WHEREAS, pursuant to North Carolina General Statutes (NCGS) 160A-280, the county may donate to
another governmental unit within the United States any personal property including supplies, materials,
and equipment that the governing board deems to be surplus, obsolete, or unused; and
WHEREAS, county staff has posted a public notice of such resolution at least five (5) days prior to its
adoption.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners declares the
equipment obsolete and approves the donation of the riot gear and dive equipment to the Pender County
Sheriff's Office and directs county staff to process any required documents to complete the transaction.

BRIEF SUMMARY:
The YWCA of the Lower Cape Fear serves the people located within the Cape Fear region. This land once thrived with
life from Indigenous Peoples, known today as the Cape Fear Indians and the Waccamaw Siouan Indian People. They
should be celebrated. A proclamation is submitted for consideration to recognize the second Monday in October as
Indigenous Peoples' Day in New Hanover County. The purpose of the proclamation is to recognize Indigenous Peoples
that once thrived on this land and to inspire others to also recognize native nations.

INDIGENOUS PEOPLES' DAY PROCLAMATION
WHEREAS, Indigenous Peoples' Day was first proposed in 1977 by a delegation of Native Nations
to the International Conference on Discrimination Against Indigenous Populations in the
Americas; and
WHEREAS, a growing number of American cities have recognized the second Monday of October
as "Indigenous Peoples' Day," reimaging Columbus Day as an opportunityto celebrate indigenous
resiliency; and
WHEREAS, New Hannover County recognizes the historical importance of the Indigenous
Peoples' lands that later became known as the Americas, including the lands which became
known as North Carolina; and
WHEREAS, the state of North Carolina recognizes the fact that New Hanover County is built upon
lands first inhabited by the Indigenous Peoples of this region; and
WHEREAS, New Hanover County values the many contributions made to this community through
Indigenous Peoples' knowledge, stewardship of these lands, labor, technology, science,
philosophy, arts and the deep cultural contribution that has substantially shaped the character
of New Hanover County.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that
the second Monday of October, October 11, 2021, will be recognized as "Indigenous Peoples'
Day" in New Hanover County. Public institutions, businesses, and organizations are strongly
encouraged to recognize and support Indigenous Peoples' Day; reaffirming the county's
commitment to demonstrating appreciation of North Carolina's first peoples.

BRIEF SUMMARY:
Easton Fitzpatrick is the Advocate/Outreach Coordinator for Domestic Violence Shelter & Services. Easton requests
that the board adopt a proclamation to recognize October 2021 as Domestic Violence Awareness Month in New
Hanover County.
New Hanover County partners with Domestic Violence Shelter & Services by providing $50,000 in outside agency
funding. The county also provides annual funding through the Department of Social Services. They were converted to
vendor status in FY19-20.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
DOMESTIC VIOLENCE AWARENESS MONTH PROCLAMATION
WHEREAS, domestic violence transcends all ethnic, racial, gender, and socioeconomic boundaries, weakening
the very core of our community; and
WHEREAS, the effects of domestic violence are far-reaching and may have lifetime implications for families,
the criminal justice system and our community; and
WHEREAS, Domestic Violence Shelter and Services, Inc. provides emergency crisis intervention and ongoing
support and services in New Hanover County for victims and survivors of domestic abuse; and
WHEREAS, 1,164 adults and 101 children received direct services such as court accompaniment, advocacy,
empowerment groups and counseling; including 129 adults and 89 children who received emergency shelter
through Domestic Violence Shelter and Services, Inc. in the year 2020; and
WHEREAS, on September 4, 2002, Gladys Bryant, an employee of New Hanover County for more than two
decades, and on August 6, 2008, Tarica Pulliam, an employee of New Hanover County for two years, lost their
lives in acts of domestic violence exhibiting to all their coworkers and friends, the prevalence of domestic
violence and its consequences; and
WHEREAS, many other persons throughout New Hanover County and the United States find themselves in
abusive relationships and need to find a safe and empowering environment; and
WHEREAS, this year's theme, We are Enough, serves as a call to action to citizens of New Hanover County to
encourage, support and empower one another to live lives free from violence.
NOW, THEREFORE, BE IT PROCLAIMED, that the New Hanover County Board of Commissioners refuses to
tolerate domestic violence in any form and wishes to create a society that promotes strong values, fosters a
safe and loving home environment for every family, and encourages our citizens to enhance their efforts to
work together to address the problem of domestic violence.
BE IT FURTHER PROCLAIMED by the New Hanover County Board of Commissioners that October 2021 be
recognized as "Domestic Violence Awareness Month" in New Hanover County.

substance use is elevated for individuals who have had a high number of traumatic or challenging experiences in
childhood. All New Hanover County residents are invited to reflect and raise awareness on the role substance use
disorder plays in community health.

