Item 1: Lot 11 N Kerr Industrial Park – Commercial Site Plan (Energov: SITECN-22-000025)
Request by Mark Maynard with Orville Wright Properties, LLC for a warehouse in the N Kerr Industrial
Park. The subject property is located at 2944 Orville Wright Way. It consists of 1.1 acres and is zoned I-2.
The engineer is Charlie Cazier with Intracoastal Engineering (charlie@intracoastalengineering.com). The

The following comments have been received for the June 15, 2022 TRC meeting. Additional comments
may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.

1. Zoning district: I-2
2. Uses (2):
a. The first defined use is Warehousing: The storing of goods, wares, and merchandise
within an enclosed building, whether for the owners or others. There is little on-site sales
activity with the customer present. Uses include: cold storage facilities (including frozen
food lockers); distribution warehouses (used primarily for temporary storage pending
distribution in response to customer orders); storage warehouses (used for storage by
retail stores such as furniture and appliance stores); warehouse storerooms; or similar
uses.
b. The second defined use is Contractor Office: An establishment primarily engaged in the
day-to-day administrative and clerical services for businesses providing contracted
services, such as building contractors, heating and air conditioning (HVAC) repair,
landscaping and janitorial services, etc., that require outside and/or fleet storage. The use
may include some on-site repair and material preparation work.
3. General comments:
a. Is the western side of the building proposed for loading bays for the warehouse? If so,
please clearly label these on the site plan.
b. Please be aware that land disturbance permits will not be issued until the tree permit has
been approved.

c. Where will the HVAC units be placed? It looks like the building to the east of this site has
HVAC units in the parking area behind the structure. This is not a building/safety code
note, but if the plan is to place the HVAC units in a similar way to the building next door,
we’d suggest bollards to protect the systems from damage.
4. Signs:
a. Please note any sign is subject to Section 5.6. of the UDO and note any other planned
locations of signs.
5. Access:
a. Please provide all NCDOT approvals upon receipt. Please be aware that no building permit
will be issued until NCDOT has issued the Driveway Permit approval.
6. Landscaping/Buffering:
a. Please provide a Landscape Plan with calculations, UDO Section 5.4., to include the
following (these details are noted in the site data table, but I did not see a Landscape Plan
included with the submittal):
i. Street Yards, both primary and secondary.
ii. Foundation plantings to equal 12% of the face of the building.
iii. Interior parking landscaping, this is required to equal 8% of the parking area.
iv. Screening is required for the dumpsters if applicable, a detail showing materials
and the screening is required, UDO Section 5.4.4.C.2.
v. Please show the correct buffer width per UDO section 5.4.3
vi. Please show locations of a proposed signage.
7. Lighting:
a. Please provide a light plan, approval of the lighting plan is required before site plan
approval (Section 10.3.6, Site Plan) or zoning compliance approval (Section 10.3.8,
Zoning Compliance Approval), whichever comes first. A lighting plan must be provided to
illustrate that street lighting, all exterior lighting, and indoor lighting visible from outside
shall be designed and located so that the maximum illumination measured in foot candles
at ground level at a residential lot line does not surpass 0.5, UDO Section 5.5. Please refer
to Table 5.5.4.B of the UDO for additional standards.
8. Tree Retention:
a. Tree Removal Permit Received and will be processed.
b. Is there any way to retain the trees on the western edge of the site? I’m not sure of the
intended purpose of that side of the building, or the exact distance of the proposed
building to the trees, but we do encourage the retention of as many trees as possible.

1. I have conducted a site visit yesterday, along with a plan review. Everything we require is noted
on the site plans. County Fire approves their part of this review.
NHC Engineering, Galen Jamison 910-798-7072
1. The stormwater permit application has been reviewed and request for additional information
was sent to the designer via email on June 1, 2022. Please resubmit the additional information
for permit issuance.
2. A land disturbing permit issued by the County and is currently under review. Any additional
information necessary will be requested from the engineer.

