Mathews, Jr., William Sisson, Jr. Absent: None * * * * * * * * Commissioner Mathews introduced the following resolution, the title of which was read: APPROV AL IN PRINCIPLE OF INDUSTRIAL PROJECT FOR EFSON, INC., AND THE FINANCING THEREOF WITH INDUSTRIAL REVENUE BONDS IN THE PRINCIPAL AMOUNT OF UP TO $3,500,000 WHEREAS: The New Hanover County Industrial Facilities and Pollution Control Financing Authority (the Authority) has agreed to assist in the financing under the North Carolina Industrial and Pollution Control Facilities Financing Act (the Act) of an industrial project by Efson, Inc., a North Carolina corporation (the Company), to acquire, construct and install a 63,400 square foot injection molding manufacturing facility in New Hanover County (the Project) and has indicated that agreement by the execution of a Memorandum of Inducement between the parties dated November 20, 1992, and; WHEREAS: Under G.S.-~. 159C-7 each project must be approved by the Secretary \ of the Department of Commerce and, under Chapter 588 of the 1987 North Carolina Session Laws, the Federal Tax Reform Allocation Committee must allocate a sufficient amount of North Carolina's "private activity bond limit," as defined in Section 141 of the Internal Revenue Code of 1986, as amended (the Code) to the financing; and WHEREAS: The Rules and Procedures of the North Carolina Department of Commerce require that the governing body of a county approve in principle any project to be financed under the Act; and WHEREAS: This Board of Commissioners has today held a public hearing with respect to the advisability of the Project and the issuance of bonds therefor; and WHEREAS: Section 147(t) of the Code requires that the Board of Commissioners approve the plan of financing for the bonds; and WHEREAS: New Hanover County (the "County") has experienced "especially severe unemployment" because of the loss of 436 job)n the County in 1993 due to plant closings; NOW, THEREFORE, the Board of Commissioners of New Hanover County, meeting in regular session at Wilmington, North Carolina, on September 20, 1993, do the following: BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR NEW HANOVER COUNTY: 1. They are not supported by the taxing 20 power of the county. They are not obligations of the county. 21 If there is a default the county is not involved in making good 22 any default. They are supported only by the agreement of the 23 industrial firm to the amounts due on the note and on the 24 bonds. 25 This morning we are here to consider a $3,500,000 ** ORIGINAL ** (4 1 revenue bond issue for a company called Efson, Inc., which is 2 headed by steve Agnoff, who is with us this morning, and the 3 attorney for the company is Franklin Block, and we would like 4 to ask him to speak briefly on the project. 5 BY MR. BLOCK: Thank you, Wallace. Thank you, Mr. 6 Chairman. My name, as you know, is Frank Block, and I 7 represent Efson in this matter. Efson is a local company that 8 is in the business of manufacturing injection molded plastic 9 parts. In fact, a little known fact is that Efson is the 10 largest supplier of these kinds of parts to the physical 11 fitness industry in the united states, located right here in 12 New Hanover County. The business has done well and has brought 13 many jobs, currently about seventy-three, to our county, and 14 they are in the process of finding the need to expand, and they 15 have applied for this industrial revenue bond, as Wallace 16 explained, to finance that expansion. '" <Xl '" '" M '" 6 o "? 17 What is hoped to be gained by this expansion is to 18 increase the manufacturing facility itself up to some 63,400 >- o ~ o <: ~ z W 0.. <Xl o Z o <Xl a: w en <: -' ::;: a: o u. 19 square feet, and in so doing to increase its employment up to 20 approximately one hundred and ten. The increased manufacturing 21 facility space will allow Efson to become a much more vertical 22 kind of operation and allowing them to do such things as to 23 manufacture their own molds, which they are currently required 24 to get from out of state. So it's going to be a real addition 25 to the local economy, a real addition to the employment base of ** ORIGINAL ** (5 1 New Hanover County. 