NEW HANOVER COUNTY
POLICY STATEMENT
New Hanover County will consider the extension of utility
services to existing and new industry on a case-by-case basis,
given the availability of funds. The Board of County
Commissioners, in its decision-making process, may consider
the total investment versus tax return, quality of the
industry, environmental acceptableness of industry, number of
employees, public purpose and other factors as appropriate.
Adopted by the New Hanover County Board of Commissioners on
this the 16th day of November, 1992.

RESOLUTION PROPOSING ACCEPTANCE OF THE OFFER TO PURCHASE REAL PROPERTY
LOCATED AT 126 TANGLEWOOD DRIVE
LEGISLATIVE INTENT/PURPOSE:
This resolution relates to the proposed sale of surplus property
owned by New Hanover County, more particularly identified as follows:

RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commission does hereby
propose to accept the offer(s) to purchase identified herein from the
offeror(s) as indicated.
2. That New Hanover County reserves the right to reject any and all
offers.
3. That New Hanover County will retain any deposit posted by the
offeror(s) when:
a. The offer is withdrawn after posting the deposit.
b. The offeror(s) fail to pay the balance of an approved offer, due

ADVERTISEMENT FOR UPSET BID
SALE OF SURPLUS PROPERTY BY NEW HANOVER COUNTY
By resolutions duly adopted by the Board of Commissioners of New Hanover
County, New Hanover County proposes to accept an offer to purchase a certain
parcel of real property located in New Hanover County owned by New Hanover
County. The identification of the offer is as follows:

ADDRESS: 126 Tanglewood Drive
OFFEROR: Gordon A. and Annette Baxley
AMOUNT OF OFFER: $9,000.00
The offer to purchase is subject to the following terms and conditions:
(1) That the offers are unconditional and may not be revoked.
(2) That New Hanover County shall retain as liquidated damages any
deposit posted if any offeror fails to pay the balance due in cash
and secure the deed within 10 days of notice by certified mail or if
returned undelivered within 10 days of the last attempted delivery.
(3) That all sales are subject to final approval by the Board of
Commissioners of New Hanover County.
(4) That the use of the property and construction of any structures
improvements, changes or additions shall at all times comply with all
applicable federal, state or local laws, rules and regulations.
The proposed sale of this property is being conducted pursuant to North
Carolina General Statute 160A-269 and is subject to upset bid. The public will
take notice that within ten days after publications of this advertisement, any
person may raise the bid by not less than 10% of the first $1,000 and 5% of the
remainder. Upset bids may be in writing and must be delivered to the County
Clerk, accompanied by a deposit of 5% of the total increased bid. The deposit
must be by cash, cashier's check, certified check or bid bond. Upon receipt of
an upset bid, the County Clerk shall readvertise the offer at the increased bid
and otherwise follow the statutory procedures until no further qualifying upset
bids are received. When no further qualifying bids are received, the Board of
Commissioners may accept the offer and sell the property to the highest bidder
for cash.
The Board of Commissioners of New Hanover County reserve the right to
reject any and all offers at any time. The proposed sale is made subject to
the above conditions together with all outstanding taxes, liens or other
encumbrances, if any; title shall be conveyed by bargain and sale deed without
warranty; and the property will be sold in its present condition "as is"
without any improvements by the County.
The Board of commissioners of New Hanover County intend to decide whether
it will accept or reject the highest offer within a reasonable time not to
exceed thirty days from the date of the published advertisement. Any and all
deposits shall be forfeited if a bid is accepted by the County and then
withdrawn by the bidder.

WHEREAS, after due advertisement, bids were received and
publicly opened by the Finance Department at 3:00 p.m. on the
15th day of October, 1992, at the County Administration Building,
320 Chestnut street, Wilmington, North Carolina, and the

RESOLUTION OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, New Hanover County has constructed the Myrtle Grove
Branch library and now desires to furnish said library; and
WHEREAS, the County is preparing bid specifications for
furnishings for the library at an estimated cost of Six Thousand
Dollars ($6,000.00); and
WHEREAS, G.S. 143-129 provides that in the case of contracts
for the purchase of apparatus, supplies, materials, or equipment,
the Board of County Commissioners may waive the requirement for a
surety bond or other deposit; and
WHEREAS, the Architect for the library recommends that the
Board waive the surety bond requirement because it is not customary
in the furniture industry for suppliers, to furnish a surety bond
for a transaction of this amount.
NOW THEREFORE, be it resolved that the New Hanover County
Board of Commissioners hereby waive the surety bond requirement for
furnishings at the Myrtle Grove Branc?PLibrary pursuant to G.S.

*Sec. 29. Administrative Leave
During periods when the Manager deems it inadvisable
for employees to report to work, such as inclement weather,
he may authorize administrative leave, which shall not be
charged to sick or personal leave. Administrative leave may
also be granted for partial periods of a work day for
purposes such as voting. As determined by appropriate
management personnel, employees identified as "essential
personnel," may be excluded from this policy.
*Sec. 30. Education Leave
A leave of absence without pay during regular working
hours may be granted to an employee upon recommendation of
the supervising department head, and prior approval from the
County Manager, to permit an employee to take courses of
study which will better equip the employee to perform
aooigned dutieo (benefit the employee and the County). A
maximum of two (2) courses may be taken at a time. The
County may reimburse the employee for tuition, fees and
books for the course, provided the employee submits a
receipt for course expenses and a notice of successful
completion (C average or better) of the course, and provided
that there are sufficient funds in the department's budget.
Sec. 31. Educational Leave Without Pay
Employees may be granted leave without pay to further
their education in a way that it will benefit the employee
and County. Educational leave will not exceed twelve (12)
months at a time. The County may reimburse the employee for

training expenses. Employees on leave without pay must sign
a contractual agreement to work for the agency involved for
twelve (12) months for every nine (9) months of training or
repay any expenses incurred by the County.
Sec. 32. Reimbursement for Education Expenses
Upon successful completion (C average or better) of a
job rolated (an) educational program, with prior approval of
A4& (the) department head and County Manager, the employee
may be reimbursed for tuition, fees and books for the
course, provided the employee submits receipts, for course
expenses, and provided that such course expenses were not
paid otherwise.
*Sec. 33. Death in Immediate Family
Employees may receive up to three (3) days leave per
occurrence in addition to personal and sick leave, upon the
death of a member of the employee's immediate family.
Emergency Medical Services Department ambulance personnel,
may receive up to forty (40) hours per occurrence in
addition to any other available leave. Immediate family will
be deemed to include the father, mother, wife, husband, son,
daughter, brother, sister, grandfather, grandmother, mother-
in-law, father-in-law, son-in-law, daughter-in-law, brother-
in-law, sister-in-law, grandson, granddaughter, half-sister,
half-brother, stepmother, stepfather, stepson, stepdaughter,
stepsister, and stepbrother.
An employee should submit notification of the desire to
take this leave to his/her supervisor prior to taking the
leave. This leave is non-cumulative and an employee will
not be paid for this leave upon termination.

Ammendment to Enabling Legislation
section 1. Authority to Adopt Ordinances. The Board of
Commissioners of New Hanover County may adopt ordinances to
prohibit discrimination in employment and housing based on race,
color, national origin, religion, sex, disabling condition,
familial status, attained the age of 40 or other catagories as may
from time to time be included in federal laws, rules, or
regulations.

AND WHEREAS, funds have been previously appropriated and are
now in or will be available in subsequent year's budget in
Account No. 110-410-4132-1000-5940 to cover this contract;

purchase of the upgrade for the New Hanover County's Computing
System and the sale as trade-in of an IBM 4381 Computer and
