Zach,
Seems reasonable. One caveat I just remembered is that stormwater has not been fully engineered. From Galen’s
comments, we know that some buffers will have stormwater easements/potenƟally augmented vegetaƟon outside of
the easement. I am not sure how to best idenƟfy this, but maybe some version of: “a combinaƟon of buffer and
landscaped open space as shown on plan”

That’s very helpful, thanks. I think with the buffer condiƟon, because the numerical value swings widely, it’s best not to
include one. I am thinking of keeping it along the lines of, “where shown on the concept plan, exisƟng vegetaƟon will be
preserved and augmented for use as buffers against adjacent residenƟal properƟes.” Once I get all the condiƟon
wordings ironed out I’ll send them over to you.

Hey Allison,
Ironing out a few details for the staff report, couple of quesƟons:
1. We would like to get the building height/stories as a condiƟon. Since the RMF-M could permit up to 4-story
buildings with addiƟonal setbacks, etc. Much like we did with the Monkey JuncƟon Townhomes/Apartments
that went through recently, this would look like “Building height will be a maximum of 3 stories.” We have it
noted as 3 stories max. on the condiƟonal rezoning plan, but if is beƩer for you all to add it as a condiƟon, I see
no issue.
2. It was stated in the applicaƟon that the live oak trees along the southwestern property line, we’d also like to add
a condiƟon about these. Something like “ExisƟng trees on site that do not impact essenƟal site improvements
will be preserved.” I need to ask the developer about the language they are comfortable with, but, in concept, I
see no issue.
3. The concept plan states that the exisƟng heavily vegetated areas along the periphery will be used as a buffer to
adjacent residenƟal areas, in some cases being wider than the requirements for those buffers. Do you know the
width of these exisƟng buffer areas? Against residenƟal areas, the width of buffers varies greatly from about 30’
to 140+’ I think we even have nearly 200’ in some locaƟons. I do not know exactly how to clearly idenƟfy it, but
we will have a graphic available in the presentaƟon with some dimensions on it. The 30’ buffer is near the
exisƟng CFPUA easements, so we will have to work with them on approval of the buffers. Otherwise, we have
some wide buffers that will need revegetaƟon. It is safe to say we will work with exisƟng vegetaƟon and
augment buffers when exisƟng vegetaƟon does not meet buffer requirements. Let me know if you need more
informaƟon on this – I may not have addressed your concern…not sure.
4. Has the applicant made a deal with the Porters Pointe HOA about paving their side of the Brays Drive access? If
there’s not pavement connecƟng them, Emergency Services are going to have an issue. We understand the road

must connect to meet the secondary access requirements. You can add it as a condiƟon if need be. Our client is
talking further with HOA, but I have not been updated on the conversaƟon today.

We’re sƟll working through the specific wording on this, but staff would like to suggest a condiƟon for bike and ped
connecƟon through the Brays Drive access point.
We understand this is a public road that has not yet been turned over to NCDOT, thus it’s sort of an orphan road, but we
think it would be prudent to at least have a bike/ped connecƟon for this development to Ɵe into the exisƟng sidewalk
system that’s in that neighborhood.
We’re working through staff report edits now, and will let you know when those are finalized.

A couple of iniƟal housekeeping quesƟons / items we noƟced:
Has Mr. Carlock recently acquired Bee Safe Porters Neck LLC? The May 2023 filing for the LLC list Stephen
Anderson, Roy Carroll, and Adam Spivey. The owners have resigned applicaƟons to align with the appropriate
LLC. See aƩached.
8138 Market Street is showing the owner as TP Holdings LLC managed by James Parker, has this been acquired
by Bee Safe Porters Neck LLC? The property was sold. If you look on GIS, the iniƟal record shows as TP
Holdings, but the sales porƟon of the site idenƟfies the sale to Bee Safe with a new deed. I believe the NHC
records are not fully updated at this Ɵme. See Book 6643 PG 1104, recorded June 2, 2023
Mr. Yunaska is listed in the applicaƟon but there is not an agent authorizaƟon form. Can you send an
authorizaƟon form for his porƟon of the project or where he’s signed the applicaƟon? Sorry – this informaƟon is
included as aƩached. We also have a clarificaƟon on the small piece of the Industrial zoned parcel being
included in this rezoning.
We’ll also need either a narraƟve of the exisƟng vegetaƟon or a tree survey for the site. I was trying to simplify
by including the exisƟng vegetaƟon narraƟve on the condiƟonal rezoning plan, but with the quesƟon, we are
providing the exisƟng condiƟons plan for clarificaƟon.