2 There is one problem that we have encountered that is 3 one of the causes for our being here today. In order to be 4 eligible for the industrial revenue bond there is a requirement 5 that the wage level of the particular p+ant applying for the 6 bond must exceed ten percent over the average wage of the state 7 for the preceding year. In the case of Efson it is our 8 anticipation that in the year 1994 that we will do exactly 9 that. In the year 1996 we will do exactly that. But in the 10 year 1992, the preceding year that is actually being looked at 11 right now, there was a need to hire a great deal of part-time 12 employees in order to keep the manufacturing process moving and 13 the great expansion that the company is experiencing, and 14 because of that the average wage fell a little bit below what 15 it is that was needed. They actually met the required amount 16 by some ninety percent. They were at ninety percent of the m ~ m ~ M m 6 o ~ 17 figure, almost ninety percent, actually eight-nine percent, of 18 the figure that was needed for 1992. > o ~ o < ~ z w ~ m o z o m oc w w < ~ ~ oc o ~ 19 So what we're asking for here today is a waiver, and 20 it's my understanding from bond counsel that the local" Board of 21 County Commissioners has the authority to grant such a waiver 22 when the number of jobs in the community have been decreased or 23 there has been a loss in number of jobs in the county of at 24 least three hundred. I believe in the materials which have 25 been furnished to you that there is indication that the number ** ORIGINAL ** (6 1 of jobs lost in New Hanover County has almost doubled that. 2 So what we're asking for now is to give "us the opportunity to 3 help make up some of that difference and to allow Efson to be 4 granted a waiver of that requirement so that we can move ahead 5 with the project, and of course the County Commissioners, as I 6 understand it, does have such authority. 7 In your materials also you should have a copy of a 8 proposed resolution. It was passed around, I think, the last 9 part of last week, and at this particular point we would of 10 course make our request that this resolution be approved by the 11 Board of County Commissioners, and if you have any technical 12 questions with regard to the processes or what is anticipated 13 out at Efson, Steve Agnoff, who is the President of the 14 company, is here also. MURCHISON: The language of the revised 6 resolution which was submitted to you says in Paragraph 2 that 7 the Board of Commissioners hereby requests that the proposed 8 industrial project be ~proved notwithstanding the fact that the operator will not pay an average weekly manufacturing wage 9 which is at least ten percent above the average weekly 11 manufacturing wage paid in the State of North Carolina. So the 12 language of the resolution is not limited to any particular 13 year, and this Board does not actually make the waiver. You 14 can only request it of the Department of Commerce in Raleigh. 15 But without your request they will not grant the waiver. 16 That's my understanding of it. 17 18 of Commerce has approved this. This is a waiver of a historical condition. 18 What has occurred in 1992 has already occurred, and the project 19 cannot move forward based on that particular set of historical 20 circumstances. We're coming forth with a 23 good faith estimate of what we think is going to happen based 24 on what we knew actually happened in 1992 where we had 25 employees that were on a part-time basis. So 8 that's why I'm having a little conflict. I used to place 9 engineers, and if you find a good plastics engineer you're 10 going to have to pay top dollar. I know that. 11 BY MR. AGNOFF: Well the incentive is to be able to 2 employ more people in New Hanover County, pay them a fair wage 3 and give them good benefits, things that Efson is already doing 4 right now. As far as your question as far as higher paid 5 engineering people that is correct. In fact, this year we've 6 hired two engineering managers for Efson, which is something 7 we're only doing in anticipation of our expansion efforts. Obviously engineers are needed to design new products, and if you have no capacity you can't produce new products anyway. So it's in accordance with our expansion that we're looking to bring in more higher level skilled highly compensated individuals who will help us continue our growth. BY COMMISSIONER BARONE: That's great. Now if that could be reflected with the language that Mr. Block just mentioned I would be personally much more comfortable with that and I'll defer of course to the other members of the Board. BY COMMISSIONER MATHEWS: Mr. Chairman, I think Mr. Agnoff and Mr. Block have satisfied any concern we may have about the waiver and the resolution, and I move that we accept it as is. BY MR. But on the other 9 hand I have a real problem with recommending waiving something 10 that the State legislation has written in to begin with. 11 BY MR. (b) The_Commission has duly considered~ among other things, the financial responsibility and capability of the company to fulfill its obligations with respect to the Loan Agreement in the form filed with the Commission, the ability of the political subdivisions in or near which the Project is to be located to cope satisfactorily with the impact of the Project and to provide necessary public facilities and services. (c) The proposed date and manner of sale of the Bonds will not have an adverse effect upon any scheduled or anticipated