WHEREAS, prevention and recovery from substance use disorder is possible through sound prevention,
education, intervention, and quality treatment; and
WHEREAS, the 2019 National Survey on Drug Use and Health reported approximately 20.4 million people
over the age of 12 had a substance use disorder in the past year; and
WHEREAS, an estimated 20.6 percent of the adult population in the U.S. had a mental illness in the past
year; and
WHEREAS, symptoms of mental illness can be masked or exacerbated by substance use, both sharing
common factors and risks, that should be assessed and treated together when possible; and
WHEREAS, risk for developing substance use is elevated for individuals who have had a high number of
traumatic or challenging experiences in childhood, therefore needing increased access to prevention,
education, intervention and treatment; and
WHEREAS, the development of substance use and mental disorders are serious public health concerns
that evidence -based prevention can prevent and reduce, and quality treatment can heal; and
WHEREAS, educating family, friends, and the community about how substance use disorder affects all
residents in New Hanover County, is essential to combat misconceptions and build effective grassroots
and professional services solutions.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that
October 2021 will be recognized as "National Substance Abuse Awareness Month" in New Hanover
County. Residents are invited to reflect and raise awareness on the role substance use disorder plays in
community health. New Hanover County commends and urge residents and community organizations
to join in this observance.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
NATIONAL BREAST CANCER AWARENESS MONTH PROCLAMATION
WHEREAS, it is estimated that more than 9,850 women in North Carolina will be diagnosed with breast
cancer in 2021; of these 9,850 women, 1,470 will die from the disease, and approximately 270 of the
diagnosed cases will be in New Hanover County; and
WHEREAS, 1 in 8 North Carolina women are at risk for developing breast cancer within their lifetime;
and
WHEREAS, breast cancer is the second most common form of cancer, and the second leading cause of
cancer death for women in the United States; and
WHEREAS, with routine mammogram screening and follow-up testing, the disease can be detected early
and treated more effectively; and
WHEREAS, being aware of the available health information, education, treatment, and support can help
individuals receive appropriate care and access resources to improve their quality of life; and
WHEREAS, community organizations, local health departments, churches and job sites can play a key
role in educating the public, members, or employees about breast cancer; and
WHEREAS, October is designated as "National Breast Cancer Awareness Month;" and
WHEREAS, the pink ribbon is the internationally recognized symbol of breast cancer awareness; and
WHEREAS, New Hanover County encourages people to recognize that breast cancer is treatable, and
that routine screening and early detection can save lives.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that
October 2021 will be recognized as National Breast Cancer Awareness Month in New Hanover County.
Citizens are encouraged to wear pink ribbons in recognition of breast cancer and in honor of women
who are courageously fighting the battle with breast cancer. The board further encourages women to
consult with their health care providers about regular screenings and to promote early detection of
breast cancer by having regular clinical breast examinations, getting regular mammograms, and
practicing a monthly breast self-examination.

NC General Statute 47-30.2 authorizes the county to appoint Map Review Officers to examine and approve plats and
maps prior to recordation at the Register of Deeds. A resolution designating a Review Officer must be recorded in the
county registry and indexed on the grantor index in the name of the Review Officer. In coordination with the
municipalities, the resolution addresses staff changes across all jurisdictions.

WHEREAS, NC General Statute 47-30.2 requires that every County appoint one or more Map Review Officers to examine
and approve plats and maps prior to recordation at the Registry of Deeds; and
WHEREAS, a Map Review Officer must examine and approve plats and maps to ascertain mapping accuracy and
consistency; and
WHEREAS, the City of Wilmington, Town of Carolina Beach, Town of Kure Beach, Town of Wrightsville Beach and New
Hanover County have requested that the staff listed below be designated Map Review Officers.

BRIEF SUMMARY:
Capital construction needs were identified and considered by the Board of Education during the FY22 budget process.
The construction needs include projects to be funded through the Public School Building Capital Fund, North Carolina
Education Lottery. Applications for the following projects are presented for consideration.
1. $200,000
- Boiler replacement at Murrayville Elementary School
2. $95,000 -
Hot water heater replacement at Veterans Park
3. $600,000
- Safety and security at various locations
4. $250,000
- Flooring repairs at Forest Hills Elementary
5. $27,500 -
Roof replacement at Holly Shelter Middle
6. $350,000
- Painting at Ashley High

- HVAC upgrades at Laney High
Total Project Applications: $1,757,500
The applications will be submitted to the NC Department of Public Instruction and once approved, a budget
amendment will be submitted to the Board of Education and the Board of County Commissioners for approval.
The unallocated balance of the Public School Building Capital Fund after this action is $1,182,859.

