Dear Ms. Doss:
Pennoni; on behalf of Driven Brands, hereby resubmits a Site Plan for review. The subject development is
located on Parcel Number R03600-005-042-000. Please find attached the following:
• Digital copy of the Plans, last revised 04/19/23, sheets 1-23 of 23;
• Digital copy of the Stormwater Management Calculation Packet, last revised 06/23/23;
• Digital copy of the Application for Permit For a Land Disturbing Activity;
• Digital copy of the Tree Removal Permit Application;
• Digital copy of the NCDOT Driveway Permit Application requiring County signature;
• Digital copy of the CFPUA Commercial Plan Review and/or Utility Extension Review with Listing of
CFPUA Fees (application with plans will also be uploaded to the CFPUA submittal portal);
• Digital copy of the NCDOT Three Party Encroachment Agreement for CFPUA signature prior to NCDOT
portal upload (agreement with plans will also be uploaded to the CFPUA submittal portal);
• Digital copy of the Application Storm Water System Authority to Construct.
The above noted items have been revised in accordance with the review comment letter from the County of
New Hanover TRC, dated 04/20/2023. We offer the following responses to each comment:
PLANNING, AMY DOSS, SHOD OVERLAY COMMENTS (05/02/2023)
Comment 1: Please label the 75’ reduced setback as SHOD setback.
Response: 75’ SHOD setback has been labeled on CS1001
Comment 2: Cover sheet notes the floor to area ratio required by the SHOD has been met.

Comment 3: Please list the total ground area covered by principal buildings and all accessory buildings, please
be aware that the coverage shall not exceed 50% of the site. Please add this data into the site data table as
well.
Response: Acknowledged. Revised site data table to list primary building area on sheet CS0001.
Comment 4: Please show additional SHOD landscaping standards are being met (UDO 3.5.3.D.1.c) in the
landscape calculations on page CS2001.
Response: We have added four (4) trees to front yard area per Section 3.5.3.D.1.c SHOD Overlay District, we
have provided additional plantings along right-of-way of Market Street as shown on the Landscape Plan and
detailed in the tabulations.
Comment 5: Please show the location of any other signs besides the stop sign and note the following SHOD
standards apply (UDO 3.5.3.D.6):
Response: Following note has been added to sheet CS1001, “All signage on site shall comply with UDO section
3.5.3.D.6.”. All sign locations are noted on sheet CS1001.
PLANNING, AMY DOSS
Comment 1: Zoning – B-1, Neighborhood Business
Use: The defined use is CAR WASH: A facility for washing or steam cleaning passenger automobiles (including
self-service operations), operating either as a separate facility or when installed and operating in conjunction
with another use, and which installation includes equipment customarily associated with a car wash and which
is installed solely for the purposed of washing and cleaning automobiles.
Response: Acknowledged.
Comment 2: General comments
A. Please refer to Section 3.4.3.D of the UDO for B-1 dimensional standards, specifically the side interior
setbacks and the building height. When adjacent to commercial districts the side and rear setbacks
are 0’ and the height is 2 stories or 40’.
B. Please show sight triangles at points of ingress and egress
Response: DISREGARD, SEE SHOD OVERLAY COMMENTS
Comment 3: Tree Retention: Tree Removal Permit has been received and will be processed.
A. Staff has received the tree removal plan and associated tables with calculations. Please submit a Tree
Removal Permit application to accompany the tree removal plan.
B. Please be aware that a Tree Removal Permit is required prior to any land disturbance activities. Please
provide the specific species (Loblolly Pine, Long Leaf Pine, etc.) of the trees to be removed or retained
to determine required mitigation
Response: A completed Tree Removal Permit application has been included with this submission.