sale of any political subdivision thereof or any agency of either of them. Section 3. The issuance of the Bonds is hereby approved. Section 4. The sale of the Bonds at private sale pursuant to an executed Indenture of Trust substantially i~ the form filed with the Commission at a price of $3,500,000 with the approval of the Issuer and the Company, is in the best interests of the Authority and will best effectuate the purposes of the Act. Section 2. The County Manager and the Finance Director of the County are each hereby authorized and directed to submit to the Commission the application of the County for approval by the Commission of the issuance of the Bonds. NEW HANOVER COUNTY ORDINANCE TO REQUIRE LICENSES FOR MUNICIPAL SOLID WASTE COLLECTORS WHEREAS, North Carolina General Statute 130A-29~ provides for the designation of a geographical area within which the collection, transportation, storage and disposal of all solid waste generated within said area shall be accomplished in accordance with a solid waste management plan; and WHEREAS, the New Hanover County Board of Commissioners on August 16, 1993, adopted a Solid Waste Management Plan, which was accepted by ~~~ Department of Environment, Health and Natural Resources on~pt .~O , 19~; and WHEREAS, North Carolina General Statute 153A-136 grants to counties the authority to require each person wishing to commercially collect or dispose of solid wastes within the unincorporated areas of the County to obtain a license from the County and the authority to prohibit any person from commercially collecting or disposing of solid wastes without a license; and WHEREAS, H.B. 625, Chapter ~58, of the North Carolina Session Laws of 1981, "An Act to Allow New Hanover County Ordinances Regulating Waste Disposal to Apply Countywide," states that, "Any ordinance adopted under G.S. 153A-132.1 or G.S. 153A-136 may become effective countywide notwithstanding the provisions of G.S. 153A-122, and may apply to activities of cities and towns, and may provide that it supercedes a city or town ordinance on the same subject"; and WHEREAS, the purpose of this Ordinance is to carry out the Solid Waste Management Plan by requiring all commercial collectors of municipal solid waste to acquire a Municipal Solid Waste Collector License and to report on the quantity of different types of waste collected by the commercial collector, and dispose of municipal solid waste collected pursuant to the License as required by Flow Control Regulations. NOW, THEREFORE, BE IT ORDAINED BY NEW HANOVER COUNTY THAT: Section 1. Definitions. The following definitions shall apply in the interpretation and enforcement of this Ordinance and Licenses granted pursuant hereto. A. Commercial Hauler -- means anyone who collects or transports municipal solid waste for profit. B. "Construction and Demolition Waste" resulting solely from construction, remodeling, means solid waste repair, or . demolition operations on pavement, buildings, or other structures. C. County Manager -- means the New Hanover County Manager (or his designee). D. Designated Geographical Area -- all incorporated and unincorporated areas within New Hanover County. E. Disposal (defined in 15A NCAC 13B, Section .0100) -- means the discharge, deposit, injection, dumping, spilling, leaking, or placing of any solid waste into or on any land so that such solid waste or any constituent thereof may not enter the environment or be emitted into the air or discharged into any water, including groundwaters. F. Flow Control Regulations -- means the regulations adopted to enable New Hanover County to carry out the provisions of the New Hanover County Solid Waste Management Plan, as such regulations may be amended from time to time by the County Board of Commissioners, attached hereto as Attachment A and incorporated herein by reference. . G. Hazardous Waste (defined in NCAC 10F) -- means a solid waste, or combination of solid wastes, which because of its quantity, concentration, or physical, chemical or infectious characteristics may: (1) cause or significantly contribute to an increase In mortality or an increase in serious irreversible or incapacitating reversible illness; or (2) pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, or disposed of, or otherwise managed. H. Inert Debris (defined in DEHNR Policy Memorandum #16, page 2) -- means solid waste which consists solely of material that is virtually inert and that is likely to retain its physical and chemical structure under expected conditions of disposal. I. Land Clearing Debris (defined in DEHNR Policy Memorandum #16, page 1) -- means solid waste which is generated solely from land clearing activities. . J. Medical Waste (defined in the Solid Waste Management Act of 1989) -- means any solid waste which is generated in the diagnosis, treatment, or immunization of human beings or animals, in research pertaining thereto, or in the production or testing of biologicals, but does not include any hazardous waste identified or listed pursuant to Article 9 of Chapter 130A of the North Carolina General Statutes, radioactive waste, household waste as defined in ~O Code of Federal Regulations 261.