PURPOSE AND SCOPE:
The purpose of this policy is to have a procedure for the adoption of rules by the New Hanover County
(NHC) Health and Human Services Board.
POLICY/PROCEDURE
When enacting regulations as a board, it is the policy of the NHC Health and Human Services Board to
enact regulations that:
• Are related to the promotion or protection of health
• Are reasonable in light of the health risk addressed
• Do not violate any law or constitutional provision
• Are not discriminatory, and
• Do not make distinctions based upon policy concerns traditionally reserved for legislative bodies.
The New Hanover County Health and Human Services Board will adopt rules pursuant to the requirements
set forth in N.C.G.S.-39.
The Board’s internal process for annual rules review is located within the By-laws of the New Hanover
County Board of Health.
