Subject: Request for Addition of Brays Drive within the Porters Pointe Subdivision in New
Hanover County to the State Secondary Road System (Division File No. 1192-N)
Dear Mr. Weaver,
This office has received your petition requesting the Division of Highways to add the roadways
listed above to the State Highway System for maintenance in Porters Pointe Subdivision in New
Hanover County. The Division of Highways (DOH) requires that the following standards be
complied with before a subdivision street may be added to the State System:
No "Basic Letter" has been issued by the North Carolina Department of Transportation
(NCDOT). The letter would indicate to the developer/Home Owners association that the
constructed roadways and drainage systems were inspected by NCDOT, which confirms
construction compliance per the approved preliminary plans dated November 30, 2006.
A letter indicating compliance requirements for drainage structures to meet department
standards was provided to; Cape Fear Paving Company Attention M. Hargrove, P.E. (date
of letter: November 16, 2011).
All encroachments for utilities within the rights -of -way have not been received.
After an investigation of your petition by inspectors of the DOH, it has been determined that the
roadways listed do not meet the standards for addition to the system at this time. The standard(s)
which have not been met are listed above. Therefore this letter serves as notification that the
petition for road addition has been denied. If there are any questions concerning this action,

ALTHOUGH I UNDERSTAND BETH'S POINT OF THE NEW DISTURBANCE PERMIT, ETC I TOTALLY
DISAGREE WITH HER ON THIS.. I AM NOT DISTURBING ANY NEW LAND AND I AM ALSO NOT
DEVELOPING ANYTHING -ALL I AM DOING IS BUYING FINISHED LOTS ALREADY APPROVED BY ALL OF
THE APPROPRIATE AGENCIES. I DO NOT WANT TO ASSUME ANY OF THESE RESPONSIBILITIES B/C I
DID NOT DEVELOP THIS PARCEL. I WOULD LOVE TO CREATE ALMOST 2 MILLION DOLLARS WORTH OF
TAX BASE FOR THE COUNTY BUT I AM NOT WILLING TO ASSUME FINANCIAL RESPONSIBILITY OR
LIABILITY FOR SOMETHING THAT I SHOULD NOT HAVE TO. AGAIN IF I BUY THESE LOTS, THEY ARE
LEES A TENTH OF THE OF THE PROJECT. PLEASE RESPOND BACK TO ME WITH YOUR THOUGHTS BY

SAM - The land disturbing permit will need to be revised. Need a new application, 3 sets of plans with new
limits of disturbance and erosion control, A $200 review fee and $400 land disturbing fee for the lots.
BRETT - Garry Pape was the previous engineer with Withers and Ravenel. He is with GPS now and might be
able to help you change the limits of disturbance for the lots on the plan. His number is 332-5939. If you are
going to have to repair one of the ponds that area will HAVE to be within your limits of disturbance. You may
need a travel path to the pond and since it is probably owned by the HOA I will need a notarized letter from
them allowing you to do the work.

I met with Bret Bostic this afternoon.
The CFPUA is ok with this subdivision.
The water and sewer mains are installed and certified and the laterals and taps and
Meter boxes are installed also.
No issues here on this end.
System Development Charges (SDCs) are due and payable at time of application for
A building permit.
