RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR APPROVAL
OF A FINANCING AGREEMENT AUTHORIZED BY NORTH CAROLINA GENERAL
STATUTE 160A - 20
WHEREAS, the Board of Commissioners (the "Board") of the
County of New Hanover, North Carolina (the "County") desires to
provide for the construction and/or renovation on certain County-
owned real property (the "Project") named the New Hanover County
Law Enforcement Facility to provide additional jail space; and
WHEREAS, the Board desires to finance the Project totalling
approximately $1,451,043 with approximately $650,000 from a united
States Marshalls Service Grant, $81,043 from the 911 Surcharge, and
$ 72 0,000 through an installment financing contract (the "Contract")
with First Union National Bank of North Carolina, Charlotte, North
Carolina ("First Union"), obligating the County to repay amounts
financed at a fixed annual interest rate of not more than 7% over
a term of approximately seven (7) years , resulting in a total
amount financed not to exceed $720,000, an average annual payment
of approximately $128,734 and total payments of approximately
$901,137. Pursuant to a proposal submitted by First Union to the
Board; and
WHEREAS, pursuant to NCGS Section 16 OA-2 0, the County is
authorized to finance the construction and lor renovation of the
Project by entering into an installment financing contract which
creates in the Project a security interest to secure payment of the
obligation thereby created; and
WHEREAS, subject to the prior approval of the Local Government
Commission of North Carolina (the "LGC") pursuant to NCGS Section
159-148, the County intends to finance the Project pursuant to said
Section 160A-20 by executing and delivering to First Union the
Contract providing for the financing of a principal amount not to
exceed $720,000;
NOW, THEREFORE, BE IT RESOLVED that the Board meeting in
regular session on the 6th day of April, 1992, make the following
findings of fact:
1. The proposed contract is necessary and expedient because
the County is experiencing overcrowding in it's jail
facility to the point of threatened litigation on behalf
of the jail inmates by the Legal Services of North
Carolina.
2. The proposed contract is preferable to a bond issue due to
the expediency needed in solving the overcrowding problem.
In addition, the County does not have a "two-thirds" bond
option this fiscal year due to ,no "net debt reduction".
The small qmount of financing needed also lends itself to
installment financing. The sum that falls due under the
Contract on an annual basis can be included in the
County's budget without difficulty, and are not excessive

for the Project.
3. The County attorney has advised the County that -the
Project is authorized by law and is a purpose for which
public funds may be expended pursuant to the Constitution
and laws of North Carolina.
4. There will be no increase in taxes necessary to meet the
sums to fall due under the proposed contract.'
5. The County is not in default on any of its debt service
obligations.
6. The County's past Comprehensive Annual Financial ReportS
indicate the debt management procedures and policies have
been carried out in strict compliance with the law and the
County has not been censured by the LGC, external
auditors, or any other regulatory agencies in connection
with such management.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Finance
Director is hereby authorized to act on behalf of the County
in filing an application with the LGC for approval of the
Project and the propo~ed financing contract and other actions,
including contracting with the County's bond attorney,
LeBoeuf, Lamb, Leiby and McRae, not inconsistent with this
resolution.

THE ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is
hereby further amended as follows:
ADD UNDER
59.4-5 . . . However , improvements as specified,' in Section
59.4-4(3) may be permitted within the conservation space
setbacks. Addi tional1y, decks may be allowed to encroach
into the conservation space setback up to six (6) feet
provided they are uncovered and constructed so that the
floorboards are spaced to allow water to flow through
directly to the ground. The ground below the deck shall be
ei ther left undisturbed or planted with ground cover or
other vegetation.

OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is
hereby further amended as follows:
ADD:
23-98 Water-oriented Parking A designated docking space
provided by a commercial establishment for the express use
of its customers. Water-oriented parking shall only be
allowed in conjunction with commercial establishments that
are located on navigable waters.
ADD UNDER:
80-1 ...such off-street parking may be provided on graded
improved open space or in an elevated parking structure or a
designated docking space on adjoining navigable waters....

80-6 ...Small parking spaces shall have a minimum width of eight
fe,et and a minimum length of 16 feet. Water-oriented
parking shall have a minimum width of ten feet and a minimum
length of 16 feet. space adjacent to a floating dock shall
have a minimum length of 16 feet. Each space or area
designated for small vehicle or water-oriented parking shall
be identified by proper signage. Water-oriented parking
shall consist of a minimum of two (2) boat slips but shall
pot account for more than 10% of the parking requirement of
any designated use.

RESOLUTION
MAINTENANCE ABANDONMENT OF A PORTION OF
RAMS GATE ROAD EXTENSION (SR 1715) ,
Whereas, a request has been made by the North Carolina
Department of Transportation on behalf of officials at Fort
Fisher Aquarium requesting the Board of Commissioners of New
Hanover County to recognize the removal from State maintenance
approximately 1,500 feet of the southern end of Ramsgate Road
Extension (SR 1713) more commonly known as Aquarium Way for the
purpose of security precautions during closing hours at the
Aq1,larium site, said portion being located south of Highway 421
South.
Whereas, ready and accurate identification of public and
private roads is important for the delivery of general county
services, for the response of emergency and public safety
vehicles and for the convenience of the general public; and
Whereas, such abandonment will not endanger the health,
safety and welfare of the citizens of New Hanover County;
Therefore, be it resolved that the abandonment of 1,500 feet
of Ramsgate Road Extension (SR 1713)/Aquarium Way from the
Department of Transportation maintenance become official and that
a copy of this resolution be forwarded to the North Carolina
Board of Transportation.
