Wetlands associated with Smith Creek may be located within the limits of the proposed development. The Corps of Engineers' statutory authority, pursuant to Section 404 of the Clean Water Act, regulates the discharge of dredged or fill material in waters of the United States, including wetlands. As defined by the 1987 Corps of Engineers Wetland Delineation Manual, wetlands are areas which contain hydric soils, wetland hydrology, and a predominance of hydrophytic plant life. Work in wetlands including ditching, mechanized land clearing, excavation, road construction, and the placement of fill material, must receive pre -construction authorization by Department of the Army permit. To prevent an unintentional violation of Federal law, wetlands should. -be identified, delineated, surveyed and indicated on development: plans before any construction is begun. I am responsible for administering the Corps' regulatory program in New Hanover County and may be contacted to identify wetlands. Since my workload may not allow a timely response, you may want to contact an environmental consultant. Delineation of wetlands performed by a consultant should be verified by the undersigned. Stowell, District Conservationist RE: BRITTANY LAKES DATE: July 25, 1996 I have reviewed this plan as requested and have these comments: The Soils are;p.redominantly, Seagate Fine.'Sand(Se)_ There are also areas of Baymeade Fine Sand, (Bej and Murville'Fine Sand (.Mu).' Along the creek is Johnston Soil (Jo). According to the booklet, "Wilmington/New Hanover Classifications, Seagate and Baymead are Class II and Murville is Class III; Johnston is CLASS IV. The Soil Survey -of New Hanover County lists Seagate as somewhat poorly drained, Murville'and Johnston -as very poorly drained and Baymeade as well drained. On the poorer drained soils, an adequate drainage and maintenance plan is needed for suitable housing. Murville and Johnston are on the New Hanover.County HYDRIC Soil "A - List" which means they are possibly wetland areas and subject to regulation under the Clean Wager Act. Seagate is on the Hydric Soils "B-List" which means that area might contain smaller areas of wetland.