A. Please note that with the latest update to the UDO, a lighting plan is not required at time of TRC
Approval. Thank you for your submittal of a lighting plan, please include site
Response: Acknowledged. A revised lighting plan will be provided for review prior to site plan approval.
Comment 5: The landscape plan appears to sufficiently address County requirements. Please include the
square footage of the foundation plantings provided.
Response: We have updated the tabulations showing four (4) areas of foundation plantings and labeled them
on the Landscaping Plan sheet #CS2001.
Comment 6: Please note that all signs are subject to section 5.6 of the UDO. Please submit for sign permits
prior to installation.
Response: Acknowledged. See note added to sheet CS1001. All signage on site will follow the appropriate
signage requirements. Sign permit applications will be submitted and permits received prior to installation.
Comment 7: Please note that required parking per UDO Table 5.1.2.A is 3 spaces for every one car the car
wash can accommodate at one time.
Response: The required vehicular parking portion of the site data table has been updated on sheet CS0001.
ENVIRONMENTAL HEALTH OSWP (WELL)- DUSTIN FENSKE
Comment 1: Site is on a well. This well must be properly abandoned by a certified well driller prior to
demolition. Public water must be obtained for this site.
Response: Acknowledged. See note added to sheet CS0501.
ENVIRONMENTAL HEALTH OSWP (SEPTIC)- DUSTIN FENSKE
Comment 1: Site is on sewer and does not impede on any other septic systems for surrounding properties.
Response: Acknowledged.
ENGINEERING STORMWATER REVIEW- GALEN JAMISON
Comment 1: A land disturbing revision to existing permit GP 12-98 and a stormwater permit issued by the
County are required for this project. Please submit for permits as the design is completed. Stormwater
permitting will be limited to conveyance permitting only. Pre and post development storm attenuation will
not be required.
Response: Acknowledged. A permit modification submission is being made to the state to modify the existing
permit. We have included the Authorization to Construct application with this resubmittal.
Comment 2: It appears the project lies within an existing State stormwater, SW8 980236. Please check with
the State DEQ office for permit modifications requirements.
Response: Acknowledged. We are submitting for a Minor Modification since we are not increasing the net BUA
and we do not change the size or design of the SCM.
FIRE SERVICES REVIEW – DAVID STONE
Comment 1: All new structures must comply with Appendix J of the NC Fire Code, Building Information Signs.
An example can be provided upon request.
Response: Acknowledged.

Comment 2: If there is no fire hydrant within 400 feet of the structure a fire hydrant will need to be added.
Sprinklered building shall have a fire hydrant located within 100 feet of the FDC.
Response: There is an existing fire hydrant to remain at the entrance off Market St. The hydrant is located
within 275’ of all points of the structure and depicted on sheet CS9801 in “Fire Apparatus Access Route” detail.
Comment 3: Fire Hydrants
a. All fire hydrants shall have a 5 ¼ inch barrel, a 5 ¼ inch valve opening, two 2 ½ inch NST side
discharges and a 5 inch pumper nozzle with a 5 inch STORZ connection. Further information
on the technical specifications is available from the fire code official or Cape Fear Public Utility
Authority.
Response: No additional fire hydrants are proposed. There is adequate coverage from existing
hydrant along Market St.
b. All fire hydrants shall be installed so they are visible from the fire apparatus access road with
unobstructed access and a clear space no less than 36 inches in all directions. They shall be
protected from vehicle impact by curbing, guard posts or other means approved by the fire
code official. They shall be oriented with the large discharge facing the nearest street. All
discharges shall meet the NFPA requirements for distance above grade.
Response: No additional fire hydrants are proposed. There is adequate coverage from existing
hydrant along Market St. The required clear space around hydrant will be maintained.
c. Additional fire hydrants may be required by the fire code official based on the type of hazard
or use of the protected structure. (Appendix C).
Response: Acknowledged. However, no additional fire hydrants are anticipated given the
proposed use.
d. Fire Department connections shall utilize 5 inch Storz connections with a 30 degree down
angle. Remote FDC’s are discouraged.
Response: Acknowledged. However, no sprinkler system or standpipe is proposed for the
structure and therefore the building does not have a FDC.
e. A fire hydrant shall be located no greater than 100 feet from the fire department connection.
For buildings with multiple fire department connections, each one shall have a dedicated fire
hydrant.
Response: N/A. No sprinkler system or standpipe is proposed for the structure and therefore
the building does not have a FDC.
f. The fire department connection shall be located that the fire apparatus and the hoses
connecting it to the fire hydrant and to the fire department connection do not obstruct access
to the buildings for other fire apparatus.
Response: N/A. No sprinkler system or standpipe is proposed for the structure and therefore
the building does not have a FDC.
g. Fire department connections are to be unobstructed with 36 inches clearance to both sides
and 78 inches vertically.

h. An audible/visual device indicating water flow or fire alarm activation shall be located above

i. The fire department connection shall be labeled with code compliant signage indicating the
type of connection and where more than one fire department connection exists additional
signage is required to indicate the area protected.

