ASSEMBLY
The New Hanover County Board of Commissioners met in Regular Session on Monday, November 16,
2009, at 9:00 a.m. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street,
Wilmington, NC.
Members present were: Chairman Ted Davis, Jr.; Vice-Chairman Jason R. Thompson; Commissioner
William A. Caster; Commissioner Jonathan Barfield, Jr.; County Attorney Wanda M. Copley; Clerk to the Board
Sheila L. Schult; and County Manager Bruce T. Shell.
Commissioner Robert G. Greer was absent.
Chairman Davis called the meeting to order and welcomed everyone present.
INVOCATION AND PLEDGE OF ALLEGIANCE
Associate Pastor James Strickland, Pine Valley Baptist Church, gave the invocation.
Vice-Chairman Thompson led the audience in the Pledge of Allegiance to the Flag.
APPROVAL OF CONSENT AGENDA
Chairman Davis asked if any member of the Board would like to remove any item from the Consent
Agenda.
Hearing no comments, Chairman Davis called for a motion to approve the items on the Consent Agenda.
Motion:
Commissioner Caster MOVED, SECONDED by Vice-Chairman Thompson, to approve the items on the
Consent Agenda as presented. Upon vote, the MOTION CARRIED 4 TO 0.
CONSENT AGENDA
Approval of Minutes Governing Body
The Commissioners approved the minutes from the Regular Session meeting held on November 2, 2009 as
presented by the Clerk to the Board.
Ratification of Grant Application Submitted to the North Carolina Department of Health and Human
Services Division, Acceptance of Grant Funding and Adoption of Budget Ordinance Amendment 10-094
Health Department
The Commissioners, at the request of the Health Department, ratified the grant application submitted to the
North Carolina Department of Health and Human Services, Division of Public Health Chronic Disease and Injury
Section, Tobacco Prevention and Control Branch in the amount of $7,617, accepted the grant award, and adopted
Budget Ordinance Amendment 10-094. No local match is required. The funds will be used as follows:

$1,512 for the purchase of coasters for distribution to restaurants and bars.
·
$6,105 for public education.

in Exhibit Book XXXII, Page 22.1.
Ratification of Grant Application Submitted to the North Carolina Division of Emergency Management for
Homeland Security Grant Funding Health Department
The Commissioners, at the request of the Health Department, ratified the grant application submitted to the
North Carolina Division of Emergency Management for Homeland Security Grant funding in the amount of
$56,200. If awarded, the funds will be used to purchase fourteen 800 MHz radios to further enhance the ability for
interoperable communications with first response partners throughout the North Carolina Domestic Preparedness
Region III and to facilitate a regional interoperable communications exercise with Brunswick, Pender, Bladen,
Carteret, Columbus, Hoke, Jones, Onslow, and Robeson Counties. No local match is required.
Ratification of Letter of Intent Submitted to the American Recovery and Reinvestment Act 2009 in
Partnership with New Hanover County Schools for Communities Putting Prevention to Work Funds Health
Department
The Commissioners, at the request of the Health Department and in partnership with New Hanover County
Schools, ratified the letter of intent submitted to the American Recovery and Reinvestment Act of 2009 for
Communities Putting Prevention to Work Funds. If awarded, the funds will be used to address tobacco prevention
through the Cape Fear Healthy Carolinians Coalition. No local match is required.
Approval of Updated Records Retention and Disposition Schedule and Amendment dated September 28,
2009 Sheriffs Office
The Commissioners, at the request of the Sheriffs Office and according to the North Carolina Department
of Cultural Resources, Division of Archives and History, Local Unit of the Government Records Branch, approved
the Updated Records and Retention and Disposition Schedule and the Amendment dated September 28, 2009.
These updated guidelines and amendment will allow the Sheriffs Office to enhance and standardize their records
policy and avoid having to retain obsolete documents.

Authorization to Submit a Grant Application to the United States Department of Health and Human Services
Department of Social Services
The Commissioners authorized the Department of Social Services to submit a grant application to the
United States Department of Health and Human Services, Office of Family Assistance, National Fatherhood
Initiative, in the amount of $25,000. If awarded, the funds will be used to develop the fatherhood program and to
improve financial sustainability to receive federal and/or private support. No local match is required.
Approval of Release of Tax Values Tax Department
The Commissioners granted the recommended taxpayers the senior citizen/disability exclusion as
presented.
A copy of the senior citizen/disability exclusion report is hereby incorporated as a part of the minutes and is
contained in Exhibit Book XXXII, Page 22.2.
Adoption of Resolution to Accept Donation of Computers and Various Office Equipment from the Veterans
Administration Medical Facility and Adoption of Budget Ordinance Amendment 10-097 Youth
Empowerment Services
The Commissioners, on behalf of Youth Empowerment Services, adopted the resolution accepting the
donation of computers and office equipment from the Veterans Administration Medical Facility and adopted Budget
Ordinance Amendment 10-097. The fair market value is in the amount of $10,307.

and are contained in Exhibit Book XXXII, Page 22.3.
Adoption of Budget Ordinance Amendments Budget Department
The Commissioners adopted the following Budget Ordinance Amendments for fiscal year ending June 30,
2010:
10-083 - Youth Empowerment Services
10-089 - Youth Empowerment Services
10-090 - Library
10-093 - Health
2010-32 - Sheriff's Office
2010-33 - Sheriff's Office

REGULAR ITEMS OF BUSINESS
STATE OF THE COUNTY ADDRESS
Chairman Davis presented the annual State of the County Address.

