New Hanover County’s Technical Review Committee (TRC) will meet Wednesday, February 7, 2024
at 2:00 p.m. to discuss the below items.

Request by Luke Menius on behalf of CHR Properties, LLC for warehousing. The site is 16.09 acres and is
zoned B-2, O&I and AC. The total square footage of the development is 107,100 sq ft. The engineer is
Luke Menius with Stroud Engineering, (lmenius@stroudengineer.com). The case planner is Zach
Dickerson (zdickerson@nhcgov.com, 910-798-7450).

The following comments have been received for the February 7th, 2024, TRC meeting. Additional
comments may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.
NHC Planning, Zach Dickerson 910-798-7450
1. General Comments –
a. Please apply for a demolition permit for the existing building at 2400 Castle Hayne Road.
2. UDO Section 3.3.1, Superseding District Standards & Setbacks
a. It looks like a portion of this section, noted by the red line here, is also within the AR
zoning district per New Hanover County GIS (not exact, forgive my drawing skills). This is
not noted on the site plan. Please confirm. Depending on where exactly that line is,
buildings 10 & 11 may need to be adjusted.

3. UDO Section 5.1 Parking and Loading
a. Parking is sufficient per the UDO.
b. Are the loading areas in the office uses going to block employees from using the parking
area while a truck is there?
4. UDO Section 5.2. Traffic, Access, & Connectivity
a. Please note primary site access on the site plan and secondary site access where any is
proposed.
b. Please note on the site plan that “No building permit for any structure shall be issued
which requires NCDOT approval for a Driveway Permit until NCDOT has issued the permit
approval. Evidence of approval shall accompany the application for the building permit.”
5. UDO Section 5.3 Tree Retention
a. Narrative states that proposed development area of the site is already cleared of
vegetation and aerial imagery confirms. If there are any other trees slated for removal,
please apply for a Tree Removal Permit.
6. UDO Section 5.4 Landscaping and Buffering
a. Where are the required 210 trees to be planted per acre disturbed going to go?
b. If there are some trees that are being retained, these can be credited towards this
requirement (maybe the small area of trees to the east?).
c. Please detail the required trees for the interior parking lot landscaping.
d. The landscaping plan states that existing vegetation will be used for buffering from the
commercial use to the adjacent residential uses. Can you please provide examples of how
this existing vegetation will meet the minimum requirements?
e. Please provide a planting schedule/inventory for the landscaping on this site.
7. UDO Section 5.5 Exterior Lighting
a. Is any lighting proposed for the development?
b. Please note that with the latest update to the UDO, a lighting plan is not required at time
of TRC approval. See below excerpt from Section 5.5.3:
i. Information about the exterior lighting for the site that demonstrates compliance
with the standards in this section shall be submitted in conjunction with an
application for site plan approval (Section 10.3.6, Site Plan) or zoning compliance
approval (Section 10.3.8, Zoning Compliance Approval), whichever comes first,
approved no later than at time of construction plan approval.
c. When the lighting plan is submitted, please ensure that the foot candles from the street
lights at the lot lines do not exceed 0.5, as the adjacent land is residential.
8. UDO Section 5.6 Signs
a. Please note that all signs are subject to Section 5.6 of the UDO.
b. Please submit for sign permits prior to installation.

9. UDO Section 5.7 Conservation Resources.
a. New Hanover GIS records indicate the majority of the site is within the Swamp Forest
Conservation Overlay District. This may reduce the developable area of the site. Please
get up with the Army Corps of Engineers for wetland delineations on the site.
b. Please refer to UDO Section 5.7.3 for Conservation Space General Performance Controls.
c. Please refer to UDO Table 5.7.3.A.5: Worktable for Determining Required Conservation
Space Developable Land.
d. Please note UDO Section 5.7.3.E Methods for Conservation- it appears that approximately
19 acres of the site are classified as Swamp Forest- using the worktable referenced in the
above comment, this would require 50% of the site to be set aside for conservation space.
e. A Jurisdictional Determination from the Army Corps will provide more specifics about how
much of the site is wetlands, so when that information is available we can run those
calculations together.
10. UDO Article 9: Flood Damage Prevention
a. It looks like the majority of this site is in the AE floodplain.
b. Please refer to UDO Article 9, Flood Damage Prevention for specific development
requirements in the Floodplain.

with questions about Floodplain Development Permits.
NHC Fire Services, Ray Griswold 910-798-7448
1. Chapter 33 - Safety During Construction & Demolition of the Fire Code is required to be followed
2. All Buildings appear to be under 6,000 sq. feet. Is this correct?
3. Add a fire hydrant on Castle Creek Road in front of the Markraft Building / Building 1 on the
street / driveway corner, which ever is easiest.
4. Street numbers / Building numbers are required on All Buildings for ease of Identification.
5. An Engineered Fire Flow shall be provided for the largest structure in this development
6. Fire Finals are required.

1. A land disturbing and a stormwater permit issued by the County are required for this project in
addition to the State stormwater permit. Please submit for permits as the design is completed.
2. It appears a driveway culvert is needed adjacent Bldg 14.
3. It appears the existing drainage patterns for SW8 900811 will be revised near Bldg 4 and the
impervious area from Castle Creek Lane and the existing ditch will be directed to the DI1. If so, a
major modification to the State stormwater permit will be required. Please verify with the State
DEQ office prior to submission for permits.

4. Per Section 7.8.B, 2nd bullet, please include a downstream analysis for existing culvert at Castle
Hayne Rod and should they be found to be undersized, a conceptual design for the required size
with the narrative report for stormwater permitting.
5. There appears offsite drainage coming from the NE parcels that be re-routed through the site to
avoid creating impacts to adjacent parcels. If so, it shall be placed in a revised public drainage
easement sized in accordance with NHC Stormwater Manual. Construction in this offsite
drainage conveyance measures that will be maintained by the county will need to be observed
during construction by Stormwater Services and a turnover meeting scheduled once the system
is ready to be conveyed to the county. Please add a plan note to ensure county construction
observation and a turnover meeting occurs. Note, should the applicant elect to maintain the
conveyance measures themselves, the POA covenants shall indicate the operation and
maintenance roles and responsibilities for the conveyance measure.

1. Site plan reflects connection to public water. Proposed infrastructure must maintain setbacks to
surrounding properties well heads. Development of this property should be mindful of potential
agricultural irrigation wells. Any irrigation wells on the property shall be identified, protected, and
properly abandoned.

surrounding properties septic systems.