~(b)(1) in . effect on 1 July 1989, or those substances excluded from the definition of "solid waste" in Article 9 of Chapter 130A of the North Carolina General Statutes. K. Municipal Solid Waste -- means any solid waste resulting from the operation of residential, commercial, industrial, governmental, or institutional establishments that would normally be collected, processed, and disposed of through a public or private solid waste management service. Municipal solid waste does not include hazardous waste, sludge, or solid waste from mining or agricultural operations. L. Municipal Solid Waste Collector -- means any person who collects or transports municipal solid waste as a commercial hauler. M. Person -- means an individual, corporation, company, association, partnership, unit of local government, State agency, federal agency, or other legal entity. N. Public Hauler -- means any non-profit collector or transporter of municipal solid waste. . O. Putrescible -- means solid waste capable of being decomposed by microorganisms with sufficient rapidity as to cause nuisance from odors and gases, such as kitchen wastes, offal, and carcasses. P. Radioactive Waste Material -- means any solid, liquid or gas which emits ionizing radiation spontaneously. Q. Recycling -- means any process by which solid waste, or materials which would otherwise become solid waste, are collected, separated, or processed, and reused or returned to use in the form of raw materials or products. R. Refuse (defined in 15A NCAC 13B, Section .0100) -- means all non-putrescible waste. S. Sludge (defined in 15A NCAC 13B, Section .0100) -- means any solid, semisolid, or liquid waste generated from a municipal, commercial, institutional, or industrial wastewater treatment plant, water supply treatment plant, or air pollution control facility; or any other such waste having similar characteristics and effect. . T. Solid Waste (defined in 15A NCAC 13B, Section .0100) -- means any hazardous or non-hazardous garbage, refuse or sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility, domestic sewage and sludges generated by the treatment thereof in sanitary sewage collection, treatment and disposal systems, and other material that is either discarded or is being accumulated, stored or treated prior to being discarded, or has served its original intended use and is . generally discarded, including solid, liquid, semisolid or contained gaseous material resulting from industrial, institutional, commercial and agricultural operations, and from community activities. Such term does not include: (1) Fecal waste from fowls and animals other than humans; (2) Solid or dissolved material in a. Domestic sewage and sludges generated by the treatment thereof in sanitary sewage collection, treatment and disposal systems which are designed to discharge effluents to the surface waters; b. Irrigation return flows; and '. c. Wastewater discharges and the sludges incidental to and generated by treatment which are point sources subject to permits granted under Section ~02 of the Water Pollution Control Act, as amended (PL 92-500), and permits granted under G.S. 1~3-215.1 by the Environmental Management Commission. However, any sludges that meet the criteria for hazardous waste under RCRA shall also be solid waste for these purposes; (3) Oils and other liquid hydrocarbons controlled under Article 21A of Chapter 1~3 of the General Statutes. However, any oils or other liquid hydrocarbons that meet the criteria for hazardous waste under RCRA shall also be a solid waste for these puposes; (~) Any source, special nuclear or byproduct material as defined by the Atomic Energy Act of 195~, as amended (~2 U.S.C 2011); (5) Mining refuse covered by the North Carolina Mining Act, G.S. 7~-~6 through G.S. 7~-68 and regulated by the North Carolina Mining Commission (as defined under G.S. 1~3B-290). However, any specific mining waste that meets the criteria for hazardous waste under RCRA shall also be a solid waste for these purposes. U. Solid Waste Generation -- means the act or process of producing solid waste. . V. Solid Waste Management Plan -- the New Hanover County Solid Waste Management Plan, as adopted by New Hanover County and participating municipalities and accepted by the North Carolina Department of Environment, Health, and Natural Resources. W. "Special Waste" (defined in 15A NCAC 13B, Section .0103) means any waste that requires special or exceptional handling from an operational or equipment standpoint and includes all . waste disposal