2. CFPUA Plan Review has been completed. Any changes that affect water and sewer utilities will

2. Please correct Zoning district: CZD B-1
3. Please list the proposed building height.
4. Please include the total number of trips for this use per the ITE trip generator, 11th edition.
5. Please update the plan with the following general corrections:
a. Please include “Site Plan” in the title block.
b. Please show sight triangles on the landscape plan.
c. Please show the location of any signs and note any proposed sign is subject to
Section 5.6. of the UDO.
6. Lighting:
a. Please provide a light plan, approval of the lighting plan is required before site plan
approval (Section 10.3.6, Site Plan) or zoning compliance approval (Section 10.3.8,
Zoning Compliance Approval), whichever comes first. A lighting plan must be
provided to illustrate that street lighting, all exterior lighting, and indoor lighting

b. There appears to be an access easement (DB 6074, PG 278) located on the south
east corner of the parcel. Please clarify the exact bounds and purposed of this
easement. This may require more discussion depending on what the easement’s
location and purpose is.
8. Landscaping:
i. Please illustrate how each of the following have been addressed Screening, Parking
Lot Perimeter Landscaping, Parking Lot Interiors Landscaping, and Street yard
Landscaping (both Primary and secondary must be specified).
A. Screening:
1. If there are any dumpster or trash receptacle storage areas, they must
be screened in accordance with Section 5.4.4. Please provide a
detail.
B. Parking Lot Perimeter Landscaping:
1. Please provided a landscaped strip along any side of a parking lot
abutting land in a Residential zoning district. The perimeter
landscaping strip shall be a minimum of ten feet in width.
C. Parking Lot Interiors:
1. Please provide landscaped areas in the interior of parking lot to
equal to eight percent of the total area to be used for parking.
D. Street yard:
1. Please provide primary and secondary street yard plantings in
accordance with Section 5.4.6.
9. Tree Retention; will any trees proposed to be removed, if so the following will apply:
a. Please apply for a Tree Removal Permit.
b. Please be aware that a Tree Removal Permit is required prior to any land
disturbance activities. Please provide the specific species (Loblolly Pine, Long Leaf
Pine, etc.) of the trees to be removed or retained to determine required mitigation.
c. Clearly illustrate what trees are being preserved and what trees are proposed to
remain.
d. Please see the chart below for an example of what Staff is looking for as a tree
inventory requirement.
e. All specimen trees located within subject tract are required to be illustrated as well.
UDO Section 5.3.5.C The removal of any specimen tree is prohibited on any parcel
unless exempt according to Section 10.3.11, Variance Zoning and Subdivision. If a
specimen tree is removed without a permit, the penalty for this violation shall be twice
the mitigation fee.
f. Please be aware that there are optional incentives for retaining trees on site, UDO
Section 5.3.8.A.2.
g. Please see the chart below indicating the documented, significant, and specimen trees
regulated by the County.

i. Per UDO Section 5.3.4.C, of the UDO requires a minimum of 15 trees at least 2” DBH
must be retained or planted on the parcel where development occurs for each acre
or proportionate area disturbed. Please add a note to the Landscape Plan showing
has this requirement has been met.
a. Please note that required landscaping for the project can be credited to meet
this requirement, however, required landscaping does not count towards
mitigation, if applicable.
h. Per UDO Section 5.3.6.B, please be aware that prior to any construction activity
protection fencing is required around protected trees or tree stands. The fencing shall
be a minimum of four feet and shall remain in place through completion of construction
activities.
i. Tree inventory plans are required to reflect the trees being retained and the trees
being removed clearly. Please see the example below, which illustrate the trees with
the X’s being removed and the trees and the trees being preserved showing the
protection in the correct placement.
j. Please include the tree data within a table as shown below.

10. Please be aware that no building permit will be issued until NCDOT has issued the Driveway
Permit approval.
11. Please label all setbacks clearly for verification of zoning district standards.
12. Please provide documentation showing proof of legal access to the private drives attached.
13. Please reference the CZD case number for the approved shopping center.

1. The stormwater permit has already been obtained. Should changes be made as a result of
the TRC, please submit updated plans and calculations.
2. The land disturbing permit application permit has been reviewed and request for additional
information was sent to the designer via email on May 14, 2022. Please resubmit the
additional information for permit issuance.

1. This site at one time was a Mobile Home Park with individual septic systems. If a septic tank
is encountered during construction then it shall be pumped, crushed and filled.
2. If any wells are encountered during construction then the well shall apply for a well
abandonment permit and have the well properly abandoned by a certified well driller.