PRESENTATION OF NEW HANOVER COUNTY SERVICE AWARDS
County Manager Shell requested the following employees to step forward to receive service awards:

RECOGNITION OF NEW EMPLOYEES
County Manager Shell requested the following new employee to stand and be introduced:

On behalf of the Board, Chairman Davis welcomed the new employees to County Government and wished
them success in their new position.
ADOPTION OF PROCLAMATION RECOGNIZING DECEMBER 5, 2009 AS IN
TUBA CHRISTMAS DAY
NEW HANOVER COUNTY
Chairman Davispresented the request for the Boards consideration to proclaim December 5, 2009 as Tuba
Christmas Day in New Hanover County.
Commissioner Barfield read the proclamation into the record and moved for adoption.
Motion:
Commissioner Barfield MOVED, SECONDED by Commissioner Caster, to adopt the proclamation
recognizing December 5, 2009 as Tuba Christmas Day in New Hanover County. Upon vote, the MOTION
CARRIED 4 TO 0.

XXXII, Page 22.6.
PRESENTATION ON THE 2010 CENSUS AND ADOPTION OF RESOLUTION
Chairman Davis reported that Constance L. Hyman, Partnership Specialist, U.S. Census Bureau, Charlotte
Region was present to make a presentation on the 2010 Census and to request the Board adopt a resolution of
support.
Constance L. Hyman, Partnership Specialist, U.S. Census Bureau reported that in March 2010, the 2010
Census will be sent to every resident and she encouraged community participation requesting the Board adopt a
resolution of support.
Vice-Chairman Thompson read the resolution into the record and moved for adoption.
Motion:
Vice-Chairman Thompson MOVED, SECONDED by Commissioner Caster, to adopt the resolution
supporting the 2010 Census. Upon vote, the MOTION CARRIED 4 TO 0.

COMMITTEE APPOINTMENT
Appointment to the Zoning Board of Adjustment
Chairman Davis reported that a vacancy needs to be filled on the Zoning Board of Adjustment with five
new applications having been received and requested direction from the Board.
Commissioner Caster nominated Justin Michael Lewis. The nomination was seconded by Vice-Chairman
Thompson.
Chairman Davis nominated H. Scott Kennedy, Jr. No second was received.
Hearing no further nominations, Chairman Davis called for a vote on the nomination of Justin Michael
Lewis.
Motion:
Commissioner Caster MOVED, SECONDED by Vice-Chairman Thompson, to appoint Justin Michael
Lewis to serve a three-year term on the Zoning Board of Adjustment with the term to expire December 1, 2012.
Upon vote, the MOTION CARRIED 4 TO 0.
NON-AGENDA ITEMS
Chairman Davis announced that time had been reserved to allow the public to present an item that was not
listed on the regular agenda. He requested all persons speaking to limit their remarks to three minutes.
Doug Capps voiced his concern on the hardship that the increased water and sewer fees are having on
senior residents and requested the Board of Commissioners request the Cape Fear Public Utility Authority provide a
discount to seniors on utility rates.
Commissioner Caster encouraged Mr. Capps to attend one of the Cape Fear Public Utility Authority Board
meetings to present his request personally to the Authority Board.

ADDITIONAL AGENDA ITEM
AUTHORIZATION FOR THE CHAIRMAN, ON BEHALF OF THE BOARD, TO SEND A LETTER OF
SUPPORT FOR THE NOMINATION OF BEN SIMMONS, JR. TO FILL A VACANCY ON THE NORTH
CAROLINA COASTAL RESOURCES COMMISSION
Commissioner Caster presented the request for the Chairman, on behalf of the Board, to send a letter of
support for the nomination of Ben Simmons, Jr. to fill a vacancy on the North Carolina Coastal Resources
Commission. The deadline for the application is December 5, 2009.
After brief discussion, Chairman Davis requested direction from the Board.
Motion:
Commissioner Caster MOVED, SECONDED by Vice-Chairman Thompson, to authorize the Chairman,
on behalf of the Board, to send a letter of support for the nomination of Ben Simmons, Jr. to fill a vacancy on the
North Carolina Coastal Resources Commission. Upon vote, the MOTION CARRIED 4 TO 0.
ADJOURNMENT
There being no further business, Chairman Davis adjourned the meeting at 9:52 a.m.
