WHEREAS, New Hanover County has long recognized the need to'
support private economic development efJorts; and
WHEREAS, New Hanover County also recognizes that such
projects may necessitate certain pUblic improvements; and
WHEREAS, .funding resources for public improvements are often
available at the time of the development of such -projects; and
WHEREAS, legislation has been introduced in the General
Assembly to permit a new type of local government borrowing for
certain economiq development proj'ects;
NOW, THEREFQRE BE IT RESOLVED, that the-New Hanover Count
,Board of COIlUJlissionersdoes hereby endorse the legislation known
as Development Finance Bonds, SB 452 and SB 440, and ur:ges the

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE ZONING MAP OF ZONING AREA CASTLE HEYNE
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED JULY 1, 1985
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area No. Castle hayne
lS hereby amended by removing the hereinafter described tract
from the R-15 Residential Zoning District Classification and
placing it in the 0-1 Office and Institution Zoning District
Classification, said land being described as follows:
Beginning at a point in the northern right-of-way of
Holly Shelter Road, formerly known as Maple Street, said
point being at an iron pipe 313 feet west of the centerline
of the A.C.L. Railroad, running thence south 80 degrees 50
minutes west 132 feet to an existing iron pipe; thence north
09 degrees 10 minutes west 165 feet to an existing iron
pipe; thence north 80 degrees 50 minutes east 132 feet to an
existing iron pipe; thence south 09 degrees 10 minutes east.
165 feet to the point and place of beginning.
Section 2.
The County Clerk lS hereby authorized and
directed under the supervision of the County Commissioners to
change the Zoning Map of Zoning Area Castle Hayne on file in the
office of the County Commissioners, so as to make it comply with
this ordinance.
Section 3.
Any ordinance or any part of any ordinance in
conflict with this ordinance, to the extent of such conflict, lS
hereby repealed.
Section 4.
This ordinance is adopted in the interest of
public health, safety, morals and general welfare of the
inhabitants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

Outpost guarding the Cape Fear River, and

erosion and preserve this historic site for future generations to

WHEREAS, it is estimated that $3.2 million is needed from
State funds for construction of this project;

Board of Commissioners supports the construction of a seawall for
the preservation of Ft. Fisher as a significant historic site and
respectfully requests the Governor to include the $3.2 million in
the State's Capital Budget.

JOINT RESOLUTION
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
WILMINGTON CITY COUNCIL
WHEREAS, the management of solid waste from generation to
collection to recycling to ultimate disposal is of great concern
to New Hanover County and the City of Wilmington not only because
of more stringent regulations and rising costs, but also because
of increasing environmental awareness; and
WHEREAS, the city and the county recognize that each has
developed expertise and gained experience in specific areas, such
as the city's SMART recycling program and the county's waste-to-
energy conversion and landfill facility; and
WHEREAS, cost savings and increased environmental protection
can be gained through the efficiency and economies on scale of
joint, coordinated efforts;
NOW, THEREFORE BE IT RESOLVED, by the New Hanover County
Board of Commissioners and the Wilmington City Council, that the
city and county jointly develop a Comprehensive Solid Waste
Management Plan with the objective of establishing a program to
control the flow of solid waste with minimum environmental impact
and at a reasonable cost.

Dear Mr. Retchin:
.. As required by General Statute 136-44.5, before Ju.ly 1 each
,~calendar.year, the Department of Transportation shall make a study of
all state maintained unpaved roads in order to determine the unpaved
mileage in each county and the total in the state. ,
These mileages are required to determine the secondary construc-
tion allocations to each of the counties. The allocation for the
secondary construction funds are determined by dividing the total
number of miles in the state times the statewide allocation as
approved by the legislature.

Secondary road construction allocations are 'based upon the
amount of revenue, generated by the gasoline tax and the final total
w~ll not be known until the end of the current fiscal year, ending
,,::June 30, 1991. Should there be a significant change in the county
":allocation. we will inform you of any adjustment in the county
i~provement program for 1991-1992.

Based on an unpaved mileage of approximately 13 miles in New
Hanover County. compared to unpaved miles statewide, the secondary
allocation is estimated at $88.461.00. which is expected to be
approved at the July Board Meeting.

