Meeting Minutes
October 19, 2023
I. Call to order
Chairman Bruce Shell called to order the regular meeting of the New Hanover County
Alcoholic Beverage Control Board at 9:00am on October 19, 2023 at the General
Office, 6009 Market Street, Wilmington, NC.
11. Chairman confirms quorum
The following Members of the Board were present:

James Casteen, Assistant General Manager

III. Conflict of Interest Reminder
Mr. Shell verbally confirmed that the Board members had read the following ethics
reminder:
"In accordance with General Statute I8B-201, it is the duty of every Board member to
avoid both conflicts of interest and appearances of conflicts. Does any member have
any known conflict of interest or appearance of conflict n4th respect to any matters
coming before the Board today? If so, please identify the conflict or appearance of
conflict and refrainfrom any undueparticipation in theparticular matter involved. "
Let it be recorded that no conflicts were identified by any Board member regarding this
Board meeting.
IV. Consent Agenda Items of Business
Mr. Shell presented the minutes from the Regular Meeting of July 20, 2023. Mr. Dickerson

made the motion to approve the minutes as written. Mr. Burney seconded the motion, all
approved. -
Mr. Shell presented the proposed meeting agenda. Mr. Dickerson made the motion to
approve the agenda as written. Mr. Rivenbark seconded the motion, all approved.
V. Regular Agenda Items of Interest
Health Insurance Renewal — Mr. Welty, advised the Board that the Health
Insurance Committee and Staff met with the current Health Insurance Agent,
Tommy Mann, with One Digital. The renewal came in with a 5% increase in cost
and an increase of $1,000 in the Total Out of Pocket, taking it to $6,000. The
Committee and Staff agree that we renew the policy with United Healthcare with
the 5% increase in cost and the increase in the Total Out of Pocket. They also
recommend raising the Healthcare Reimbursement Agreement by $1,000 to cover
the increase in the Total Out of Pocket. This would take the Healthcare
Reimbursement Agreement for this upcoming Policy period to $1,000 of the
Deductible and $1,500 of the Total Out of Pocket. Mr. Burney made a motion to
accept the renewal with United Healthcare, with a 5% increase in cost, and raise
the Healthcare Reimbursement Agreement to $1,000 of the Deductible and
$1,500 of the Total Out of Pocket. Mr. Dickerson seconded the motion, and all
approved.
VI. Administrative Reports
• ABC Law Enforcement Officers' Unit Monthly — (ALE) Report for September was
presented by Mr. Hill. Please see the attached LE Monthly Reporting Numbers from the
North Carolina ABC Commission website (Attachment "A").
Financial Statements — Mr. Casteen and Ms. Clark presented a copy of the Board
Financial Statements for September, 2023. The Financial Statement showed, the
Actual -to -Actual comparison Gross Sales more than the prior September by $135k
(2.33%), Operating Expenses more than prior September by $19k (3.50%), and Income
from Operations was more than prior September by $61 k.
• Outreach & Communications Update -- Ms. Iammatteo updated the Board on the
progress of the Linkin, Facebook and Bourbon Blast with increases in followings. She
also advised that a survey had been sent out to get input from followers on each platform,
in one day over 800 had responded to the survey.
• General Manager Updates
• Renewal of Interlocal Agreements for ABC Enforcement — Mr. Hill advised that
the Town of Wrightsville Beach requested a decrease in the number of ABC Officers
from 3 to 1. This agreement will be sent to them this week.
Capital Ordinance Restriction Request — Mr. Hill and Mr. Rivenbark advised the
Board that the New Hanover County Commissioners approved on October 16, 2023

the request for a Capital Ordinance Restriction of $4 n-fillion, for purchase of property
and construction of a new store.
Real Estate Agent — Mr. Hill advised the Board that at the September 21, 2023
Regular Board Meeting, that they had approved the retainment of Mr. Thomas Wolfe.
As the Board's Real Estate Agent at a rate of 3.5% commission in the search for
property to build a new store. The rate of commission was misstated, it should have
been 4.5%. Mr. Rivenbark made a motion to increase the commission rate for Mr.
Thomas Wolfe to 4.5%. Mr. Burney seconded the motion, and all approved.
Press Release — Mr. Hill advised that a press release will be prepared over the next
couple of weeks for the distributions of the $4,511,245 to the municipalities.
VIT. Adjournment
Mr. Shell advised the Board the next regular Board Meeting is scheduled for Thursday,
November 9, 2023 at 9:00 am at the General Office, 6009 Market Street, Wilmington,
NC.
Mr, Burney made the motion to adjourn the meeting; Mr. Dickerson seconded the motion,
and all approved.
