THIS AGREEMENT is made and entered into on the last date executed below, by and between the
North Carolina Department of Transportation, an agency of the State of North Carolina, hereinafter
referred to as the “Department”, and the New Hanover County, hereinafter referred to as the
“County.”
W I T N E S S E T H:
WHEREAS, the Department and the County on 7/3/2019, entered into a certain Project Agreement
for the original scope: design for the construction of multi-use path along Middle Sound Loop Road,
Lendire Road to the Ogden Business Lane in New Hanover County, programmed under Project EB-
6027; and,
WHEREAS, the Department and the County on 12/16/2020, reduced the scope of the Project to
include only the design of a multi-use trail on the south side of Market Street from Red Cedar Road to
the existing trail at the corner of Market St and Middle Sound Loop Road; and,
WHEREAS, the Department and the County have entered into a separate agreement for the
construction of this phase of work under Project BL-0040; and,
WHEREAS, the County has requested additional time to complete pre-construction requirements;

NOW THEREFORE, the parties wish to supplement the aforementioned Agreement whereby the
following provisions are amended:
4.PERIOD OF PERFORMANCE
The County has until September 30, 2023, to complete all work outlined in the Agreement.
Completion for this Agreement is defined as completion of all pre-construction activities,
acceptance of the project, and submission of a final reimbursement package to the Department.
If additional time is needed to complete the Project, then a supplemental agreement must be
executed. The Department and/or FHWA reserves the right to revoke the funds awarded if the
County is unable to meet milestone dates included herein.
Except as hereinabove provided, the Agreements heretofore executed by the Department and the
County on 7/3/2019 and 12/16/2020 are ratified and affirmed as therein provided.

IN WITNESS WHEREOF, this Agreement has been executed, in duplicate, the day and year
heretofore set out, on the part of the Department and the County by authority duly given.