Section 2: Explanation
BA 22-010 budgets funds provided by New Hanover County Schools for the purpose of providing nurses during the
summer sessions. Specifically, these funds are being used for Salary and Fringe expenditures for 15 nurses that are
working from June 15 to October 1, 2021. It also covers a small incentive bonus for the nurses that took on these
additional summer responsibilities, which is outside of their regular work schedule. Coverage is being provided at
15 schools, including several traditional and year-round schools, as well as Snipes Academy. This revenue is unused
portions of the same revenue from FY20-21 that will be rolled forward for continued service in FY21-22 for the
dates indicated. No new positions are being requested and no county match is required.

BA 22-015 budgets a grant award from the COVID-19 Pandemic Response, Part IX: Consolidated Appropriations Act,
2021 Supplemental Nutrition Funding (HDC5) in the amount of $101,611. HDC5 funding allows support for Home
Delivered Meals (HDM) and Congregate Non -Unit Emergency Response Cost-COVID, such as food service equipment
and other unique items that allow providers to continue services or enhance nutrition services affected by the COVID-19
pandemic. The HDC5 funds expire on September 20, 2022 and do not require a local match. The Area Agency on Aging
approved the Senior Resource Center's HDC5 proposed funding plan to utilize funds that will support several nutrition
program -related needs that have been affected by the COVID-19 pandemic. The proposed use of HDC5 funds will be
utilized to support the cost of a constructed HDM and Congregate drive -up meal canopy to protect staff, volunteers, and
participants from weather elements during meal pick up; additional salary expenses to reclassify and increase the FTE of
an existing program assistant position to a nutritionist; casual part-time salary expense for the Maides Park drive -up meal
location; ice machine replacement; supplies for congregate sites; and contract service expenses for off -site meal
locations. Per Administration for Community Living (ACL) guidelines, the SRC will submit a waiver application along
with three bids to the Cape Fear Council of Governments Area Agency on Aging for final approval by the ACL of
Capital Acquisition/Improvement Process (canopy) costing $5,000 or more. These grant funds must be used to
supplement the county's nutrition programs but cannot supplant current funded services.

Commission for Women Inspiration Award for being an example of empowerment and inspiration to our community.
As of July 7, 2021, Ms. Young is the first professional female basketball player from New Hanover County who has
retired from the Women's National Basketball Association (WN BA). Chair Evans will provide additional information on
the award and Ms. Young during the update.

Brief on the functions: The Commission shall be organized for the purpose of acting as an advocate for

• To identify the status of women and assess the needs of women in New Hanover County
(County) and the City of Wilmington (City);
• To provide a status of women in New Hanover County report on an annual basis to the Board
and Council;
• To provide information and recommendations to the Board and Council on the needs and
issues important to women as it deems necessary in improving and upholding the opportunities
in employment, education and community services for all people, regardless of sex;
• To work toward the betterment of the status of women with respect to employment and
educational opportunities, health services, childcare services, welfare services, financial
services, and community leadership opportunities;
• To serve as an umbrella to coordinate and support all women's initiatives, organizations, and
networks in the County and the City including coordinating and cooperating with the YWCA and
other organizations involved in activities on the status of women; and
• To conduct educational seminars in collaboration with other organizations for residents and
businesses in the County and the City.

