Road(s) Description:
ROADS IN BAYSHORE ESTATES, SECTION 14
WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the county of New Hanover requesting that the above described
road(s), the location of which has been indicated in red on the attached map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road system, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described road(s), and to take over the road(s) for maintenance if they
meet established standards and criteria.
CERTIFICATE
The foregoing resolution was duly adopted by the Board of
Commissioners of the County of New Hanover at a meeting on the

A regular meeting of the Board of Corrunissioners of the County of
New Hanover was held on Tuesday, December 21, 1993 at 9:00 a.m. in Room
100 of the New Hanover County Administration Building, 320 Chestnut street
Wilmington, North Carolina, and the following Commissioners were present: '

following bond orders which were read by title:
"BOND ORDER AUTHORIZING THE ISSUANCE OF
$13,900,000 COMMUNITY COLLEGE BONDS
OF THE COUNTY OF NEW HANOVER"
WHEREAS, the Board of commissioners of the County of
New Hanover has received and considered a resolution from the
Board of Trustees of Cape Fear Community College fncluding a
request that the Board of Commissioners provide and improve
additional community College facilities in the County; and

WHEREAS, the Board of Commissioners of the County of
New Hanover deems it advisable to make the improvements
hereinafter described; and
WHEREAS, the Board has caused to be filed with the
Secretary of the Local Government Commission of North Carolina an
application for Commission approval of the bonds hereinafter
described as required by The Local Government Finance Act, and
the Secretary of the Local Government Commission has notified the
Board that the application has been filed and accepted for
submission to the Local Government commission; NOW, THEREFORE,
BE IT ORDERED by the Commissioners of the County of New
Hanover, as follows:
section 1. The Board of commissioners of the County of
New Hanover has ascertained and hereby determines that it is
necessary to provide improvements to community college
facilities, including the construction of new facilities and
expansion of existing facilities at Cape Fear Community College,
and including the acquisition and installation of necessary
furnishings, machinery and equipment and the acquisition of land
or rights-in-land required therefor, and to pay capital costs of
such improvements.
section 2. In order to ralse the money required to pay
capital costs of providing the improvements as set forth above,
in addition to any funds which may be made available for such

purpose from any other sources, bonds of the County of New
Hanover are hereby authorized and shall be issued pursuant to The
Local Government Finance Act of North Carolina. The maximum
aggregate principal amount of said bonds authorized by this bond
order shall be $13,900,000.
section 3. A tax sufficient to pay the principal of
and interest on said bonds when due shall be annually levied and
collected.
section 4. A sworn statement of the County's debt has
been filed with the Clerk to the Board of Commissioners and is
open to public inspection.
section 5. This bond order shall take effect when
approved by the voters of the County at a referendum.

OF THE COUNTY OF NEW HANOVER,lI and "BOND ORDER AUTHORIZING THE
ISSUANCE OF $39,900,000 SCHOOL BONDS OF THE COUNTY OF NEW
HANOVER," have been introduced at the meeting of the Board of
Commissioners held on December 21, 1993 and the Board desires to
provide for the holding of public hearings thereon and the
submission of a statement of debt in connection therewith as
required by The Local Government Bond Act; NOW, THEREFORE,
BE IT RESOLVED by the Board of Commissioners of the
County of New Hanover, as follows:
(1) The public hearings upon said bond orders shall be
held on the 3rd day of January, 1994, at 6:10 o'clock, p_.M., at
320 Chestnut Street. R(X)lll 100 , in wilmington, North
Carolina.
(2) The Clerk to the Board of Commissioners is hereby
directed to cause a copy of each bond order to be published with
a notice of each such hearing in the form prescribed by law in a
qualified newspaper no fewer than six days prior to each such
public hearing.

file with the Clerk to the Board of commissioners, prior to

WHEREAS, after due advertisement, and readvertisement bids were,
received and publicly opened by BMS Architects at 3:00 p.m. on the 23rd day
of November, 1993, at the County Administration Building, 320 Chestnut
Street, Wilmington, North Carolina, and bids were received for General
construction of the new Animal Control Center; and
WHEREAS, the Animal Control Center Task Force, the Finance Director,
and the County Manager recommend that the contract be awarded to Group III
Management, Inc., of Kinston, North Carolina, the lowest responsible
bidder, in the amount of Five Hundred Ninety-Five Thousand Sixty-Five
Dollars ($595,065); and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
New Hanover County that the contract for General construction for the new
Animal Control Center, Bid #94-0199A be awarded to Group III Management,
Inc. in the amount of Five Hundred Ninety-Five Thousand Sixty-Five Dollars
($595,065) and that the County Manager is hereby authorized and directed to
execute the contract, contract form to be approved by the County Attorney.

bidder, in the amount of Fifty-Five Thousand One Hundred Twenty-Three
Dollars ($55,123); and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
New Hanover County that the contract for Electrical construction for the

SOLID WASTE CONSTRUCTION PROJECT
BE IT ORDAINED, by the Board of Commissioners of New Hanover
County:
1 .
New Hanover County (County) is
engaged in the
construction of the Solid Waste Construction Project, which
capital project involves the construction and/or acquisition of
capital assets.
2. County desires to authorize and budget for said capital
project is a project ordinance adopted pursuant to North Carolina
General Statute $159-13.2, such ordinance to authorize all
appropriations necessary for the completion of said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute $159-13.2.

The capital
project undertaken pursuant to this
ordinance is the Solid Waste Construction Project which project
is herewith authorized.

WHEREAS, after due advertisement, bids were recei ved and

3:00 p.m. on the 18th day of November, 1993, at the conference room
at the New Hanover County Wastec Administration Building, 3002
Highway 421 North, Wilmington, North Carolina, and the following
bid was received for Wastec Ash Handling Area & Drainage
Improvements for the Environmental Management Department, Bid
Number 94-0191.
Tri-state Consultants - $90,821.00
AND WHEREAS, according to G.S. 143-132, if fewer than three
bids are received after the first advertisement for a formal
construction bid, a second advertisement of the proposal should be
made and after this second advertisement, the award may be made
even if only one bid has been received;
AND WHEREAS, after the first advertisement, no bids were
received and the proj ect was advertised as required by. General
Statutes a second time after which only one bid was received;
AND WHEREAS, it became necessary to modify the scope of work
to deduct work associated with the vibrating conveyor and add work
to allow the use of roll-off boxes.
AND WHEREAS, the Environmental Management Director, the
Finance' Director and the County Manager recommends that the
contract be awarded to Tri-state Consultants of Greensboro, North
Carolina, the lowest responsible bidder, in the amount of Ninety
Thousand Eight Hundred and Twenty One Dollars ($90,821.00);
AND WHEREAS, funds have been previously appropriated and are
now in or will be in subsequent years budget Account Number 715-
480-8510-6424.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for Wastec
Ash Handling Area & Drainage Improvements for the Environmental
Management Department, be awarded to Tri-state Consultants in the
amount of Ninety Thousand Eight Hundred and Twenty One Dollars
($90,821.00); and that the County is hereby authorized and directed