which requires a letter of approval from the County or State of North Carolina Department of Environment, Health and Natural Resources, Divison of Solid Waste. For purposes of this definition, Special Waste shall include, without limitation, sludges, asbestos, powders, and ashes. X. Yard Waste -- means municipal solid waste consisting solely of vegetative matter resulting from landscaping maintenance. Section 2. Municipal Solid Waste Collectors -- License For Collection and Transportation. A. No commercial or public municipal solid waste collector shall collect, transport, or dispose of municipal solid waste within New Hanover County without obtaining and maintaining a License issued by the County: Provided, that this subsection 2.A. shall not apply to any person disposing of municipal solid waste from his own residence. . B. All commercial or public municipal solid waste collectors desiring Municipal Solid Waste Collector Licenses must purchase from the County Manager or his designee a license for the collection and transportation of solid waste. The fee for this license shall be $250 per year. Public haulers will be exempted from the license fee but must be licensed. The license year shall run from July 1 until June 30 of the subsequent calender year. The License shall require the licensee to follow the "Flow Control Regulations" attached hereto as Attachment A, as such Flow Control Regulations may be amended from time to time by the County Board of Commissioners. Should any of the data which must be submitted by a license pursuant to the Flow Control Regulations constitute a "trade secret" as defined in G.S. 66-152(3), or any other applicable North Carolina statute, the County shall protect such information as required by G.S. 132-1.2, provided that at the time of initial disclosure to the County the licensee designates such information as "confidential" or as a "trade secret". . C. Whenever the County finds that a licensee is operating in violation of the provisions of the License, the County shall give notice in writing to such licensee that unless such violation is corrected within ten (10) days the License of such licensee shall be suspended. If such violation is determined by the County to continue after such ten (10) day period or a second violation is determined by the County, the County shall give notice in writing to such licensee that his License has been suspended. No such license shall be reinstated unless the County is assured that the licensee shall not operate in violation of the License. If the County determines a third violation of such License has occurred following a previous notice and suspension, the license shall be revoked and the County shall give written notice of such revocation to the licensee. . D. On written petition from a licensee whose License has been suspended or revoked, the Board of County Commissioners (or its designee) shall hold a hearing at which time such licensee shall be given an opportunity to show that his License should not have been suspended or revoked. It shall be the duty of the County Manager or his designee to communicate the request to the Chairman of the Board of County Commissioners as soon as practicable. Such hearing shall be held by the Board of County Commissioners (or its designee) as soon as practicable but no later than 30 days following receipt of such petition by the Chairman. After such hearing, the Board of County Commissioners (or its designee) may either suspend, revoke or reinstate such License, depending upon its finding as to whether the provisions of the License have been complied with. If no such petition is filed on or before the tenth day following the day on which such License was suspended or revoked, the License shall be deemed automatically suspended or revoked. . E. When any person has made application for a License, and the County Manager or his designee has refused to issue a license to the applicant, the applicant may file a written petition for a hearing before the Board of County Commissioners (or its designee). A petition for hearing must be filed with the County Manager or his designee within ten (10) days after the refusal of the County Manager or his designee to issue the License. It shall be the duty of the County Manager or his designee to communicate the request to the Chairman of the Board of County Commissioners as soon as practical. The Board of County Commissioners (or its designee) shall act upon the petition as soon as practical but no later than thirty (30) days after its receipt by the Chairman; and at the said hearing, the Board (or its designee) shall issue or refuse to issue the License. Section 3. Administration. The administration and enforcement of this Ordinance shall be the duty of the County Manager or his designee. Section~. Enforcement. This Ordinance may be enforced ln any