This is to advise that the revised construction plans for Phase 2, Brittany Woods Subdivision, has been
reviewed and approved by the Department of Transportation, Division of Highways. During this review it
was noted that said plan meets the minimum construction requirements for subdivisions. With the
following exceptions. Elite Drive, Privet Place, and Zest Way, southwest of Wren Court cannot be
considered for addition to the state system until it is -extended to an intersection or a permanent cul-de-sac
is constructed. Also, before Privet Place can meet the requirements for a residential collector road the 300
feet radius must be changed to a 310 feet radius.
Attached is a copy of the approved plan, together with a copy of District Subdivision Inspection Policies,
and Slope and Drainage Requirements for driveway pipe installations for your ready reference in the
construction of this subdivision. It should be noted that driveways are to be graded to meet the shoulder
grades as shown on the attached drawings.
Only state approved materials are to be used in the construction of this project for it to be state approved. A
driveway permit will be required for any entrance adjoining a state maintained road.
Any utilities located within the right of way i ;,ill require an encroachment agreement be executed at the time
the road is considered for addition to the state system.

Subject: Submittal Requirements
Brittany Woods Subdivision
New Hanover County
Dear Mr. Grathwol:
Per our meetings in June and today concerning the April 1995 letter from this Office requesting
a stormwater submittal for any portion of the Brittany Woods project that required a revised Erosion
Control plan. The following items were discussed and agreed upon as they pertain to the development
at Brittany Woods:
1. Portions of the project to be sold to other developers will obtain their own Sedimentation
and Erosion Control plan, therefore, those portions will be required to deal with
stormwater on their own.
2. The overall total built -upon area will be 30 % or less. Built -upon area includes roads,
driveways, houses, sidewalks, patios, etc. It does not include wood decking and the water
surface of swimming pools. A "bank account" of the total allowable built -upon area can
be set up with the master plan approval, with the built -upon area from each subsequent
project being subtracted from the total allowed.
3. Brittany Woods currently uses a combination of piping, grassed swales, and existing or
planned detention ponds for stormwater control. The use of piping is not allowed for a low
density submittal, however mitigation for the excessive use of piping and curb and gutter
will be allowed. Any ponds that are used as mitigation must have a minimum depth of 3',
and provide storage for the runoff.
4. A minimum of 50 % of the Class IV soils adjacent to Smith Creek will be designated and
restricted as conservation areas. Impacts to the fringe wetlands along Smith Creek will be
minimized.

5. A signed and notarized Operation and Maintenance plan will be required for each pond.
6. Prior to the start of construction for any portion of the Brittany Woods tract, you will
submit 2 sets of plans, calculations of. the built -upon area, a completed permit application
form, appropriate pemit fee, pond volume calculations, and an O & M plan if a pond is
utilized.
7. Pipe invert elevations will be labelled on the plans.