CAPE FEAR PUBLIC UTILITY AUTHORITY- BERNICE JOHNSON

Response: Acknowledged.
Comment 2: Utility Plan review required by CFPUA. CFPUA is moving toward becoming paperless. When
ready to submit plan review package, upload all documents to

Response: Acknowledged. The applicable applications have been completed and are being submitted through
the CFPUA submittal portal.
Comment 3: CFPUA water and sewer available.
Response: Acknowledged.

Response: Acknowledged. The applicable applications have been completed and are being submitted through
the CFPUA submittal portal.
Comment 5: CFPUA Meter Sizing Form will be required.
Response: Acknowledged. A meter sizing form is being completed and will be submitted for review.
Comment 6: Location currently has CFPUA water and sewer. If existing water and sewer services are not
used, they will need to be properly abandoned. Water will need to be abandoned at the main.
Response: Acknowledged.
Comment 7: It appears a NCDOT Encroachment will be required.
Response: Acknowledged. A NCDOT Encroachment Agreement has been executed by the applicant and has
been submitted to CFPUA for signature.
Comment 8: Additional Notes: CFPUA does not allow half size services. Irrigation tap will need to be 1” or
2”. Sewer service will need to be 6”.

Response: Irrigation line has been revised to a 2”. Sewer service is proposed as a 6” line and located at the
same location of the existing 6” sanitary tap..
NDOT- NICK DREES
Comment 1: NCDOT Driveway Permits, and Encroachments are submitted through the NCDOT Online Portal.

Response: Acknowledged. A NCDOT Encroachment Agreement has been executed by the applicant and has
been submitted to CFPUA for signature.
Comment 2: A NCDOT Driveway Permit is required. Submit plans in accordance with pages 14 and 15 of the
Policy on Street and Driveway Access to North Carolina Highways to include access locations within 500’ of
the proposed access on both sides of the State Road. Submit to the local NCDOT District Engineer’s Office
Response: Acknowledged. See revised plan sheet CS1001 which now includes a plan depicting all access
locations to Market St. within 500’ of the proposed access. A NCDOT Driveway Permit application along with
the plans are being submitted to the District’s Office for review.
Comment 3: A NCDOT Encroachment Agreement is required for any utility connections or installations within
NCDOT right-of-way.
Response: Acknowledged. A NCDOT Encroachment Agreement has been executed by the applicant and has
been submitted to CFPUA for signature.
Comment 4: Show/Label the 10’ X 70’ NCDOT sight triangles.
Response: Sight triangles have been added to sheet CS2001.
Comment 5: No obstructions shall be placed within the NCDOT sight triangles.
Response: Acknowledged.
Comment 6: No obstructions shall be placed with the stopping site distance. Reference table 3-1 (for level
roadways only).
Response: Acknowledged.
Comment 7: Driveway will need to be paved from edge of pavement to r/w line (minimum).
Response: Driveway is now shown to be asphalt pavement from the r/w line to edge of Market St pavement.
A standard detail for asphalt can be found on sheet CS6001, and a pavement legend has been added to sheet
CS1001.
Comment 8: The Radii needs to be adjusted to accommodate the fire truck turning in from the right lane, it
is now showing that it is coming across two lanes of traffic and entering the site into exiting traffic.
Response: Radii on driveway apron has been revised along with truck movements on sheet CS9801.
Comment 9: The garbage truck auto-turn is the same, it is cutting across two lanes of traffic to enter into the
site.
Response: Auto-turn has been revised, and now shows the truck turning into site from right turn lane in Market
St..

included with this resubmission. A revised Stormwater design packet has been included with this resubmittal
for conveyance design calculations.

WMPO- JAMAR JOHNSON
Comment 1: Please revise site driveway. Turning templates show the design vehicles performing conflicting
movements for site ingress.
Response: Driveway apron radii has been revised. Also see a revised CS9801 for revised Auto-Turn truck
movements.
