Section 2: Explanation
I BA 23-007 accepts the donation of approximately 2.584 acres of land,located at 905 North 10th Street,from the City of
Wilmington,for the construction of a new grocery store. This site is located within a USDA designated food desert and
would be used to develop a small-scale,full-service,affordable grocery store in the Northside Community. This would
offer Northside residents a convenient and accessible location to access fresh,healthy food. Wilmington City Council
adopted a resolution on July 19,2022,to donate the property to the county.

t This ordinance shall be effective upon its adoption.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of New Hanover County,North
Carolina,that the Ordinance for Budget Amendment(s)23-007 amending the annual budget ordinance for the fiscal year
ending June 30,2023,is adopted.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION TO ACCEPT THE DONATION AND CONVEYANCE OF REAL PROPERTY TO NEW HANOVER
COUNTY FROM THE CITY OF WILMINGTON
WHEREAS, New Hanover County has authority pursuant to N. C. General Statute (NCGS) 153A-158 to
acquire real property; and
WHEREAS, New Hanover County, in collaboration with the Northside Food Cooperative, plans to design
and build a grocery store in the Northside,which has been designated as a food desert for over 35 years;
and
WHEREAS, after the county completed a review of the property owned by the City of Wilmington (city),
it was found to meet the overall needs of the store in terms of location, size, and accessibility and the
county made a formal request to the city for the donation of land to construct a grocery store; and
(
WHEREAS, the city adopted a resolution on July 19, 2022, to convey the property located at 905 North
10th Street(approximately 2.584 acres)to New Hanover County without consideration pursuant to NCGS
160A-274; and
WHEREAS, both the county and the city desire to work together to achieve the donation of the property
for the public purpose.
NOW, THEREFORE, BE IT RESOLVED, by the New Hanover County Board of Commissioners that the
property identified as approximately 2.584 acres, located at 905 North 10th Street, shall be accepted by
New Hanover County from the City of Wilmington. The County Manager and County Attorney are
authorized to draft,execute,and record any documents necessary for the acceptance of the real property
donation for the purpose of providing a grocery store in the food desert.

RESOLUTION HONORING THE LIFE AND LEGACY OF TONY RIVENBARK
WHEREAS, Tony Rivenbark served as Executive and Artistic Director of the Thalian Hall Center for the
Performing Arts for more than 42 years; and
WHEREAS, Mr. Rivenbark was a renowned local historian, actor, author, fundraiser, producer, and
influential presence in the cultural life of New Hanover County and the Cape Fear Region for decades;and
WHEREAS,Mr.Rivenbark's tenure fundamentally transformed Thalian Hall into a vibrant civic and cultural
center and led significant restorations and expansions that included modernizing the facility and adding
new wings,ADA accessibility, and a hydraulic orchestra pit; and
WHEREAS,as an actor, Mr. Rivenbark performed in more than 200 stage productions; and
WHEREAS, Mr. Rivenbark is the author of several works, including"Images of America:Thalian Hall"; and
WHEREAS, Mr. Rivenbark was awarded Wilmington's Lifetime Achievement for the Arts in 2004,was the
recipient of Most Enduring Contribution to Wilmington Theatre Award at the 2014 Wilmington Theatre
Awards,received the 2019 StarNews Lifetime Achievement Award,and was recently awarded the Thomas
and Elizabeth Wright Award for Lifetime Achievement from the Historic Wilmington Foundation.
NOW,THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners honors the
life and legacy of Tony Rivenbark.

WHEREAS, vaccine-preventable diseases still exist and outbreaks do occur; and

WHEREAS, vaccines reduce the risk of infection by working with the body's natural defenses to help
them safely develop immunity to disease; and
WHEREAS,vaccines are safe, effective and save lives; and

WHEREAS, Immunization Awareness Month is an opportunity to raise awareness, advocate for
resources, and promote access to education about immunizations for vaccine-preventable diseases.

i NOW,THEREFORE,BE IT PROCLAIMED by the New Hanover County Board of Commissioners that August
2022 will be recognized as "National Immunization Awareness Month" in New Hanover County. Citizens
are encouraged to increase their awareness of the importance of immunizations for vaccine-preventable
diseases in the hope of achieving optimal health for both today and tomorrow. The board commends
this observance to all citizens and urges that all citizens and community organizations join in this
1 observance.

