Call to order Chairman- William Blair, III called to order the regular meeting of the New Hanover County Alcoholic Beverage Control Board at 9:00am on April 21, 2022 at the General Office, 6009 Market Street, Wilmington, NC. II. Chairman confirms quorum The following Members of the Board were present.: William Blair, III, Chairman Cedric Dickerson, Vice Chair Bruce Shell., Member Thomas Wolfe, Member William Rivenbark, Member Others in attendance were: Charles Hill, General Manager James Casteen, Assistant General Manager Kathy Clark, Finance Officer/Board Secretary Wanda Copley, Legal Counsel Lieutenant Joe Jewell, NHC Sheriff's Department Chief Deputy Sarvis, NHC Sheriff's Department Amy Pasareti, Port City Daily Alderman Ken Dull, Wrightsville Beach Mayor Lynn Barbee, Carolina Beach Mayor Pro Tem Jay Healy, Carolina Beach County Manager Chris Coudriet, NHC County Manager Mayor Bill Saffo, City of Wilmington III. Conflict of Interest Reminder Mr. Blair verbally confirmed that the Board members had read the following ethics reminder: "In accordance with General Statute 18B-201, it is the ditty of every Board member to avoid both conflicts of interest and appearances of conflicts. Does any member have any known conflict of interest or appearance of conflict with respect to any matters coming before the Board today? If so, please identify the conflict or appearance of conflict and refrainfrom any undueparticipation in theparticular matter involved. " 11Page Let it be recorded that no conflicts were identified by any Board member regarding this Board meeting. IV. Consent ALYenda Items of Business Mr. Blair presented the minutes from the Regular Meeting of March 17, 2022. Mr. Wolfe made the motion to approve the minutes as written. Mr. Dickerson seconded the motion, all approved. Mr. Blair presented the minutes from the Closed Session of March 17, 2022. Mr. Wolfe made the motion to approve the minutes as written. Mr. Dickerson seconded the motion, all approved. Mr. Blair presented the proposed meeting agenda. Mr. Dickerson made the motion to approve the agenda as written. Mr. Shell seconded the motion, all approved. V. Regular Agenda Items Extra Profit Distribution/budget Amendment 4002 — Ms. Clark present a proposed Extra Profit Distribution of $1,914,940.34, from the sale of vacant property located at 5978 Carolina Beach Road and excess working capital at FY ending June 30, 2021. She also presented a proposed Budget Amendment 4002 (Attachment "A"). Mr. Shell made the motion to approve the Extra Profit Distribution in the amount of $1,914,940.34 and Budget Amendment #002. Mr. Wolfe seconded the motion, all approved. Presentation of the extra profit distributions checks were given to representatives of the five municipalities within New Hanover County. Callijill Outlay for Racking System for the Warehou — Ms. Clark present a proposed Budget Amendment 4003 (Attachment "B") to increase the previously budget capital outlay for the racking system for the warehouse by $874. Mr. Dickerson made the motion to approve the Budget Amendment #003, for the increase of $874 for the racking system for the warehouse. Mr. Wolfe seconded the motion, all approved. Capital Outlay for Toyota Flectrie Forklift/BudgeForklift/Budgel Amendment 4004 -- Ms. Clark present a proposed Budget Amendment #004 (Attachment "C") to add a capital outlay for a new Toyota Electric Forklift in the amount of $39,048.58. Mr. Dickerson made the motion to approve the Budget Amendment #004, to add a capital outlay for a new Toyota Electric Forklift in the amount of $39,048.58. Mr. Wolfe seconded the motion, all approved. VI. Administrative Reports • ABC Law Enforcement Officers' Unit Monthly - (ALE) Report for March was 2111�)ge presented by Lieutenant Joe Jewell. Please see the attached LE Monthly Reporting Numbers from the North Carolina ABC Commission website (Attachment "D"). Financial Statements — Mr. Casteen presented a copy of the Board Financial Statements for March, 2022. The Financial Statement showed, the Actual -to - Actual comparison Gross Sales more than the prior March by $430k (&51%), Operating Expenses more than prior March by $20k (4.13%), and income from Operations was more than prior March by $103k. Mr. Casteen reported that of the $9.7 million in the bank that there were unrestricted funds of $8.3 million, working capital restricted of$1.8 million. General Manager Updates: Reg ugEj fQr Board, Chair and Board Member AVIjointmen—I Mr. Hill. advised the Board that the New Hanover County Commissioners will be accepting applications starting May 1, 2022, for the upcoming vacant seats on our Board in July, 2022. The Board agreed to send a letter to the New Hanover County Commissioners, requested for the reappointment of Mr. Dickerson. Also, requesting that Mr. Shell be appointed as the Board Chair for the upcoming year. Re -mulch Wrillhtsville Beach Store — Mr. Hill presented a proposal from Levy Landscaping to re -mulch the Wrightsville Beach Store for $2,1 00. Mr. Wolfe made the motion to approve the proposal from Levy Landscaping to re -mulch the Wrightsville Beach Store for $2,100. Mr. Rivenbark seconded the motion, all approved. Cepco POA — Mr. Hill advised the Board that Mr. Wolfe and himself had met with representatives from Cepco to handle the Market Street Property Owners Association. VII. Pliblic Comments on Non-AgeriLla Item — Chief Sarvis of the New Hanover County Sheriffs office thanked the Board for their support of law enforcement and the Sheriff. VIII. Adiournment Mr. Blair advised of the next Board Meeting to be held on Thursday, May 19, 2022 at 9:00am at the General Office, 6009 Market Street, Wilmington, NC.
