AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North
Carolina, does hereby ordain that Chapter 8, Fire Protectio~ and
Prevention, Article II and Article. III, New Hanover County Code,
are hereby amended as follows:
p~end Article II caption to read: FIRE. CODE ENFORCEMENT AND
FIRE MARSHAL.
}~end Section 8-16 as follows:
Section 8-16. Title of Article.
This Article shall be known as the "New Hanover County
Fire Code Enforcement Ordinance".
Repeal existing Section 8-17.
(note: On July 1, 1991 the North Carolina State Building
Code, Vol. V, Fire Prevention, became mandatory statewide).
Repeal existing Sect.ion. 8-18, and substitute. the following:
Section 8-18. Purpose of this Article.
The Purpose of this Article is to provide for local
enforcement of the North Carolina State Building Code,
Vol. V, Fire Prevention, including Chapter 4 therein.
Repeal existing Section 8-19.
Repeal existing Section 8-20.
Amend Section 8-21, Duties of. the Fire Marshal, as follows:
SEC. 8-21 Duties of the Fire Marshal..
The Fire Marshal shall have the duties and. authority
set forth in G.S. section 153A-234.. Duties and authority
shall include but are not limited to:
(a) Advising the board on improvements in the fire-fighting
or fire prevention activities under the county's
supervision or control.
(b) Coordinating fire preven.tion activities under the
county's supervision or control.
(c) Assisting incorporated volunteer fire departments in
developing and improving their fire-fighting or fire
prevention capabilities.

(d) Making fire prevention inspect~ons, including the
periodic inspections and reports of school buildings.
required by chapter 115 and the inspections of
day-care facilities required by chapter 110. The
Fire Marshal shal.l not make electrical inspections
unless he or she is qualified to do so under G..S.
section 153A-351.
(e) Exercising, as chief. of the Fire Code Division. of the
Inspection Department, all duties, powers, and
author~ty express and. inherent in that office,
including the enforcemen.t of the State Fire Prevention.
Code.
Sec. 8-25 Enf.orcement and. penalties..
As provided in section 1-15 of this Code, violations of
this article may be enforced by anyone (1) or more of the
remedies authorized by G.S. 153A-123, including but not
limited to the following:
(a) The Fire Marshal may issue a citation which subjects
the offender to a civil penalty of fifty dollars
($50.00) to be recovered. by the county in a civil
action in the nature of debt if the offender does not.
pay the penalty within twenty (20) days after being
cited for a violation.. Provided, however, that the
Fire Marshal may issue a citation for a locked or
blocked. exit violation which subjects the offender
to a civil penalty of one hundred dollars ($100.00)
td be recovered by the county in a civil action the
nature of debt if the offender does not pay the penalty
within twenty (20) days after being. cited for a
violation.
(b) A misdemeanor warrant may be issued ei.ther inunediately
or upon the issuance of a citation and. the violator's
failure to. pay the same.
(c) A civil action seeking an injunction and order of
abatement may be commenced against. the violator.
Each Day's continuing. violat.ion of this article. is a
separate and_ distinct offense.

It appearing to the Board of County Commissioners of New
Hanover County that a Resolution of Intent to close a portion of
an unnamed road was adopted by the County Commissioners on the
3rd day of February, 1992; and it further appearing that said
resolution called for a hearing to be held on the 4th day of
March, 1992, at which time the County Commissioners would hear
complaints and comments of interested persons, and it further
appearing that notice of said hearing was published in the
Wilmington Star News in accordance with the Road Closing
Ordinance of New Hanover County, and after conducting such
hearing the County Commissioners are of the opinion that a
portion of this unnamed road in the County of New Hanover should
be closed and are satisfied that the closing of same is not
contrary to the public interest, and that no individual owning
property in the vicinity of the roads will be deprived of
reasonable means of ingress and egress to his property by such
closing, the legal description of said road being as follows:
ORDER

Being a twenty (20) foot right-of-way beginning at
a point and intersection with the western right-of-way
of Bald Eagle Lane and the southeastern property corner
of lot 25 as displayed on the map of Sections E and F
of Porters Neck Plantation; recorded in Map Book 6,
Page 1 of the New Hanover County Registry; running
thence from said point 500 feet west to the southwest
corner of lot 25 as shown in Map Book 6, Page 1 of
Porters Neck Plantation; running thence 650 feet north
to the northwest corner of lot 31, Porters Neck
Plantation which is the point of termination.
NOW, THEREFORE, IT IS ORDERED AND DECREED that the above
described road be and the same is hereby closed. It is further
ORDERED that a copy of this order be filed in the Office of the