In the Matter of Closing ORDER
An Unnamed Road
It appearing to the Board of County Commissioners of New Hanover County that a Resolution of Intent to
close an unnamed road located between 2805 and 2809 Blue Clay Road was adopted by the County
Commissioners on the 11th of July 2022, and it further appearing that said resolution called for a hearing
to be held on the 15t day of August 2022,at which time the County Commissioners would hear complaints
and comments of interested persons, and it further appearing that notice of said hearing was published
in the **Wilmington Star News Newspaper in accordance with N.C.G.S. 153A-241, and after conducting
such hearing the County Commissioners are of the opinion that the unnamed road in the County of New
Hanover should eb closed and are satisfied that the closing of same is not contrary to the public interest,
and that no individual owning property in the vicinity of the roads will be deprived of reasonable means
of ingress and egress to their property by such closing,the legal description of said road being as follows:
A parcel of land lying in Cape Fear Township, New Hanover County, North Carolina, being all that property
shown on a Map in Deed Book 571 at Page 24-1/2 of the New Hanover County Registry as"Street"and lying
northeast of lot#14 of the Bide-A-Wee subdivision, as shown on that same map.This parcel being more
particularly described in accordance with the results of a boundary survey sealed May 28, 2021 by GS&E,
Inc.(Mr.Comer Lyons,PLS)and recorded in Map Book 69 at Page 324 of the New Hanover County Registry,
as follows:
Commencing from a Mag-Nail set in asphalt at the intersection of the northern right-of-way of N. Kerr
Avenue and the western right-of-way of Blue Clay Road, as shown on Map Book 69, Page 324 of the New
Hanover County Registry, and running thence along the western right-of-way of said Blue Clay Road the
following three courses and distances:
1. N 39°39' 57" E 85.82-feet to an NCDOT Survey Disc;
2. N 26° 37'42" E 3.09-feet to a 5/8" rebar;
3. N 26° 37'42" E 100.25-feet to the Point of Beginning, a 5/8" rebar in the western right-of-way of
Blue Clay Road.
}
Running thence from said Point of Beginning,the previously noted 5/8" rebar in the western right-of-way
of Blue Clay Road,along the lines of said Street's boundary the following four courses and distances:
1. N 26°37'42" E 60.00-feet to a 5/8" rebar;
2. N 63°20' 53" W 199.39-feet to a 1" Pinched Top Pipe;
3. S 26°35'41" W 59.64-feet to a 1" Open Top Pipe;
4. S 63° 14' 39" E 199.36-feet to the Point of Beginning, the previously noted 5/8" rebar in the
western right-of-way of Blue Clay Road.
Said Street containing approximately 11,927 square feet in area and comprising that entire parcel of land
so noted as"Street".
NOW,THEREFORE, IT IS ORDERED AND DECREED that the above described road be and the same is hereby
closed. It is further ORDERED that a copy of this order be filed in the Office of the Register of Deeds of
New Hanover County, North Carolina.

ASSESSMENT RESOLUTION
BEDROCK COURT AND STONEYBROOK ROAD
WHEREAS,the owners of property on Bedrock Court and Stoneybrook Road have petitioned the Board of
Commissioners of the County of New Hanover to undertake a project to improve Bedrock Court and a
portion of Stoneybrook Road,a residential street,and to bring it up to the standards of the North Carolina
Department of Transportation(NCDOT)so that it may become a part of the state maintained system;and
WHEREAS, as provided in North Carolina General Statue (NCGS) 153A-205(b) a county may finance the
local share of the improvements made under the supervision of Department of Transportation to bring
the street up to the standards of Department of Transportation; and
WHEREAS,the NCDOT has approved the improvement to Bedrock Court and Stoneybrook Road and has
agreed to take over the street once the improvements have been completed.
NOW,THEREFORE,BE IT RESOLVED, by the New Hanover County Board of Commissioners that:
1. New Hanover County intends to undertake a project to improve and repair Bedrock Court and
Stoneybrook Road, this section of Bedrock Court and Stoneybrook Road is located from Anchors
Bend Way to Hervey Lane, as more specifically set forth in Attachment A.
2. One hundred percent (100%) of the cost of the project shall be assessed against the benefited
property owners.
3. The basis for making the assessment against the benefited properties will be the number of
parcels with road frontage and addresses on Bedrock Court and Stoneybrook Road at an equal
rate per parcel, as allowed by NCGS 153A-186(a).
4. The assessment herein provided for shall be payable in cash, or if any property owner shall so
elect, they shall have the option of paying the assessment in five (5) equal annual installments,
said installments to bear interest at a rate of(5.50%)which approximates all the costs, including
opportunity costs,to administer the installment loans not to exceed the limits imposed by NCGS
153A-200(a).
