Fifth St. Wilmington, NC 28401 RE: Brittany Woods-2 (Performance Development) Dear Mr. Stocks: A preliminary plan for the referenced project was reviewed by the Technical Review Committee of the County Planning Board on October 27 and approved pursuant to Section 102-4 of the County Zoning Ordinance. • Attending the meeting were: Wesley Nixon, Chairperson; Joyce Fernando, Charlie Howell, and James Wolle, TRC members; Wayne Kimbrell, County Engineer; Bill Grathwol, Developer; members of the Planning staff and you. A total of 112 units as indicated in your land use summary are approved. This approval shall be valid for one (1) year. The plan will automatically expire if a final plat for all or part of the plan is not recorded within twelve months. You may request a preliminary plan extension from the Technical Review Committee if you are not able to record a map in the prescribed time. All extension requests must be made prior to the plan's expiration date. If you desire to record a map prior to the completion of required improvements, a surety in the form of a letter of credit, bond, or cash in escrow must be posted. However, a cost estimate must be submitted to and approved by County Engineering before the surety is presented. The Corps of Engineers' regulatory jurisdiction, pursuant to Section 404 of the Clean Water Act, manages the placement of excavated or fill material in wetlands, areas exhibiting saturated, organic soils and hydric vegetation. Such work, including road construction and the placement of fill material to raise elevations, must be permitted by Department of the Army authorization before it is begun. To prevent an unintentional violation of Federal law, before any construction is begun, wetlands should be identified, delineated, surveyed and indicated on development plans. Mr. Jeff Richter in our Wilmington Field Office is responsible for our regulatory program in New Hanover County and may be contacted to identify wetlands. However, because of the delay that his workload will inflict on a timely response, you may choose to engage an environmental consultant. The efforts of the consultant, the delineation of the wetlands, will be subject to Mr. Richter's verification. We do not recommend, endorse or exclusively approve any consultant. A smaller area of the resource is located along a un- named branch leading from the creek into Brittany Woods Phase II. No flagging was provided along the un-named branch. The total area of swamp forest acreage on the site is about 107. Of that, approximately 60o will be preserved. Based on a cursory review of the plan only, and pending a complete Stormwater Submittal, this project will be able to meet the State's requirements for Curb and Gutter Density with the following items addressed in the Stonnwater Submittal: 1. Revised Submittal Forin including submittal authorization and deed restriction. 2. Calculations of density and swale velocity. 3. Again, as in the submittal for Gordon Woods Subdivision, the extensive piping shown is not acceptable. The surveyor is showing the 100' grassed swales required to meet our requirements as part of a wet ditch that already accepts flow from other pipe outlets. This defeats the purpose of the dry grassed swale to settle the pollutants. Please eliminate as much piping as needed to provide 100' grassed swales prior to entering any perimeter property ditches or ditches that already accept runoff from upstream swales and that drain upland areas. 4. A signed and notarized Operation and Maintenance Plan for continual upkeep of the swales. 5.