BRIEF SUMMARY:
Coastal Protection Engineering of North Carolina, Inc. (CPE-NC) began monitoring seven tidal creeks within New
Hanover County on a monthly basis in November 2007. The creeks included in this study are Pages, Futch, Lords, Mott,
Barnards, Smith, and Prince George. In addition, three sampling sites from within Airlie Gardens were included
beginning with the 2015-2016 sampling efforts.
Physical and biological parameter data is collected at each of the tidal creek sampling locations. Physical parameters
include temperature, salinity, conductivity, pH, turbidity, and dissolved oxygen. Biological parameters include
chlorophyll -a and Enterococci. At Airlie Gardens, physical parameters as well as chemical parameters including
orthophosphate and nitrate/nitrite are monitored. Enterococci samples are not collected at Airlie Gardens.
The information included in the annual report focuses on the results of the monitoring period that took place from July
2020 through June 2021. Long term trends have also been assessed using data obtained since 2007. The purpose of
this presentation is for CPE-NC staff to present data from the FY 2020-2021 monitoring program and long term trends.
In general, the dissolved oxygen levels within each creek have not changed notably from year to year and continue to
be non -problematic, though dissolved oxygen levels within Prince George Creek have been consistently low, which may
be attributed to the natural slow moving water of the creek. Turbidity has slightly increased in several creeks since
2008 but overall, turbidity levels remain non -problematic. Levels of chlorophyll -a in all watersheds have remained
consistent and show no signs for concern.
Overall, Enterococci bacteria levels during the 2020-2021 sampling for the majority of the watersheds remained the
same or were slightly lower than last year, with the exception of Pages Creek and Prince George Creek which saw
increases. Enterococci bacteria has had a history of elevated levels that have been of carefully monitored over the
years within several of the creeks including Mott, Pages, Barnards, Smith, and Prince George. Lords Creek and Futch
Creek, on average, have contained relatively lower bacteria levels compared to the other creeks.
As an ongoing effort to determine the source of the bacteria at Pages Creek, the county partnered with CPE-NC and
the University of North Carolina Wilmington (UNCW) on a research project this past year. In January 2021, an
unmanned aerial vehicle (UAV) equipped with thermal infrared sensors was flown along targeted segments within the
Pages Creek watershed to identify temperature differences between the surface water of the creek and surrounding
areas, which can indicate the presence of any contamination entering the creek. Following the study, several areas
were investigated, and some were ruled out based on reviewing aerial imagery and site visits. Groundtruthing the
remaining sites revealed several subterranean water seeps entering the creek from the streambank. Staff has worked
with CPE to perform additional water quality testing, which indicated there was Enterococci bacteria in the water
coming from the seeps. More samples and PCR tracing will be needed in order to make a definitive determination as to

whether that groundwater contains bacteria and if the bacteria is from a human source.

EXECUTIVE SUMMARY
This report represents the results of the New Hanover County Water Quality Monitoring Program from
July 2020 to June 2021. The results and long-term trends presented in this report are described from a
watershed perspective. Since 2007 the county has worked with Coastal Protection Engineering of North
Carolina to test water quality at nineteen (19) monitoring stations within seven (7) tidal creeks in New
Hanover County. The creeks monitored include Barnards, Futch, Lords, Mott, Pages, Prince George, and
Smith. Each creek is monitored monthly for physical, chemical, and biological characteristics that depict
the overall quality of the water. In addition to the raw sampling results, a general assessment of the water
quality is provided for each watershed. The general assessment gives each parameter the rating of either
"Good", "Fair", or "Poor" depending on the percentage of samples that went above the State standard
for turbidity, chlorophyll -a, and Enterococci, or below the State standard for dissolved oxygen. If the
recorded value of a parameter went outside the acceptable range of the State standard less than 10% of
the times sampled the watershed will receive a "Good" rating, a "Fair" rating 11%-25% of the times
sampled, or a "Poor" rating for greater than 25% of the sampling times.

Long Term Trends
Dissolved oxygen, turbidity, and chlorophyll -a levels fluctuate on a seasonal basis where levels decrease
in the winter and increase in the summer. Generally, dissolved oxygen levels have not changed drastically
from year to year and there has been minimal issues with low dissolved oxygen levels with the exception
of Prince George Creek where levels in the creek have been consistently low over time. This is due to
Prince George Creek's water flow, which is naturally slow and acts more like swamp -like waters. Slower
moving waters are typical of having lower dissolved oxygen levels. Likewise, in general, turbidity and
chlorophyll -a levels over time have not been of concern.
Overall, Enterococci bacteria levels during the 2020-2021 sampling for the majority of the watersheds
remained the same or were slightly lower than last year, with the exception of Pages Creek and Prince
Georges Creek which saw increases. Enterococci bacteria has had a history of elevated levels that have
been of carefully monitored over the years within several of the creeks including Mott, Pages, Barnards,
Smith, and Prince George. Lords Creek and Futch Creek, on average, have contained relatively lower
bacteria levels compared to the other creeks.
In addition to monitoring the seven tidal creeks, New Hanover County in 2015 began monthly testing at
the lake at Airlie Gardens due to concerns of water quality and noticeable algal blooms that had occurred
over the years. The lake drains directly into Bradley Creek close to the Intracoastal Waterway. There are
three sampling sites, one where contributing water enters the lake (intake), one in the middle of the lake,
and one at the outfall before the water enters Bradley Creek.