of the following manners as prescribed by law: . A. Violation a Misdemeanor -- Any person who violates any provision of this Ordinance, including but not limited to knowingly making a false certification of the Monthly Data Report shall, upon conviction, be guilty of a misdemeanor and shall be fined not exceeding Five Hundred Dollars ($500.00) or imprisoned not exceeding thirty (30) days. Each day that a violation continues to exist shall be considered to be a separate offense. B. Injunction and Order of Abatement -- The provisions of this Ordinance may be enforced by injunction and order of abatement. When a violation of this Ordinance occurs, New . Hanover County, through the County Attorney or other official designated by the Board of County Commissioners of New Hanover County, may apply to the appropriate division of the General Court of Justice for a mandatory and prohibitory injunction and order of abatement commanding the defendent to correct the unlawful activity. C. Civil Penalties -- A civil penalty of $100.00 per ton for disposal of solid waste in violation of this Ordinance shall be assessed by the County, which amount can be recovered by the County in a civil action in the nature of debt if the violator does not pay the penalty within thirty (30) days after receipt of the notice of violation specifying the amount of the civil penalty. A civil penalty of $100.00 a day for failure to submit the Monthly Data Report to the County Manager or his designee as required by the Flow Control Regulations shall be assessed by the County, which amount can be recovered by the County in a civil action in the nature of debt if the violator does not pay the penalty within thirty (30) days after the receipt of the notice of violation specifying the amount of the civil penalty. . D. Other Remedies -- The provisions of this Ordinance may also be enforced in any other manner set forth in G.S. 153A-123. Section 5. Conflict With Other Laws. It is not intended that this Ordinance repeal, abrogate, annul or in any way impair or interfere with any existing ordinances or regulations of the New Hanover County Board of Commissioners. Section 6. Severability. Should any section of this Ordinance be decided by the courts to be unconstitutional or invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. Section 7. Effective Date. This Ordinance shall be in full force and effect from and after its date of adoption. ATTACHMENT A FLOW CONTROL REGULATIONS The following Flow Control Regulations have been adopted to enable New Hanover County to carry out provisions of the New Hanover County Solid Waste Management Plan. Disposal Requirements Each municipal solid waste collector shall deliver or cause to be delivered all municipal solid waste collected by the hauler to County administered solid waste management facilities or a properly permitted Waste-to-Energy Facility which will accept municipal solid waste, or to other solid waste management facilities as designated by the County Director of Environmental Management. Notification . Each municipal solid waste collector will be notified in writing as to the designated facility or facilities to which they must deliver all municipal solid waste colJected by the hauler at least thirty (30) days prior to the effective date of the notice. In the event a designated facility is unable to accept waste on a regularly scheduled day, a contact person designated by the hauler will be contacted by telephone by a representative of the County Department of Environmental Management and directed to an alternate facility until such time as the designated facility is able to accept municipal solid waste. If the contact person cannot be reached by telephone the hauler will be redirected to the alternate facility upon arrival at the designated facility. Reporting Requirements Effective December, 1993, on a monthly basis, each licensed municipal solid waste collector must submit data on the quantity of different types of waste collected by the collector within the New Hanover County Designated Geographic Area, and the location or locations where this Municipal Solid Waste was disposed. The monthly data must be submitted to the County Director of Environmental Management on the attached form, postmarked no later than the 30th day following the completed reporting period. NEW HANOVER COUNTY ORDINANCE TO PROVIDE FOR FLOW CONTROL OF SOLID WASTE WHEREAS, North Carolina General Statute 130A-29~ provides for the designation of a geographic area within which the collection, transportation, storage and disposal of all solid waste generated within said area shall be accomplished in accordance with a solid waste management plan; and WHEREAS, the New Hanover County Board of Commissioners on August 16, 1993, adopted a Solid Waste Management Plan, which was accepted by the Department of