Applicability
• Language regarding the applicability of the County’s conservation resources standards was revised
in 2019 with the development of the Unified Development Ordinance document. The intent of the
amendment was to reorganize provisions and not to change the regulations that apply to properties.
Recent questions, however, have indicated that the revised applicability language is less clear than
the previous text.
• Staff is working with Legal staff to update the current language so that it clarifies the current intent
and the longstanding interpretation and application of these requirements. Conservation resource
standards were intended to apply to all development that took place after the effective date of the
provisions, December 1, 1984, with the exception of specific uses on pre-existing lots of record.
• The draft language for this amendment and full staff report will be posted to this page once
complete, no later than the publishing date of the full Planning Board agenda packet of March 24,
2023.
• Because this item is a clarification of existing and longstanding standards, a concept presentation
and public comment period were not held for the proposed amendment.
