AREA AHEAD OF DITCHING OPERATIONS BY OBSERVATIONS, ELECTRONIC
DEVICES, HAND DIGGING AND BY PERSONAL CONTACT WITH THE UTILITY
COMPANIES. IN ORDER TO LOCATE EXISTING UTILITIES IN ADVANCE OF
TRENCHING OPERATIONS SO AS TO ELIMINATE OR MINIMIZE DAMAGE TO
EXISTING UTILITIES. THE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL COSTS

7.CONTRACTOR SHALL COMPLY WITH THE LATEST REVISIONS AND
INTERPRETATIONS OF THE DEPARTMENT OF LABOR SAFETY AND HEALTH
REGULATIONS FOR CONSTRUCTION PROMULGATED UNDER THE OCCUPATIONAL
SAFETY AND HEALTH ACT. CONTRACTOR SHALL PLAN AND CONSTRUCT WORK
SO AS TO CAUSE MINIMUM INCONVENIENCE TO THE OWNER AND THE PUBLIC.
8.CONTRACTOR SHALL PLAN AND CONSTRUCT WORK SO AS TO CAUSE MINIMUM
INCONVENIENCE TO THE OWNER AND THE PUBLIC. THE CONTRACTOR SHALL
PROVIDE, ERECT AND MAINTAIN AT ALL TIMES DURING THE PROGRESS OR
TEMPORARY SUSPENSION OF WORK, SUITABLE BARRIERS, FENCES, SIGNS OR
OTHER ADEQUATE PROTECTION, INCLUDING FLAG MEN AND WATCHMEN AS
NECESSARY TO INSURE THE SAFETY OF THE PUBLIC AS WELL AS THOSE
ENGAGED IN THE CONSTRUCTION WORK. CONSTRUCTION SIGNING SHALL BE IN
ACCORDANCE WITH THE LATEST EDITION OF "CONSTRUCTION AND
MAINTENANCE OPERATIONS SUPPLEMENT TO THE MANUAL ON UNIFORM
TRAFFIC CONTROL DEVICES" BY THE NCDOT.
9.ALL MATERIAL CLEARED OR DEMOLISHED BY THE CONTRACTOR IN ORDER TO
CONSTRUCT THE WORK SHALL BECOME THE PROPERTY OF THE CONTRACTOR
AND SHALL BE PROPERLY DISPOSED OF OFF-SITE OR BURNED IF PROPER
PERMITS ARE RECEIVED.
10.ALL WORK BY THE CONTRACTOR SHALL BE WARRANTED BY THE CONTRACTOR
FOR A PERIOD OF ONE YEAR AFTER THE OWNER ACCEPTS THE WORK.
11.CONTRACTOR SHALL CALL THE NORTH CAROLINA ONE-CALL CENTER AT 811 FOR
ASSISTANCE IN LOCATING UTILITIES. THE CONTRACTOR SHALL CALL AT LEAST 72
HOURS PRIOR TO ANY DIGGING.
12.ALL PAVEMENT MARKINGS IN PUBLIC RIGHT-OF-WAYS AND FOR DRIVEWAYS ARE
TO BE THERMOPLASTIC AND MEET COUNTY AND/OR NCDOT STANDARDS.
13.ALL SIGNS AND PAVEMENT MARKINGS IN AREAS OPEN TO PUBLIC TRAFFIC ARE TO
MEET MUTCD (MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES) STANDARDS.
14.ALL TRAFFIC CONTROL SIGNS AND MARKINGS OFF THE RIGHT-OF-WAY ARE TO BE

3.UNOBSTRUCTED VISIBILITY SHALL BE MAINTAINED AT ALL DRIVEWAYS AND ROADWAY INTERSECTIONS,
AT ELEVATIONS BETWEEN THREE AND SEVEN FEET OF THE PAVEMENT LEVEL WITHIN THE DRIVEWAY OR
ROADWAY'S SIGHT TRIANGLE, OR ANY REQUIRED BY THE NCDOT.
4.NO CERTIFICATE OF OCCUPANCY FOR ANY CONSTRUCTION OR RENOVATION SHALL BE ISSUED UNTIL
ONE OF THE FOLLOWING CONDISTIONS IS MET:
a.THE REQUIRED LANDSCAPING IS COMPLETED IN ACCORDANCE WITH THE APPROVED PLAN;
b.A BOND OR CERTIFIED CHECK, IN AN AMOUNT SUMBITTED BY THE DEVELOPER AND CERTIFIED BY
THE COUNTY COMMISSIONERS TO BE ACCEPTABLE, IS POSTED AND IS AVAILABLE TO THE COUNTY;
OR
c.AN IRREVOCABLE LETTER OF CREDIT OR DEPOSIT OF FUNDS IN ESCROW, IN AN AMOUNT
SUBMITTED BY THE DEVELOPER AND CERTIFIED BY THE COUNTY COMMISSIONERS TO BE
ACCEPTABLE, IS ISSUED BY A BANK IN A FORM APPROVED BY THE COUNTY ATTORNEY.
5.NO SURETY OR PORTION THEREOF SHALL BE RELEASED UNTIL ALL LANDSCAPING IS INSTALLED,
INSPECTED, AND APPROVED.
6.ALL EXISTING VEGETATION THAT IS USED TO COMPLY WITH THE LANDSCAPING REQUIREMENTS, ALL
REQUIRED PLANTED LIVING MATERIAL, AND ALL REQUIRED BERMS SHALL BE MAINTAINED BY THE
OWNER OF THE PROPERTY ON A CONTINUING BASIS.
7.ANY PLANTED MATERIAL THAT BECOMES DAMAGED OR DISEASED OR DIES SHALL BE REPLACED BY THE
OWNER WITHIN 60 DAYS OF THE OCCURRENCE OF SUCH CONDITION. IF THE PLANNING DIRECTOR
DETERMINES THERE ARE SEASONAL CONDITIONS THAT WILL NOT PERMIT THE TIMELY REPLACEMENT OF
THE VEGETATION (E.G. TOO HOT OR TOO COLD FOR SUCCESSFUL REPLANTING), THE PLANNING
DIRECTOR MAY MODIFY THE REQUIREMENT UNTIL A TIME CERTAIN WHEN THE REPLANTING WOULD BE