County Manager recommend that the contract be awarded to
D & E Car Exchange, Inc. of Wilmington, North Carolina, the
lowest responsible bidder, in the amount of Eighteen Thousand
Five Hundred Dollars ($18,500.00) for the 1991 Monaco and 1990
Dynasty;
AND WHEREAS, funds have been previously appropriated and are
now in Account No. 110-431-4311-3000-6450 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for Two
Used Vehicles for the sheriff's Department, Bid # 92-0235 be
awarded to D & E Car Exchange, Inc. in the amount of Eighteen

Plan for the Use of Turnkey III Refund
HUD requires the Housing Authority to submit a plan for
obtaining a refund of excess residual receipts, operating
reserves and proceeds from the sale of houses in Creekwood North.
The Housing Authority can use the refund for modernization of
Public Housing or for the development of more housing for lower
income fa~lies.
The following funds are available from the sale of houses in
Creekwood North:

As required ny BUD the Housing Authority's plan must be
developed after consultation with resident organizations and
local governments. This synopsis is intended to advise
residents, Housing Authority Commissioners and local elected
officials of the plan for the use of the refund from the sale of
houses in Creekwood North. The plan only budgets for the use of
the $1,620,821.00 received by BUD from houses already sold. As
houses are sold in the future, the proceedS from the
$1,774,387.75 may be allocated to one or more of these housing
programs.
$200,000.00 Modernization and Landscaping Improvements to
Public Housing Developments
The Housing Authority plans to purchase trees and shrubs to
to be planted at various developments. Where appropriate the
Housing Authority may install yard furniture such as park
benches.

$500,000.00 Development of Apartment Complex
The Housing Authority plans to develop a 40 unit apartment
complex containing 2 and 3 bedroom units. The units will be
available to existing Public Housing or section 8 tenants who
agree to participate in the Family Self Sufficiency (FSS)
Program. Families participating in the FSS Program will receive
a variety of services to help improve their economic
well being. Families can live in these apartments for up to
seven (7) years.
$500,000.00 Home ownership Pool
The Housing Authority proposes to participate with local
banks in the Home ownership Pool (HOP). The Housing Authority
will fund 40% of a mortgage at a low interest rate, a local batik
will fund 60% of the mortgage at a market interest rate. The
lower interest rate loan from the Housing Authority will reduce
the borrower's monthly house payment.
The HOP offers Housing Authority tenants:
Low down payments of 2% of the cost of acquisition or no
less than $1,000.00.
Low interest fixed rate loans for 30 years.
The total mortgage pool will be $1,250,000.00. The
participating banks will contribute $750,000.00 to the HOP. The
mortgage pool can fund approximately 25 loans at $50,000.00 each.
$400,000.00 Homeplace Housing
The Housing Authority will provide WHED $400,000.00 to help
fund the acquisition and rehabilitation or construction of 18
single family houses. The houses are expected to cost
approximately $45,000.00 each. It is anticipated that private
lenders will provide $410,000.00 in first mortgage financing.'"
The tenants for these houses will be selected from the
Housing Authority's Public Housing and Section 8 waiting lists.
In order to lease these houses tenants must agree to participate
in the Housing Authority's Family Self Sufficiency Program.
Tenants will be allowed to live in these houses for a maximum of
7 years.

~20,821.00 Down Payment Assistance
The Housing Authority will provide public Housing tenants
purchasing a house up to $2,000.00 or half the cost of the down
payment or closing costs, whichever is less. There is no monthly
payment for the Down Payment Assistance. The Down Payment
Assistance will be secured by a second mortgage which will be
forgiven if the family lives in the house for 15 years. If the
house is sold before 15 years, all or a portion of the Down
Payment Assistance may be payable based on the net appreciated
value of the house.
$1,620,821.00 Construction Loans
The Housing Authority will not be aD~e to spend the
$1,620,821.00 for the programs listed in the plan when it is
received from BUD. It is anticipated that these funds will be
loaned out over a period of three years for the various programs.
Therefore, the Housing Authority will have funds available for
short term construction loans.
The Housing Authority construction loans will be available
to developers, general contractors or persons constructing houses
or apartments for lower or moderate income families. For
example, a builder constructing a house for a Housing Authority
tenant to purchase could receive a construction loan.
The Housing Authority construction loans will be loaned at
one half (1/2) prime rate for a term of six to twelve months.
The Housing Authority will lend 90% of the appraised value or
cost whichever is less. The construction loan will be secured by
a first mortgage.
WHFD will originate construction loans for the Housing
Authority. The construction loans will be approved by the Board
of commissioners or a committee of the Board. The purpose of the
low interest construction loan is to help lower the cost of
housing for low income families.
