A PUBLIC ROAD: Railroad Road to
STEPHENS CHURCH ROAD
ORDINANCE
It appearing to the Board of County Corrunissioners of New
Hanover County that consideration has been given to the renaming
of Railroad Road (SR 1351), located in Harnett Township, Scotts
Hill corrununity corrunencing approximately 1000 feet northeast of
the Market Street/Futch Creek Road intersection extending 4,350
feet northeast to its termination and being a part of the
abandoned Seaboard Coast Railroad, and it further appearing that
a public hearing was held on Monday, June 3, 1991, at which time
all persons were heard on the question of whether or not the
renaming would be in the public interest, and it further
appearing that notice of said hearing was transmitted to all
resident owners and prominently posted in. at least two (2)
locations along said road, and published in the Star News local
newspaper, and the Board of County Corrunissioners rs--of the
opinion that said public road in New Hanover County should be
renamed and the renaming of same is in the public interest, the
description of which is delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby renamed STEPHENS CHURCH ROAD.
IT IS FURTHER ORDERED that a copy of this ordinance be
recorded in the office of the Register of Deeds of New Hanover
County, North Carolina, and that notice of the action taken by
the Board of County corrunissioners be transmitted to the
postmaster having jurisdiction over the road, the North Carolina
Board of Transportation and to any city within five (5) miles of
said road in accordance with N.C. General Statute 153A-240.

It appearing to the Board of County Corrunissioners of New
Hanover County that consideration has been given to the naming of
a private access easement to FOYS TRAIL, located in Harnett
Township approximately 300 feet southwest of the Market
Street/Creekwood Road intersection extending basically south for
a distance of 550 feet to its termination; and it further
'appearing that a public hearing was held on Monday, June 3, 1991,
at which time all persons were heard on the question of whether
or not the naming would be in the public interest, and it further
appearing that notice of said hearing was transmitted to all
resident owners and prominently posted, in at least two (2)
locations along said road, and published in the Star News local
newspaper, and the Board of County corrunissioners ISOf the
opinion that said road in New Hanover County should be named and
the naming of same is in the public interest, the description"'of
which is delineated on the attached exhibit.

the naming of same is in the public interest, the description of

It appearing to the Board of County Corrunissioners of New
Hanover County that consideration has been given Ito the
assignment of house numbers on STEPHENS CHURCH ROAD, numerical
range 8600-9099; McINTIRE TRAIL, numerical range 100-199; and
FOYS TRAIL, numerical range 100-199.
WHEREAS, ready and accurate identification of developed
property is important for the delivery of general County
services, for the operation of corrunercial enterprises, for the
response of emergency and public safety vehicles, and for the
convenience of the general public; and
WHEREAS, a comprehensive and systematic property numbering
system is an efficient means of identifying property within the
County; and

WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE, it further appearing that a public hearing was
held on the 3rd day of June, 1991, at which time all persons were
heard on the question of whether or not assigning house numbers
would be in the public interest, and it further appearing that
notice of said hearing was prominently posted in at least two (2)
locations along said street, that notice of the time, place and
subject matter of the hearing was prominently posted at the
County Courthouse, and published in a newspaper of general
circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above
House Number Assignment be made.
It is further ordered that a copy of this ordinance be
transmitted to the postmaster having jurisdiction over the road,
to the Board of Transportation, Sheriff's 911 dispatcher and to
any city within five miles of said road in accordance with N.C.

involves the construction andlor acquisition of capital

14th day of February, 1991, at the County Administration
BUilding, 320 Chestnut Street, Wilmington, North Carolina, and
the following bids were received for a Computer system for the
Health Department, Bid # 91-0039:

REAL PROPERTY
WHEREAS, the offer to purchase the indicated parcel of real property
owned by New Hanover County and the City of Wilmington has been advertised
for upset bid in compliance with North Carolina General Statute 160A-269 and
pursuant to resolutions adopted by the City council of the City of
Wilmington and the Board of Commissioners of New Hanover County; and
WHEREAS, there have been no further qualifying upset bids entered for
the property described on the attached list within the statutory period
allowed by North Carolina General Statute 160A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay
the amount indicated on the attached list for the indicated parcels of real
property shown thereon; and
WHEREAS, the property is declared by the County Commissioners to be
surplus and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of
this property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners do

WHEREAS, a petition has been filed pursuant to N.C.G.S.
~153A-241, requesting the Board of Commissioners of New Hanover
County to close the following described public road:
Beginning at a point in the eastern line of Castle
Hayne Road (also known as U.S. Highway #117 and
formerly known as N. C. State Highway No. 40), said
beginning point being the northwest corner of Lot 9,
Block 1, Hanover Gardens Subdivision, as the same is
shown on a map recorded in Book 173, at page 514 of the
New Hanover County, North Carolina Registry; running
thence from said beginning point along the eastern line
of Castle Hayne Road north 30 degrees 33 minutes east
50 feet to the southwest corner of Lot 1, Block 2,
Hanover Gardens Subdivision; running thence south 59
degrees 27 minutes east 225.0 feet along the southern
line of said Lot 1, Block 2, Hanover Gardens
Subdivision to its southeast corner; running thence
south 30 degrees 33 minutes west 50 feet to the
northeast corner of Lot 9, Block 1, Hanover Gardens
Subdivision; running thence along the northern line of

WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above de-
scribed road, the location of which has been indicated in red on the attached
map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the oplnlon that the
above described road should be added to the Secondary Road System, if the
road meets minimum standards and criteria established by the Division of
Highways of the Department of Transportation for the addition of roads to
the System.
NOW, THEREFORE, be it resolved by the Board of County Commissioners of

WHEREAS, Hewlett's Creek is an extremely valuable natural
area in New Hanover County that should be protected; and
WHEREAS, water quality in Hewlett's Creek is currently being
degraded by land use activities in its watershed; and
WHEREAS, current local, state and federal environmental
safeguards may be inadequate to maintain water quality in
Hewlett's Creek and to protect its still open shell fishing beds
from increased contamination;
NOW THEREFORE BE IT RESOLVED THAT, the New Hanover County
Planning Department is directed to conduct a Hewlett's Creek
Watershed Land Use study to assure the protection and restoration
of water quality in Hewlett's Creek. The study will make
recommendations concerning the County's Land Use Plan and
Policies and the existing regulations concerning land
development. The study will be similar to previously upheld
neighborhood plans for the County, but will primarily focus on
water quality in Hewlett's Creek and its watershed.