Since 2015 water quality monitoring has shown that dissolved oxygen varies significantly over an annual
basis, increasing during the warmer summer months and decreasing during the colder winter months.
Overall, there are no current concerns with the dissolved oxygen levels.
Over past 7 years, the levels of the nutrient orthophosphate as well as Nitrite/Nitrate has generally been
higher at the intake compared to the sampling sites located at the middle of the lake and at the outfall.
High concentrations of orthophosphate and Nitrite/Nitrate has been linked to algae growth leading to
algae blooms which can cause issues leading to low dissolved oxygen and a decline in overall water quality.
Levels of orthophosphate have incrementally increased over the past six years while Nitrate/Nitrite levels
have remained relatively stable.
Chlorophyll -a levels can also indicate the presence of algal blooms. In recent years levels have increased
at the middle of the lake and the outfall and compared to the sampling location in proximity to the intake
into the lake.
Improvement Efforts
In addition to continued monitoring there have been efforts from New Hanover County to improve overall
water quality including the purchasing of property with Clear Water Management Trust Funds, working
with the Cape Fear Public Utility Authority to test sewer infrastructure, install stormwater BMPs (Best
Manage Practices like raingardens, infiltration basins, and impervious surface retrofits), as well as perform
additional source tracking. In 2008 New Hanover County partnered with University of North Carolina
Wilmington's Center for Marine Science and Coastal Protection Engineering NC Inc. to conduct an initial
DNA source tracking study to identify the origin of the bacteria in Pages Creek. The study showed that
the water sampled tested positive for a human source suggesting that the bacteria in the creek was
coming from nearby wastewater systems such as septic tanks and/or the municipal sewer system.
Following the report, NHC Planning & Land Use partnered with the Cape Fear Public Utility Authority and
the NHC Health Department to search for leaking septic or sewer, however, that investigation did not find
the source for contamination. In 2013 the County partnered with UNC-Chapel Hill to conduct an extensive
study into the source of enterococci bacteria in Mott, Smith and Pages creeks. That study did find the
presence of a human signature in the bacteria for all three creeks, with Smith and Pages having the higher
counts.
In 2019 New Hanover County partnered with the University of North Carolina Wilmington's Socio-
Environmental Analysis Laboratory and Coastal Protection Engineering of North Carolina to conduct a
thermal imagery scan of two portions of Pages Creek adjacent to monitoring sites that have consistently
detected elevated levels of Enterococci bacteria in an attempt identify any possible sources of bacteria
entering the creek. The thermal study consisted of utilizing a thermal sensor (thermal camera) attached
to a fixed wing drone. The thermal sensor was flown following a rain event in January of 2021 in order to
detect differences in temperature both above and below ground to show anywhere where there maybe
uncommon warm spots or patterns that would normally be cold. Following the flight, UNCW and CPE
analyzed the imagery to identify uncommon differences in temperature that may be a possible target or
areas that may need follow up investigation. The full report from UNCW of the thermal study and a
summary from CPE are found in Appendix D and E of this report.
Most recently, staff has worked with CPE to perform additional water quality testing in two areas where
the thermal imagery showed peculiar temperature differences. Groundtruthing these sites revealed

several subterranean seeps entering the creek from the streambank. That testing indicated there was
Enterococci bacteria in water coming from the seeps in proximity of the two sewage lift stations adjacent
to the long-term monitoring sites at Pages Creek. More samples and PCR tracing will be needed in order
to make a definitive determination as to whether that ground water contains bacteria and if the bacteria
is from a human source.
Airlie Gardens
To help combat problems associated with eutrophication and overall water quality, Airlie Gardens has
implemented initiatives identified in their stormwater master plan. These initiatives include installing
several aerators in the lake to increase the dissolved oxygen levels, restore a wetland area near the entry
point where water enters the lake and the completion of a dredging operation effectively removing
approximately 4,000 cubic yards of bottom sediment and material. Monitoring data from this past year
has not shown a reduction on nutrient loading into the lake. It may take a couple to several years for a
data trend to emerge. It is recommended to continue to monitor the lake to gauge the status of the lake
and the effectiveness of the implemented projects.
Program Expansion
For this upcoming year, a new watershed and testing site have been added to the program. Island Creek
located in the norther portion of the county is segmented by Sidbury Road and is largely undeveloped.
The testing site proposed at a culvert that runs under Sidbury Road will provide a baseline for the water
quality data in the watershed. The baseline data will be necessary in in order to establish trends as the
area is anticipated to develop overtime.