Environment, Health, and Natural Resources on ; and WHEREAS, a Waste-to-Energy Facility lS considered to be a more environmentally sound mechanism for the management of solid waste in solid waste management hierarchies developed by the State of North Carolina and the federal Environmental Protection Agency; and . WHEREAS, the purpose of this ordinance is to carry out said Solid Waste Management Plan by requiring that all disposal of solid waste within the geographical area designated by the Department of Environment, Health, and Natural Resources be controlled by Flow Control Regulations and imposing reporting requirements on municipal solid waste collectors. NOW, THEREFORE, BE IT ORDAINED BY NEW HANOVER COUNTY THAT: Section 1. Definitions The following definitions shall apply ln the interpretation of this Ordinance: A. Commercial Hauler -- means anyone who collects or transports municipal solid waste for profit. B. "Construction and Demolition Waste" means solid waste resulting solely from construction, remodeling, repair, or demolition operations on pavement, buildings or other structures. C. County Manager -- means the New Hanover County Manager (or his designee). . D. Designated Geographical Area -- all incorporated and unincorporated areas within New Hanover County. E. Disposal (defined in 15A NCAC 13B, Section .0100) -- means the discharge, deposit, injection, dumping, spilling, leaking, or placing of any solid waste into or on any land so that such solid waste or any constituent thereof may not enter . the environment or be emitted into the a1r or discharged into any water, including groundwaters. F. Flow Control Regulations -- means the regulations adopted to enable New Hanover County to carry out the provisions of the New Hanover County Solid Waste Management Plan, as such regulations may be amended from time to time by the County Board of Commissioners, attached hereto as Attachment A and incorporated herein by reference. G. Hazardous Waste (defined in NCAC 10F) -- means a solid waste, or combination of solid wastes, which because of its quantity, concentration, or physical, chemical or infectious characteristics may: (1) cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating reversible illness; or . (2) pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, or disposed of, or otherwise managed. H. Inert Debris (defined in DEHNR Policy Memorandum #16, page 2) -- means solid waste which consists solely of material that is virtually inert and that is likely to retain its physical and chemical structure under expected conditions of disposal. I. Land Clearing Debris (defined in DEHNR Policy Memorandum #16, page 1) -- means solid waste which is generated solely from land clearing activities. J. Medical Waste (defined in the Solid Waste Management Act of 1989) -- means any solid waste which is generated in the diagnosis, treatment, or immunization of human beings or animals, in research pertaining thereto, or in the production or testing of biologicals, but does not include any hazardous waste identified or listed pursuant to Article 9 of Chapter 130A of the North Carolina General Statutes, radioactive waste, household waste as defined in ~O Code of Federal Regulations 261.~(b)(1) in effect on 1 July 1989, or those substances excluded from the definition of "solid waste" in Article 9 of Chapter 130A of the North Carolina General Statutes. . K. Municipal Solid Waste -- means any solid waste resulting from the operation of residential, commercial, industrial, governmental, or institutional establishments that would normally be collected, processed, and disposed of through a public or private solid waste management service. Municipal solid waste does not include hazardous waste, sludge, or solid waste from mining or agricultural operations. . L. Municipal Solid Waste Collector -- means any person who collects or transports municipal solid waste. M. Person -- means an individual, corporation, company, association, partnership, unit of local government, State agency, federal agency, or other legal entity. N. Public Hauler -- means any non-profit collector or transporter of municipal solid waste. o. Putrescible -- means solid waste capable of being decomposed by microorganisms with sufficient rapidity as to cause nuisance from odors and gases, such as kitchen wastes, offal, and carcasses. P. Radioactive Waste Material -- means any solid, liquid or gas which emits ionizing radiation spontaneously. Q. Recycling -- means any process by which solid waste, or materials which would otherwise become solid waste, are collected, separated, or processed, and reused or returned to use in the form of raw materials or products. . R. Refuse (defined in 15A NCAC 13B, Section .0100) -- means all non-putrescible waste. S. Sludge (defined in 15A NCAC 13B, Section .0100) -- means any solid, semisolid, or liquid