SUBJECT: Increase in Environmental Health Fees
On April 3, 1991, the New Hanover County Board of Health approved ~ ~
an increase in fees in the Environmental Health Program. These
fees need to go to the County Commissioners for approval.
The Environmental Health Committee, Chaired by Bobby Greer,
County Commissioner, made these recommendations to the Board of
Health for their approval.
The State of North Carolina has mandated that all counties
develop a management entity to supervise alternative sewage
systems. This management entity will assure the proper
maintenance of all alternative sewage systems. Presently the
mandate for a management entity is to take effect on July 1,
1991. If this requirement does go into effect on that date, then
the New Hanover County Health Department must establish two new
positions and design a program to assist in the development and
operation of the management entity. We have included those
positions in our 1991-92 proposed budget request. The revenues
from these increased fees will more than cover the costs of the
new positions and program.
There has been some indication from the state that the management
entity may not be mandated until July 1, 1992. If that is the
case, we will not need staff until that time. However, the
Environmental Health Conunittee and Board of Health propose the
new fees take affect July 1, 1991 so that the county can realize
the benefits of the increased revenues in FY91-92.

Our proposed revenues in the FY91-92 Budget for Environmental
Health as 'submitted were $76,000. With the' new' fees I request
the revenue figure be changed to $140,000 which is an increase of
$ 6 4 , 000 in Env ironmen tal Health revenues. I f the Managemen t
Entity does take effect July 1, 1991, then we will begin charging
for the alternative systems permit which will add on even
addi tional revenues. But for purposes of the budget and for
adoption of this fee schedule, please project Environmental
Health revenues up from $76,000 to $140,000. '
An important point both the Board of Health and I want to make is
that these additional revenues will pay the total cost for' the
requirements, including staff, of the management entity. If
staff are not needed until July 1, 1992, we want everyone to know
that the revenues being generated in FY91-92 budget are designed
to help pay for the costs of that new service. The increase in
revenues exceeds the costs for the management entity and the
county will receive more revenues as a result of this fee
increase. But, once again, I reiterate that these revenues are
designed to cover the cost of the management entity, .be it
implemented July 1, 1991 or July 1, 1992.

WHEREAS, Governor James Martin has issued Executive
Order No. 134 granting Special Readjustment leave to employees of
the State of North Carolina who served with the Nation's Armed
Forces during the Persian Gulf conflict; and
WHEREAS, New Hanover County is proud of its employees
who interrupted their employment with New Hanover County and took
military leave to perform their military duties;
NOW, THEREFORE, BE IT RESOLVED by the New Hanover
County Board of Commissioners in grateful recognition of all that
these employees have done for their country in the Armed Forces
of the United States during the Persian Gulf conflict that:
Section 1. Upon resuming their employment with New Hanover
County, all New Hanover County employees on military leave from
their regular County employment on account of extended active
duty with the armed forces of the United States during the
Persian Gulf conflict shall be given 80 hours (10 days) special
readjustment leave.
Section 2.
This special readjustment leave shall be in
addition to the regular leave earned by such County employees.

Any such leave that is not used:within twelve months after the
recipient has returned to work c r prior to his separation from
County employment, shall be lost.

Section 3. For the purpose of the Resolution:
(a) "Persian Gulf Conflict" shall refer to that time
beginning August 2, 1990 and ending when all County
employees have returned from active military duty.
(b) "County employees" shall refer to all persons
employed by New Hanover County in a regularly budgeted
position.
Section 4. This special readjustment leave shall be
administered by the Department of Human Resources.
Section 5. This resolution shall be effective immediately.

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE ZONING MAP OF ZONING AREA NO. 2
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED DECEMBER 15, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1.
The Zoning Map of Zoning Area No. 2 is hereby
amended by removing the hereinafter described tract from the R-15
Zoning District Classification and placing it in the 0-1 Office
and Institution Zoning District Classification, said land being
described as follows:
All of lots 25, 26, 27, and 28 and part of Lot 29. of
Soundcrest Subdivision. These lots measure 232.75 feet
(along the right-of-way of Stokley Avenue) by 125.01 feet.
These lots are recorded in Map Book 5, Page 44 of the New
Hanover County Registry.

The County Clerk is hereby authorized and
directed under the supervision of the County Commissioners to

of the County Commissioners, so as to make it comply with this
ordinance.
Section 3.
Any ordinance or any part of any ordinance in
conflict with this ordinance, to the extent of such conflict, is
'hereby repealed.
Section 4.
This ordinance is adopted in the interest of
public health,
safety, morals and general welfare of the
inhabi tants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

WHEREAS, New Hanover County has long recognized the need to
support private economic development efforts; and
WHEREAS, New Hanover County also recognizes that such
projects may necessitate certain public improvements; and
WHEREAS, funding resources for public improvements are often
available at the time of the development of such projects; and
WHEREAS, legislation has been introduced in the General
Assembly to permit a new type of local government borrowing for
certain economic development projects;
NOW, THEREFORE BE IT RESOLVED, that the New Hanover Count
Board of Commissioners does hereby endorse the legislation known
as Development Finance Bonds, SB 452 and SB 440, and urges the
members of the General Assembly to do the same.