Rezoning Request (Z21-11) - Request by Craig Johnson, Applicant on Behalf of the Property Owner, SOCOL, LLC,
to Rezone Approximately 5.1 Acres of Land Located at 4606, 4618, & 4626 South College Road from R-15,
Residential District to (CZD) R-5, Conditional Residential Moderate -High Density District, in Order to Develop a 40-
Unit Single -Family Development
BRIEF SUMMARY:
The applicant is seeking to rezone 5.1 acres of land located at 4606, 4618, & 4626 South College Road from R-15 to
(CZD) R-5 (Conditional Residential Moderate -High Density District). The applicant is proposing to construct a 20-
lot residential development, containing a maximum of 40 dual -unit attached homes. In response to concerns expressed
at the Planning Board's August 5th meeting, the applicant has revised the conceptual plan to include attached housing
structures, a reduced number of lots from 40 to 20, an increase in the minimum lot width, and replaces the concrete
parking pads with garages. The proposed performance development would be subject to a 20-foot perimeter setback
along the Fortune Place development and a minimum dedication of 20% open space. Primary access to the
development will be provided on Jasmine Cove Way.
Under the county's performance residential standards, the subject parcel would be permitted up to 13 dwelling units at
a density of 2.5 du/ac. The proposed 40 lots equate to an overall density of 7.8 du/ac.
As currently zoned, the site would generate about 33-42 trips during the peak hours, for an increase of 19-28 trips
during the peak hours. The estimated traffic generated from the site is under the 100 peak hour threshold that triggers
the ordinance requirement for a Traffic Impact Analysis.
Based on the current general student generation rate, staff would estimate that the increase in homes would result in
approximately 6 additional students than would be generated under current zoning. The general student generation
rate provides only an estimate of anticipated student yield as different forms of housing at different price points yield
different numbers of students. Please refer to the Schools section included in this report for additional information on
school enrollment and capacity.
One of the goals of the New Hanover County Strategic Plan for 2018-2023 is to encourage the development of
complete communities in the unincorporated county by increasing housing diversity and access to basic goods and
services. The proposed (CZD) R-5 zoning district would allow for an increase in housing diversity and would allow those
residents to utilize existing goods and services within one mile of the subject property.
While the area was zoned for low density housing in 1969, and the 2016 Comprehensive Plan encourages lower density
housing in this particular area, the recommended density range is up to approximately 8 du/ac. The rezoning will result
in an increase in density from 2.5 du/ac to 7.8 du/ac.

The intent of the R-5 zoning district is to serve as a transition between mixed -use or commercial development and low
to moderate density residential development. The site is situated between residential development to the north,
south, and west and a place of worship to the east. Silver Creek Village at Jasmine Cove, north of the request, is
zoned R-15 and contains a density of 8.7 units per acre. Fortune Place 11, south of the request, located within
the municipal limits, is zoned MF-L(CD) and contains a density of 2.6 units per acre.
The New Hanover County Future Land Use Map provides a general representation of the vision for New Hanover
County's future land use, as designated by place types describing the character and function of the different types of
development that make up the community. These place types are intended to identify general areas for particular
development patterns and should not be interpreted as being parcel specific. The subject parcel is General Residential.
The proposed (CZD) R-5, Conditional Residential Moderate -High Density District rezoning is generally CONSISTENT
with the intent of the 2016 Comprehensive Plan because the project provides for the types of uses and
density recommended in the General Residential place type and the proposal will provide a transition between a place
of worship and the established low and moderate residential neighborhoods.
The Planning Board considered this application at their September 2, 2021 meeting. At the meeting, five residents
spoke in opposition to the proposal, citing concerns about traffic, density, and drainage.
The Planning Board recommended approval of the application (6-0) finding it to be consistent with the purposes and
intent of the Comprehensive Plan because the project provides for the types of uses and density recommended in the
General Residential place type and the proposal will provide a transition between a place of worship and the existing
low and moderate density housing. The board also found their approval of the rezoning request is reasonable and in
the public interest because the proposal supports the county's goals of providing for a range of housing types and
opportunities for households of different sizes and income levels.
The Planning Board, with agreement of the applicant, included the following condition:
Each residential structure shall include an attached garage consistent with the elevations submitted with the revised
petition.

recommended for the property, and the project will provide an appropriate transition between a place of
worship and existing low and moderate density housing, I find DEN IAL of the rezoning request is
reasonable and in the public interest because the proposal is not consistent with the desired character of
the surrounding community and the density will adversely impact the adjacent neighborhoods.

