Special Meeting New Hanover County Board of Elections June 10, 2022 Subject: Approval of Agenda Summary: N/A Board Action Required: Staff recommends approval Item # 1d Special Meeting New Hanover County Board of Elections June 10, 2022 Subject: Public Comment Summary: This is an opportunity for members of the public to provide comment on elections-related matters. There is a 2-minute limit per person and a 10-minute limit total for the public comment portion of the meeting. Board Action Required: Discuss as necessary Item # 2 Item # 2 Special Meeting New Hanover County Board of Elections June 10, 2022 Subject: Hand-to-Eye Recount of the NHC Board of Education (DEM) Applicable Statutes and/or Rules N.C. Gen. Stat § 163-182.7A, 08 NCAC 09 Summary: On Wednesday, June 8, 2022, the New Hanover County Board of Elections conducted a machine recount of the NHC Board of Elections (DEM) contest at the request of Nelson Beaulieu, who was entitled to request a recount since the difference between the votes cast for Mr. Beaulieu and the lowest prevailing candidate, Jenna Bosch, was not more than 1% of the votes cast for those two candidates. In accordance with N.C. Gen. Stat. § 163-182.7A, Mr. Beaulieu is now entitled to request a sample hand-to- eye recount within 24 hours of the completion of the initial recount if the machine recount does not reverse the results. Mr. Beaulieu has submitted a timely request for a sample hand-to-eye recount. A random selection of 3% percent of the precincts casting ballots in the election should be used for the sample hand-to-eye recount. For this calculation, each one-stop site is considered a precinct and, as such, should be included in the sample. The random selection process conducted by Chair Carter on Thursday, June 9, 2022, determined that New Hanover County will conduct a full recount for the NHC Board of Education (DEM) in the following precincts: •M02 – Masonboro Elementary School •OS-CFC – Cape Fear Community College One-Stop Site A bipartisan team of election officials will hand count the votes cast for Nelson Beaulieu and Jenna Bosch in each precinct. The hand-counted results are compared to the recounted results and any variances are documented and reported to the NC State Board of Elections. In the event the results of the sample hand-to-eye recount differ from the machine recount results such that extrapolating the amount of the change to the entire county would reverse the results, the NC State Board of Election would order a full hand-to-eye recount in this contest. To determine whether any change in results would reverse the results, the State Board would consider the number of ballots that were recounted, the amount of change in the results, and the total votes cast for that office. Document/s Included: Rules for Conducting the Sample Hand-to-Eye Recount (Provided at Board Meeting) Board Action Required: Discuss as necessary Item # 3a Item # 3a Special Meeting New Hanover County Board of Elections June 10, 2022 Subject: Member Kemp’s proposal for discretionary full Hand-to-Eye Recount of NHC Board of Education (DEM) Applicable Statutes and/or Rules N.C. Gen. Stat § 163-182.7(a) Summary: Member Kemp has requested that the county board vote to order a Discretionary Recount under N.C. Gen. Stat § 163-182.7(a) of a full hand-to-eye recount of every ballot. In total , there were 31,263 ballots cast in 2022 Primary Election. After the machine recount, the total ballots cast did not change but Jenna Bosch and Nelson Beaulieu each lost two votes. However, the margin of victory for Jenna Bosch remained the same. There were four differences found when comparing canvass results to the machine recount results. •At the OS-CFC site, each candidate lost one vote. •At the OS-CB site, Nelson Beaulieu lost one vote. •At the OS-NLB site, Jenna Bosch lost one vote. Per the NC State Board of Elections, these differences are well within the acceptable range given that we used a DS850 for the recount and the One-Stop ballots were initially scanned using the DS200. The most common cause of these differences is human error in marking the ballot improperly. Document/s Included: N.C. Gen.
