Cell, secretaria de la Junta i 4 1 1 i 1 i 1 1 a i v Exhibit, LP Book Page NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION DETAILING NEW HANOVER COUNTY SUGGESTED LEGISLATIVE PRIORITIES FOR THE NORTH CAROLINA ASSOCIATION OF COUNTY COMMISSIONERS WHEREAS, New Hanover County is a member of the North Carolina Association of County Commissioners (NCACC); and WHEREAS,the NCACC asks member counties to submit legislative priorities for the statewide organization to adopt as strategic and advocacy goals; and WHEREAS, the New Hanover County Board of Commissioners has identified several goals worthy of inclusion among the NCACC list of legislative priorities; and WHEREAS,the Board supports NCACC advocacy for recurring funding solutions to support transportation infrastructure beyond the gasoline tax; and WHEREAS,the Board supports NCACC advocacy to support legislation to hold chemical manufacturers of emerging contaminants that include perfluorooctanoic acid (PFOA), perfluorooctanesulfonic acid (PFOS), and other per-and polyfluoroalkyl substances(PFAS)who then pollute drinking water sources financially responsible for cleanup and mitigation efforts; and WHEREAS, the Board supports NCACC advocacy to identify a recurring source of funding for the state's Coastal Storm Damage Mitigation Fund, recognizing that residents throughout the state's 100 counties own property along the coast of North Carolina; and WHEREAS, the Board supports NCACC advocacy for increased state funding to fully support drug treatment courts and other specialty courts, recognizing that treatment courts are an extension of the judicial system and the state has the primary duty to fund the court system. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby affirms the I following: 4 4 • That New Hanover County, the Applicant, will arrange financing for all remaining costs of the projects, if approved for a state loan and/or grant award. I • That the Applicant will provide for efficient operation and maintenance of the projects on completion of I construction thereof. I • That the Applicant will adopt and place into effect on or before completion of the projects a schedule of fees and charges and other available funds which will provide adequate funds for proper operation, maintenance, 1 and administration of the system and the repayment of all principal and interest on the debt. I • That the governing body of the Applicant agrees to include in the loan agreement a provision authorizing the State Treasurer, upon failure of the New Hanover County to make a scheduled repayment of the loan, to I withhold from New Hanover County any state funds that would otherwise be distributed to the local government unit in an amount sufficient to pay all sums then due and payable to the state as a repayment of 4 the loan. 1 • That Tim Burgess, Deputy County Manager, the Authorized Official, and successors so titled, is hereby authorized to execute and file an application on behalf of the Applicant with the State of North Carolina for a loan and/or grant to aid in the study of or construction of the projects described above. • That the Authorized Official, and successors so titled, is hereby authorized and directed to furnish such information as the appropriate state agency may request in connection with such applications or projects: to I make the assurances as contained above; and to execute such other documents as may be required in 4 connection with the application. Oc2401(44 �`�-- K erleigh G.C ell, Clerk to the Board 5 I I k `2 i i Exhib' LW Page 33,6 NEW HANOVER COUNTY BOARD OF COMMISSIONERS fi RESOLUTION AUTHORIZING THE APPLICATION FOR SURFACE TRANSPORTATION BLOCK GRANT PROGRAM-DIRECT ATTRIBUTABLE FUNDS WHEREAS, the Wilmington Urban Metropolitan Planning Organization (WMPO) will be awarding approximately $5,088,395 in funding through their Surface Transportation Block Grant Program-Direct Attributable(STBGP-DA)competitive grant process which requires a local cash match of 20%; and WHEREAS,the New Hanover Planning and Land Use Department,in coordination with Parks and Gardens, wishes to apply for funding through the Federal Surface Transportation Block Grant Program-Direct Attributable (STBGP-DA)fund for construction of a 10-foot multi-use path (MUP) on the east bound side of U.S.421/Carolina Beach Road as part of the Monkey Junction Pedestrian Improvement Project; and WHEREAS, these improvements together with lighting and pedestrian signals, will augment the ease of pedestrian movement and address safety concerns for citizens at one of the most heavily traversed intersections on U.S. Hwy.421; and WHEREAS, the maximum federal funding which is allocated to NCDOT for this project can only fund a sidewalk on the eastern side of U.S. 421,which is not in alignment with long-term bicycle and pedestrian plans for this area,the county, NCDOT and the Wilmington Metropolitan Planning Organization (WMPO) are in agreement that the upgrade to a 10-foot MUP on the east side of the roadway is the preferred functional, design option at the location; and WHEREAS, the multi-use path would provide connection to the high-visibility crosswalks at the intersection of U.S.421 with Antoinette Drive and the northernmost access at Walmart. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby authorizes the Planning and Land Use Department to apply for the STBGP-DA fund in the amount of $461,949,with New Hanover County providing the required local cash match of$115,488.00.