waste generated from a municipal, commercial, institutional, or industrial wastewater treatment plant, water supply treatment plant, or air pollution control facility or any other such waste having similar characteristics and effect. T. Solid Waste (defined in 15A NCAC 13B, Section .0100) -- means any hazardous or non-hazardous garbage, refuse or sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility, domestic sewage and sludges generated by the treatment thereof in sanitary sewage collection, treatment and disposal systems, and other material that is either discarded or is being accumulated, stored or treated prior to being discarded, or has served its original intended use and is generally discarded, including solid, liquid, semisolid or contained gaseous material resulting from industrial, institutional, commercial and agricultural operations, and from community activities. Such term does not include: (1) Fecal waste from fowls and animals other than humans; . (2) Solid or dissolved material in: a. Domestic sewage and sludges generated by the treatment thereof in sanitary sewage collection, treatment and disposal systems which are designed to discharge effluents to the surface waters; and . b. Irrigation return flows; and c. Wastewater discharges and the sludges incidental to and generated by treatment which are point sources subject to permits granted under Section 402 of the Water Pollution Control Act, as amended (PL 92-500), and permits granted under G.S. 143-215.1 by the Environmental Management Commission. However, any sludges that meet the criteria for hazardous waste under RCRA shall also be solid waste for these purposes; or (3) Oils and other liquid hydrocarbons controlled under Article 21A of Chapter 143 of the General Statutes. However, any oils or other liquid hydrocarbons that meet the criteria for hazardous waste under RCRA shall also be a solid waste for these purposes; or (4) Any radioactive material as defined by the North Carolina Radiation Protection Act, G.S. 104E-1 through 104E-23; or . (5) Mining refuse covered by the North Carolina Mining Act, G.S. 74-46 through G.S. 74-68 and regulated by the North Carolina Mining Commission (as defined under G.S. 143B-290). However, any specific mining waste that meets the criteria for hazardous waste under RCRA shall also be a solid waste for these purposes. U. Solid Waste Generation -- means the act or process of producing solid waste. V. Solid Waste Management Plan -- the New Hanover County Solid Waste Management Plan, as adopted by New Hanover County and participating municipalities and accepted by the North Carolina Department of Environment, Health, and Natural Resources. W. "Special Waste" (defined in 15A NCAC 13B, Section .0103) means any waste that requires special or exceptional handling from an operational or equipment standpoint and includes all waste disposal which requires a letter of approval from the State of North Carolina Department of Environment, Health and Natural Resources, Division of Solid Waste. For purposes of this definition, Special Waste shall include, without limitation, sludges, asbestos, powders, and ashes. . X. Yard Waste -- means municipal solid waste consisting solely of vegetative matter resulting from landscaping maintenance Section 2. Collection of Municipal Solid Waste. The collection of all municipal solid waste generated within the Designated Geographic Area shall be subject to the control of . the County as provided in the Flow Control Regulations attached hereto as Attachment A, and as amended from time to time by the County Board of Commissioners. Section 3. Disposal of Solid Waste. All municipal solid waste generated within the Designated Geographic Area shall be subject to the control of the County and shall be disposed of as provided in the Flow Control Regulations attached hereto as Attachment A, as amended from time to time by the County Board of Commissioners. Section 4. Reporting Requirements. . Municipal solid waste collectors must submit data on the quantity of different types of waste collected by the collector within the Designated Geographic Area as provided in the Flow Control Regulations attached hereto as Attachment A, as amended from time to time by the County Board of Commissioners. Should any of the data which must be submitted by a municipal solid waste collector constitute a "trade secret" as defined in G.S., 66-152(3), or any other applicable North Carolina statute, the County shall protect such information as required by G.S. 132-1.2, provided that at the time of initial disclosure to the County the municipal solid waste collector designates such information as "confidential" or as a "trade secret". Section 5. Administration. The administration and enforcement of this Ordinance shall be the duty of the County Manager or his designee. Section 6. Enforcement.
