to be
removed or retained to determine required mitigation.
d. Significant trees removed must be mitigated by planting additional trees (at a rate of 2 times
the caliper inches removed), preserving existing trees, or making a payment into the County’s
Tree Improvement Fund. Is the method of mitigation known? Prior to issuance of a CO, a tree
mitigation plan must be approved.
5. Please be sure to provide a light plan to illustrate that all exterior lighting and indoor lighting visible
from outside shall be designed and located so that the maximum illumination measured in foot candles,
at ground level, and at lot lines do not surpass 2.0 foot-candles.
6. Please be aware that the SHOD has additional standards, UDO Section 3.5.3D.4, please specify the lot
coverage the total ground area covered by principal buildings and all accessory buildings shall not
exceed 50% of the site.
7. Please Provide the required screening for the dumpsters and a detail.
8. Please provide a landscape plan illustrating the required streetyard, foundation, screening, buffer, and
interior parking landscaping. Existing vegetation may be credited for required landscaping.
9. Please indicate the AM and PM peak hour trips within the Site Data Table.
10. Please be aware that no building permit will be issued until NCDOT has issued the Driveway Permit
approval UDO Section 5.2.3.

1. These preliminary comments and are based on the plans as submitted for the proposed site and are
subject to further review upon receipt of any additional information. Subsequently, additional
comments and/or requirements may be necessary for this site.
a. A NCDOT Driveway Permit is required. Submit a plan in accordance with pages 14 and 15 of
the Policy on Street and Driveway Access to North Carolina Highways to include access
locations within 500’ of the proposed access on both sides of the State road. Submit to the
local NCDOT District Engineer’s Office.
b. A right turn lane may be warranted due to the ADT of Market Street.
c. A NCDOT Encroachment Agreement is required for any utility connections or installation within
NCDOT right-of-way.
d. NCDOT Driveway Permits are now submitted through the NCDOT Driveway website.

1. The well serving this property must be abandoned per 15A NCAC 02C .0113 ABANDONMENT OF WELLS.
Please make a note on the site plan that the existing well will be permanently abandoned.
15A NCAC 02C .0304 PERMITTING:
a. (No person shall permanently abandon a private drinking water well without first obtaining a
well abandonment permit from the local health department.
i. Prior to any clearing, grading, or construction activity, any wells that are existing must
be protected around each well head/casing and capped. Prior to well abandonment,
Well Abandonment Permits are required by NHC Environmental Health. Well
Abandonments must be performed by someone certified to do this type of work.
Please apply through NHC COAST for all well abandonment permits. A site plan/survey
is required showing well locations as part of the application process and a permit must
be secured prior.
ii. All new construction and appurtenances must meet the required state rule setbacks
to existing wells per 15A NCAC 02C. The applicant shall identify on the survey all wells
that exist within 50 FT of the property lines. Pet waste within the proposed fenced
area may act as a potential source of contamination to adjacent wells.
b. sThe rules of 15A NCAC 02C .0100 apply to private drinking water wells, as well as the following:
i. (Potential sources of groundwater contamination shall not be located closer to the
well than the separation distances specified in 15A NCAC 02C .0107(a)(2) or
.0107(a)(3), as applicable;
ii. (In addition to the provisions in 15A NCAC 02C .0109, the builder, well contractor,
pump installer, or homeowner, as applicable, shall provide assistance when necessary
to gain access for inspection of the well, pumps, and pumping equipment; and
iii. (In addition to the requirements of 15A NCAC 02C .0113, any well that acts as a source
or channel of contamination shall be repaired or permanently abandoned within 30
days of receipt of notice from the local health department.
2. OSWP Septic Comments:
a. Property will be connecting to CPFUA sewer.