• The R-15 district in this area was established in 1969. The purpose of the R-15 district is to
provide lands that accommodate very low to low density residential development that can
serve as a transition between very low -density residential development patterns and
smaller lot, more dense residential areas of the County.
• Under the County's performance residential standards, the subject parcel would be
permitted up to 13 dwelling units at a density of 2.5 du/ac. The proposed 40 units equate
to an overall density of 7.8 du/ac.
• The purpose of the R-5, Residential Moderate -High Density District is to provide lands that
accommodate moderate to high density residential development on smaller lots with a
compact and walkable development pattern. The R-5 district allows a range of housing
types and can be developed in conjunction with a non-residential district to create a vertical
mixed -use development pattern as well as serve as a transition between mixed -use or

The current general student generation rate was calculated by dividing the projected New Hanover County public school student
enrollment for the 2021-2022 school year by the number of dwelling units in the county. Currently, there are an average of 0.22

6. Conditional Zoning District Considerations
The Conditional Zoning District procedure is established to address situations where a particular land use would be
consistent with the New Hanover County 2016 Comprehensive Plan and the objectives outlined in the Unified
Development Ordinance and where only a specific use or uses is proposed. The procedure is intended primarily for
use with transitions between zoning districts of dissimilar character where a particular use or uses, with restrictive
conditions to safeguard adjacent land uses, can create a more orderly transition benefiting all affected parties and
the community at -large.
The applicant must explain, with reference to attached plans (where applicable), how the proposed Conditional
Zoning district meets the following criteria.
1. How would the requested change be consistent with the County's policies for growth and development, as
described in the 2016 Comprehensive Plan, applicable small area plans, etc.

River Birch Investments, LLC is requesting the property, including parcels R07100-003-046-000,
R07100-003-568-000, and R07100-003-567-000, be rezoned to from R-15 to Residential
Moderate -High Density (R-5) District for a forty (40) lot, single family residential use of the
property to provide a necessary missing middle housing opportunity. The R-5 district allows a
range of housing types and can be developed in conjunction with a non-residential district to
create a vertical mixed -use development pattern as well as serve as a transition between
mixed -use or commercial development and low to moderate density residential development.
The project is proposed on three tracts of mostly vacant land with one residence. The proposed
project is an infill site currently surrounded by developed properties of single family and a
church and conveniently located between two commercial centers with the Pine Valley library
and shopping to the north and Monkey Junction to the south.
The Future Land Use Map identifies this site as General Residential. General Residential focuses
on lower density housing ranging up to approximately 8 units per acre and typically consisting
of single-family or duplexes. The proposed project is for single-family residential at under 8
units per acre which aligns with the properties' classifications on the 2016 Comprehensive
Plan's Future Land Use Map.
We will amentize the pond by placing walking trails and a dog park adjacent therefore having
the pond be a vital part of our active open space. The proposed project will plant street tress in
addition to other landscape amenities to enhance the visual appeal of the neighborhood.
The project will have access via of the public right of way of Jasmine Cove Way and a WAVE
transit stop is conveniently located at the intersection of Jasmine Cove Way and College Road.
There are no wetlands or waters of the US present within the boundaries of the project parcels.
Water and sewer are available to the property line of the project site.

housing types, opportunities, and choices. This project will provide a safe and conveniently
located community and provides another housing type near the employment centers as it is
located between two commercial centers with the Pine Valley library and shopping to the north
and Monkey Junction to the south.

3. What significant neighborhood changes have occurred to make the original zoning

existing zoning?
The project site is boarded on the north by Jasmine Cove, a townhome community, Cedar Cove
Assisted Living Facility, and the Wilmington Shrine Club; to the east by religious institutions and
the Wilmington Shrine Club, the south by a religious institution; and to the south and west by
single family residential. The surrounding properties have not been developed in the typical R-
15 purpose of very low to low density residential development and the R-5 zoning with single
family lots would be a proper transition to the surrounding uses.
The R-5 district allows a range of housing types and can be developed in conjunction with a
non-residential district to create a vertical mixed -use development pattern as well as serve as a
transition between mixed -use or commercial development and low to moderate density
residential development. Due to the unique dimension of this tract, the proximity to College
Road, the proximity to transit and services, this site lends itself to meet the purpose of the R-5
zoning district.

BEGINNING at a point in the southern line of the 36 foot tract of land conveyed to Henry Martindale by
Deed recorded in Book 00, at Page 649 of the New Hanover County Registry; said point being North 70
degrees 55 minutes West along said line 600.0 feet from its intersection with the western line of N.C.
Highway No. 132 (200 foot right-of-way), said intersection point being South 5 degrees 10 minutes West

Community Meeting Summary
for Conditional Rezoning Request by River Birch Investments, LLC
Meeting Date & Time: Tuesday June 29, 2021, 6:00 PM
Meeting Location: Zoom
Representatives from River Birch Investments, LLC, Intracoastal Engineering, PLLC, and
DAVENPORT Engineering (collectively, "Development Team") hosted a meeting to introduce
the proposed development including parcels R07100-003-046-000, R07100-003-568-000, and
R07100-003-567-000, which is proposed to be rezoned to from R-15 to Residential Moderate -
High Density (R-5) District for a forty (40) lot, single family residential use currently known as
"Jasmine South". Property owners within 500 ft. of Jasmine South, as required by New Hanover
County, were notified of the community meeting by mail on June 18, 2021.
The meeting allowed people to view a context aerial for general site location purposes and
a concept of the overall proposed conditional rezoning. The Development Team also provided a
brief overview of the public hearing process and technical review process for development projects
in New Hanover County.
The community asked the Development Team questions about the plans, and many of the same
questions were discussed repeatedly during the meeting. The following is a synopsis of the
comments heard at the meeting.
• A few people mentioned receiving the notice of the community meeting late and possible
difficulty of accessing the Zoom meeting. The Development Team agreed to set up a
separate email account for Jasmine South and to follow up with the neighbors after the
meeting.
• Attendees were most concerned about the density of the project. The Development Team
explained the project is intended to serve as workforce housing.
• Neighbors expressed worry about what type of housing product would be built. The
Development Team stated the proposed request will be for detached, single family housing.
• Questions were presented regarding homes sizes and sale prices. The Development Team
explained the exact product type is still under consideration, but the home size is estimated
to be 1600 sq feet with a price range starting at $250, 000.
• One participant expressed concerns over potential air, light, and noise pollution. The
Development Team explained the proposal is for single family residential and any street
lights will be required to shine down on Jasmine South.
• Concerns were raised over the potential for Jasmine South to lower the property value of
the adjacent neighborhoods. Again, the Development Team explained the exact product
type is still under consideration, but the home size is estimated to be 1600 sq feet with a
price range starting at $250, 000.
• Neighbors asked if the project would seek government assistance or subsidies. The
Development Team said no.
• Concerns were raised regarding the project's impact on the school system and bus stops.
The Development Team agreed to discuss this concern with New Hanover County staff.
• Neighbors expressed concern over the visibility of the structures from their properties. The
Development Team is going to work on potential elevations of the proposed single family

detached homes. The project site has few trees and it appears most are within the adjacent
Homeowner Association areas.
A question was asked if Jasmine South would be fenced. The Development Team stated
that due to the desire for workforce housing, the proposal does not include a fence.
However, homeowners could certainly install them if they chose.
Neighbors had concerns over the current stormwater issues, ponds, and ditches as well as
the potential hazards of a pond. It was explained that the state stormwater regulations
require the project to treat all water on site and not contribute to flooding in the area. The
ponds are not required to be fenced under New Hanover County code requirements.
Concerns centered around traffic that will be created by the development and the proposed
access. The Development Team explained a traffic impact analysis was not warranted but
they did study the traffic and found 33 AM Peak Hour Trips and 42 PM Peak Hour Trips.
The Development Team explained that Jasmine Cove Way is a public road and that is why
it will be used for access to the project instead of access through third party private
property.
Jasmine South proposed a dog park and neighbors were concerned over noise and fencing.
The proposed dog park would be fenced and was proposed as an additional amenity to
Jasmine South.
A question was asked if there had been an environmental study completed and if there was
any endangered wildlife. The Development Team stated they had completed an
environmental survey to determine if there were any wetlands or waters of the U.S. present
within the boundaries of the parcels and there were none found. A study had not been done
for wildlife but the Development Team would check with New Hanover County since there
is other recent development in the area.
One neighbor asked about Native American camps on the site. The Development Team had
no knowledge of such but agreed to check with New Hanover County since there is other
recent development in the area.
Questions arose regarding the water and sewer capacity and connection areas. CFPUA has
stated there is capacity and connections are located on Jasmine Cove Way.
